Located: 2875 Pine Tree Road, Cutchogue. SCTM# 104-3-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that proposed actions are INCONSISTENT with the denoted following LWRP Policy Standards as outlined below and therefore is INCONSISTENT with the LWRP. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. 6.1 Protect and restore ecological quality throughout the Town of Southold. 6.2 Protect vulnerable fish, wildlife, and plant species, and rare ecological communities. The action is proposed to be located within a New York Department of Significant Coastal Fish and Wildlife Habitat area. The construction of dock structures in these areas results in the loss of littoral and marine habitats. Town of Southold LWRP CONSISTENCY ASSESSMENT FOR A. INSTRUCTIONS 1. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listine both supportine and non- supportine facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Not Applicable Consistent with Policy 9, the proposed dock will not inhibit public access to or recreational use of coastal waters or public lands, and access along the shoreline will be maintained by the inclusion of two sets of steps that will allow access up and over the elevated fixed catwalk at its landward end. Attach additional sheets if necessary WORKING COAST POLICIES ARTHUR & JULIANE GRUNEISEL 2875 PINE TREE ROAD CUTCHOGUE,NY SCTM #1000-104-3-7 LWRP Policy 6: The project consists of construction of a fixed timber dock similar in design, scope, and seaward intrusion to numerous similar docks located along the same and opposite shorelines and therefore will not cause any fragmentation of ecological communities. The fixed catwalk will be located in a historically trodden path that is presently devoid of wetlands vegetation, and so placement of the elevated catwalk should allow for marsh vegetation to recover underneath it. The dock will be located in the portion of property that was permitted by the Trustees to be dredged out in the late 1960s (Trustee permits 437 & 478) will be situated well within the allowable seaward intrusion into Little Creek of 1/3 the width of the waterway during low tide, and the deck will be constructed with untreated decking. Therefore, the project has been designed to minimize and potential physical loss, degradation, or functional loss of ecological components and will thus be consistent with Policy 6 and the statutory and regulatory requirements of the New York State Tidal Wetlands Act and Chapter 275 of the Town Code. (The project requires modification of the existing Trustees permit authorizing installation of an 8' x 14' floating dock). Policy 10.
