BE IT ENACTED by the Town Board of the Town of Southold as follows: 1. Purpose. Parking associated with County Route 48 in the hamlet of Cutchogue has resulted in conditions that impact the public health, safety and welfare in the surrounding community. The conditions consist of undue congestion, restrictions on access and Parking on CR 48 Public Hearing 2 August 27, 2013 maneuverability as well as dangerous traffic impacts. Accordingly, it is necessary to impose parking and standing limitations in this area to protect the residents and visitors of the Town and restrict the blocking of traffic flow and the orderly use of roads within the Town. Accordingly, Amendments to Chapter 260 are warranted. II. Chapter 260 of the Code of the Town of Southold is hereby amended as follows: § 260-15. Parking or standing prohibited during certain times. IV. EFFECTIVE DATE This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law. I have a notice that it was posted in the Suffolk Times on August 15 2013 and that it was posted on the Town Clerk's bulletin board on August 2, 2013. I have a letter from Suffolk County "Pursuant to the requirements of section A 14-14 to A 14-25 of the Suffolk County administrative code, the above referenced application which has been submitted to the Suffolk County Planning Commission is considered to be a matter for local determination as there is no apparent significant county wide or inter community impact and a decision of local determination should not be considered either an approval or a disapproval." That is from Sara Lansdale, director of planning and Andrew Freleng, chief planner. A letter from Mark Terry, LWRP coordinator, `the proposed local action is consistent with the LWRP, it is also in conformance with chapter 130 of the environmental quality review of the Southold Town code'. From Donald Wilcenski, chairman of the Planning Board, `Thank you for the opportunity to provide comments. The Planning Board supports the legislation as previously stated. As previously stated in our memo of July 11, 2013, the Planning Board along with the Transportation Commission is recommending that signs stating no parking or standing be installed as soon as possible at this location. Numerous safety issues related to parking and standing issues on this section of the road has been documented. We consulted with Suffolk Parking on CR 48 Public Hearing 3 August 27, 2013 County Department of Public Works at this site where their traffic engineer informed us that the shoulders in this area are not adequate for safe parking or standing. Suffolk county Department of Public Works is in favor of these signs. The signs should be located along County Route 48 from Depot Lane west to private road known as Road B on the south side and from the same distance approximately 1420 feet on the north side. They should state no parking or standing. See attached map for the recommended signage.' And that is it. I seriously question their knowledge of coastal processes and inlet dynamics. Most of the study was a rehash of previous studies with conclusions that we already knew, such as the inlet is flood dominant and the channel sills control the tidal prism. What was most astounding to me was an alternative to build anotherjetty when they readily admitted upon questioning that it would do little to improve the ecology of the inlet, and in my opinion would be a detriment to the entire eco-system. Any experienced coastal process engineer knows that utilize two jetties to protect and maintain an essential navigation channel, whose importance outweights the detrimental impact on the down drift side of the second jetty. The only explanation I could come up with for this alternative suggestion was " there is another agenda at work here', or "they really do not understand what is going on". I wish to remind the board that in their December 2010 report to the Town Board on dredging practices, EDD recommended removing the by-pass spit on the east side of the jetty, which is the vehicle that supplies sand to the eastern beach. They also recommended the deeper channel dredging at the "S" bend in the channel. Both of these recommendations resulted in the collapse of the channel bank on the west side of the channel, and severe erosion on the east bank, and contributed to the need for the recent emergency project to amour the west bank to protect the road. I now note that in their current report, they seem to have changed their position on the need for the by-pass spit and now agree with previous studies by the Army Corps of Engineers that the by-pass spit serves a beneficial purpose in moving sand to the eastern beach, and minimizes sand intrusion into the channel and pond. At Saturday's meeting I tried to articulate a way forward that the Town should consider. Before we spend another dime