Box 1179 Southold, NY 11971 Date: September 29, 2014 This notice is issued pursuant to 6 NYCRR Part 617 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review— SEQR) of the Environmental Conservation Law. The Planning Board of the Town of Southold, as lead agency, has determined, subsequent to review of the Environmental Assessment Form (Parts 1, 2 and 3), review of the proposed Site Plan, review of the Traffic Assessment, input received from community service providers, site inspection, consideration of other relevant factors, and review of 6 NYCRR Part 617, that the proposed action described below will not have a potential significant adverse effect on the environment, and that a Draft Environmental Impact Statement (EIS) need not be prepared. Title of Action: Peconic Landing at Southold, Inc. -Amended Site Plan SEQR Status: Type I Action Location: The site is located on the north side of NYS Route 25, approximately 1,121 feet east of Sound Road, in Greenport. Tax Map Number: District: 1000 Section: 35 Block: 1 Lot: 25 Description of The proposed action involves an Amended Site Plan Application Action: for the construction of two (2) new buildings at the existing Peconic Landing Continuing Care Retirement Community. Proposed improvements include the construction of an 87,426 square foot, three (3) story Independent Living Residential Facility containing 46 apartments and a 46-vehicle parking garage in the lower level, a 35,543 square foot Special Needs Peconic Landing SEQRA September 29, 2014 and Memory Care Facility containing 33-units, and reconfiguration of an existing parking lot [Site Plan, Sheets 1-11, dated June 19, 2012, revised March 19 & June 26, 2014, prepared by Young and Young Surveyors]. The project will require the re-location of two (2) tennis courts in addition to eight (8) parking stalls. Reasons Supporting This Determination: 1. The site has been evaluated in accordance with the Criteria for Determining Significance as contained in SEQRA 6 NYCRR Part 617.7 (c). The proposed action has been evaluated through review of the following materials: • Full Environmental Assessment Form, Parts I, II & III (EAF), last revised September 25, 2014; • Site Plans prepared by Young and Young Surveyors, last revised March 19 & June 26, 2014; • Landscape Plan, prepared by RGR Landscape, dated March 14, 2014; • Traffic Assessment prepared by Schneider Engineering, PLLC, dated July 8 2014; • Letters from local Fire Districts (Southold Fire District, dated September 2, 2014, Southold Town Fire District Council, dated April 22, 2014 and September 16, 2014 and East Marion Fire District, dated February 23, 2013, August 26, 2014 and September 17, 2014); • Record of emergency service calls provided by the Applicant (letters dated June 23, 2014 and September 8, 2014); • Agreement between the Greenport Fire Department and Peconic Landing at Southold, Inc., dated September 22, 2014; • Review by the Southold Town Engineer, dated August 18, 2014; • Ecological investigation conducted by Nelson, Pope &Voorhis, LLC, dated August 19, 2014; • New York State Department of Environmental Conservation (NYDSEC) Letter of Non-Jurisdiction (May 1, 2014); • Capacity Certification/Allocation Letter (sanitary sewer collection and treatment availability letter), dated November 4, 2013; • A Letter of Water Availability from Suffolk County Water Authority, dated January 27, 2014; • Office of Parks, Recreation & Historic Preservation (OPRHP) finding of no significant impact" (letter dated February 6, 2003) and letter of September 10, 2014. 2. The proposed project is not expected to cause any significant adverse environmental impacts based on project design and mitigation inherent in the project as described herein. The Criteria for Determining Significance are specifically evaluated as follows with respect to this action: Page 2 of 4 Peconic Landinq SEQRA September 29, 2014 a. The project will not cause a substantial adverse change in existing ground or surface water quality or quantity, public water supplies, or noise levels, increase in solid waste production, a substantial increase in erosion, flooding, leaching or drainage problems. All disturbance will be set back greater than 100 feet from the on-site wetlands. Additional drainage will be installed for the newly paved areas. The proposed development area of the 144 acre site where proposed improvements will be located is not within a flood prone area. The proposed development is contained mainly to areas of the site which have previously been developed,and disturbances to steep slopes are limited to a small area north/northwest of the existing tennis courts. Retaining wails are proposed within this area to minimize disturbances. An Erosion Control Plan has been prepared to provide Best Management Practices during construction and until the area is re-vegetated/stabilized. b. The project will not result in the removal or destruction of large quantities of vegetation or fauna, impacts on a significant habitat area, substantial adverse impacts on a threatened or endangered species of animals or plants, or the habitat of such a species, or other significant adverse impact to natural resources. There will be some vegetation removal on site, including the removal of several trees, in order to accommodate the proposed parking stalls. No rare or threatened species have been identified in connection with the site and no rare or unique habitats are associated with the site. c. The project will not impair the environmental characteristics of a Critical Environmental Area. d. The project site is currently developed with numerous buildings used in the operation of Peconic Landing at Southold, Inc., a long term, residential health care facility and the expansion from 250 to 329 in residential units would not be in conflict with Town planning objectives. e. The project is not expected to cause impairment of the character or quality of important historical, archaeological, architectural, or aesthetic resources. There are no known archaeological or historical resources within the 5.48 acre project development area. The removal of areas of trees and the installation of the proposed parking area will be partially mitigated by the installation of replacement plantings along the perimeter of the new buildings and parking area. f. The project will not cause a major change in the use of either the quantity or type of energy. g. The project will not create a significant impact to human health based upon the Mitigation Agreement established between the Greenport Fire Department and Peconic Landing at Southold, Inc., dated September 22, 2014, which Page 3 of 4 Peconic Landing SEQRA September 29, 2014 provides for guaranteed training of emergency medical technicians (EMTs) and additional provisions to reduce the burden on local fire districts to respond to emergency calls, as outlined in their Agreement. h. The project proposes an increase from 250 to 329 in residential units/beds. This change will result in an increase in the intensity of use of the site, however, such use would not be out-of-character with the existing land use pattern in the vicinity of the property. The applicant has submitted evidence that the proposed 689 parking stalls are adequate to support the proposed use. Additionally, a Traffic Assessment was completed and demonstrated that traffic generated by the increase in residential units should not have a significant impact on traffic conditions within the immediate area. The Planning Board's review of the Site Plan pursuant to Chapter 280-137(8)(b) of Town Code will assure the adequacy, safety and convenience of vehicular traffic access and circulation, including driveways, rights-of-way, curb cuts, intersections, pavement surfaces, traffic controls and designated areas for access to public transportation. L The project is not related to any other action which may be undertaken, funded or approved by an agency, such that it does not have a significant impact on the environment on its own, but when considered cumulatively, would meet one or more of the criteria. 3. The Town of Southold finds that the documentation prepared is complete in addressing potential adverse environmental impacts related to the proposed project and no significant adverse environmental impacts have been identified. As a result, a Negative Declaration is determined to be appropriate for this project. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project.
