Party of the second part;
Whereas, a certain execution was issued out of the Supreme Court, County of Suffolk,
State of New York in an action between Goggins & Palumbo (judgment Was assigned to
Tristate Capital Holdings LLC, 2885 Sanford Avenue, Sw#17763 Grandville, Michigan
49468, by assignment of judgment filed on the 17`^ day Of January 2013 with the
Clerk'-of Suffolk County, State of New York) as Plaintiff and Ronald Diachun,
defendant;.=who are the parties named in said action, a judgment was rendered in
favor-of Goggins & Palumbo, as judgment creditor and,Ronald Diachun as judgment
debtor for file sum of Thirty Four Thousand, Three Hundred Forty Five Dollars and
30/100 ($34,,345.30). Balance remaining due and unpaid and against said defendant,
Ronald Diachun,for the sum of Thirty Four Thousand, Three Hundred Forty Five
Dollars-and 30/100 ($34,345.30), as appears by the judgment roll filed in the
office-of the Clerk of the Supreme Court, County of Suffolk, which said judgment
was docketed in the office of the Clerk of the County of Suffolk on the Eighteenth
day of October Two Thousand and Twelve.
Whereas, said execution was directed and delivered to the Sheriff of the County of
Suffolk commanding them to satisfy said judgment out of the real property belonging
to the judgment debtor Ronald Diachun on the day when said judgment was so docketed
in said County of Suffolk, or any time thereafter.

at public auction on the thirteenth day of August, 2013, all the estate, right,
title and interest which on the eighteenth day of October, 2012, the judgment debtor
had of, in and to said premises. The public auction was held in the auditorium of
the Suffolk County Office Building, 360 Yaphank Avenue, Yaphank, New York,11980 in
the said County of Suffolk, having first given public notice of the time and place
of such sale, by advertising, serving and posting the same according to law, at
which sale the said premises were struck off to: Tristate Capital Holdings LLC,
for the sum of one thousand dollars and 00/100 ($1,000.00) they being the highest
bidder and that being the highest sum bidden for the same.
Whereupon, the Sheriff of Suffolk County after receiving from the said purchaser
the said sum of money so bidden as aforesaid, gave to said Tristate Capital
Holdings LLC, the proofs of publication, service and posting of the notice of said
sale as directed by the law be given.
Now This Indenture Witnesseth, That the said party of the first part, by virtue of
the said execution, and in pursuance of the act in such case made and provided, and
in consideration of the sum of money so bidden as aforesaid, to him duly paid, hath
sold and by those presents doth, grant and convey unto the said party of the second
part, all the estate, right, title and interest which the said defendant Ronald
Diachun had on the eighteenth day of October, 2012 or any time afterward, of, in
and to all that certain plot, piece or parcel,of land with the buildings and
improvements thereon erected,situate lying and being in the Hamlet of Laurel, Town
of Southold, County of Suffolk and State of New York, and further described as
follows: Beginning at a point located at the Northwest corner of premises currently
owned by Eleanor Diachun and Rose Diachun by deed dated March 31, 1998 and filed
under Liber 11888 at page 175 from said point of beginning. Running Thence northerly
along the line of mean high water of Brushee Creek as same lines and turns a general
course north 33 degrees, 55 minutes 30 seconds west 477.95 feet to a point; Thence
south 73 degrees 17 minutes 40 seconds west 130 feet; Thence north 22 degrees 38
minutes 40 seconds west 140.36 feet; Thence north 59 degrees 29 minutes 20 seconds
east 240.03 feet to a monument; Thence north 59 degrees 29 minutes 20 seconds east
100.00 feet; Thence south 47 degrees 56 minutes 20 seconds east 719.18 feet;
Thence south 69 degrees 59 minutes 40 seconds west 446.00 feet to the point or
place of beginning. Together with a right of way for ingress and egress from the
above described property to and from Peconic Bay Blvd. Said right of way is shown
on a certain survey map drawn by John C. Ehlers surveyed 12-07-99 amended
January 2196, 2000, amended January 241h, 2000.
To Have and to Hold the said above mentioned and conveyed premises unto the said
party of the second part, and assigns of the party of the second part, their heirs
or successors, as fully and absolutely as the said party of the first part, as
Sheriff as aforesaid, can or ought to sell and convey the same by virtue of the
said execution and the law relating thereto. The word "party" shall be construed
as if it read "parties" whenever the sense of this indenture so requires.
In Witness Thereof, the said JOHN P. MEYERRICKS, JR, Under Sheriff ofthe County of Suffolk, State ofNew York has
duly executed this deed, the day and year first above written.