on channel intervention, we need to know first, how deep the pond needs to be at (MLW) mean low water to promote and sustain ecological health. Second, what percentage of the total pond volume of water needs to be exchanged each tidal cycle to maintain its health. Once you have answers to these two questions, you can calculate the tidal prism required and the bathymetry of the channel and sills can be designed. Then you go to the DEC for the necessary permits and approvals. In the meantime do minimal or no channel intervention. Should the mouth of the inlet close up for more that two weeks, send down a bulldozer at low tide to cut an opening in the by-pass spit. Should not take longer than 4 hours. One more recommendation. The Town Board needs to carefully deliberate their selection of consulting partners, with the same level of thoughtfulness that you deliberate a new local law or change in town code. A review of EDD's CV and project history does not indicate a level of expertise sufficient to analyze and understand complex coastal processes and inlet dynamics. Copies to: Suffolk Times Town Board Town Attorney Town Clerk Bulletin Bd Web Site RESOLUTION 2013-587 ADOPTED DOC ID: 9001 THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2013-587 WAS ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON JULY 30, 2013: WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 30`n day of July, 2013, a Local Law entitled "A Local Law in relation to Amendments to Chapter 260, Vehicles and Traffic, in connection with Parking and Standing on County Route 48 in Cutchogue" now, therefore, be it RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at Southold Town Hall, 53095 Main Road, Southold, New York, on the 27th day of August, 2013 at 7:31 p.m. at which time all interested persons will be given an opportunity to be heard. The proposed Local Law entitled, "A Local Law in relation to Amendments to Chapter 260, Vehicles and Traffic, in connection with Parking and Standing on County Route 48 in Cutchogue" reads as follows: LOCAL LAW NO. 2013 A Local Law entitled, "A Local Law in relation to Amendments to Chapter 260, Vehicles and Traffic, in connection with Parking and Standing on County Route 48". BE IT ENACTED by the Town Board of the Town of Southold as follows: 1. Purpose. Parking associated with County Route 48 in the hamlet of Cutchogue has resulted in conditions that impact the public health, safety and welfare in the surrounding community. The conditions consist of undue congestion, restrictions on access and maneuverability as well as dangerous traffic impacts. Accordingly, it is necessary to impose parking and standing limitations in this area to protect the residents and visitors of the Town and restrict the blocking of traffic flow and the orderly use of roads within the Town. Accordingly, Amendments to Chapter 260 are warranted. 11. Chapter 260 of the Code of the Town of Southold is hereby amended as follows: § 260-15. Parking or standing prohibited during certain times. Wilcenski, Chairmar�9�i Date: July 11,-2013 Re: No Parking or Standing Signs on County Road 48 in Cutchogue As a result of documented safety issues on County Road 48 in Cutchogue just west of Depot Lane (see attached map), the Planning Board, together with the Transportation Commission, is recommending that'signs stating "No Parking or Standing" be installed as soon as possible. The Suffolk County Department of Public Works (SCDPW) has approved our moving forward with the necessary steps to do so (see attached email from Robert Hillman, Jr. Traffic Engineer III). Mr. Hillman's observation at the site was that the shoulders on both sides of the road in this area are not adequate or safe for parking. The signs are recommended to be located along County Road 48 from Depot Lane west to the private road known as Road B on the south side, and for the same distance on the north side. They should state "No Parking or Standing". The procedure for the Town to install signs on the County Road is to obtain approval from the SCDPW (I've been assured by Mr. Hillman that the email attached suffices as this approval), and then amend our Town Code as we would for signs on Town roads. Once our Town Code is amended, we are then able to install the signs which are the Town's responsibility to install and maintain. 1 r Approval e-mails from SCDPW to Town to install No Parking or Standing on CR 48. The same for the one-way signs across from their driveway(s)—we think those should go up immediately.Will SCDPW take that responsibility or does the Town pay for and install those signs? Also, we'll be sending another letter to you with the site plan asking for SCDPW's approval of the plan before we'll give any approvals.What we'd be looking for from you is comments on the plan prior to any approvals by your agency.
