A regular meeting of the Board of Southold Town Trustees was
held a~ 7:30 p.m., Tuesday, July 3, I9~9, ~at the Town Hall, Main
Road, Southold, New York. Present were:
President Philip G. Horton
Trustee Scott Harris
Trustee Anna Hataier
Trustee JohnNickles
Trustee paul Stoutenburgh
Motion was made by Trustee Hataier, seconded by Trustee
Nickles and carried tO approve the minutes of the meeting of June
5, 1979.

with Richard MastroSimone as their spokesperson. He said'.his

the New York State DEC back-in t965 and the TOwn Clerk is requesting
a copy of same to see if this was included. The next meeting will
be the 7th of August and a determination will be made at that time.
Trustee Nickles made a motion, seconded by Trustee Hataier
and carried to table action on this application pending receipt of
the agreement with the New York State Department of Conservation.
On motion made by Trustee Stoutenburgh, seconded by Trustee
Hataier, it was
RESOLVED to approve the application of Joseph G. Callahan to
place offshore stake with pulley line to onshore stake at Corey
Creek Estates at end of Corey Creek Lane.
Vote of the Board: Ayes: Horton, Harris, Hataier, Nickles,
Stoutenburgh
A letter is to be written to the Corey Creek Association informing
them that they must file permits for the two docks and the stakes.
On motion made by Trustee Stoutenburgh, seconded by Trustee
Harris, it was
RESOLVED to approve the application of William E. deBruin~ Jr.
~o place mooring in Little Creek with access from Meadow Lane.
Mr. deBruin is to contact Philip Horton for placement of the
mooring.

On motion made by Trustee Hataier, seconded by Trustee Harris,
it was
RESOLVED to approve the application of Helen Brown to place
150 lb. mushroom anchor off private property o£ the applicant at
Goose Creek with the condition that the boat does not'swinginto
the channel and.it does not interfere with any othe~ moorings.

On motion made by Trustee Hataier, seconded by Trustee Harris,
it was
RESOLVED to approve the application of Harold ~. Hannafin to
place 150 lb. mushroom anchor with access from public property with
a dinghy at Mattituck Creek.

On motion made by Trustee Hataier, seconded by Trustee Nicktes,
it was
RESOLVED to approve the application of Nancy-Jo Cautrell to
dredge material and place behind retaining wall at private property
of the applicant at East Creek with the condition that the fill be
placed on the upland and not to be ~ithin ten feet of the two wings
and graded back from there and planted with suitable ground cover
to retain fill.

On. motion made by Trustee Harris, seconded by Trustee
Stoutenburgh, it was
RESOLVED to recommend to the Southold Town Board denial of
Wetland Application #39 for Thomas and Jacaueline Occhiogrosso to
fill property and erect dwelling on proplerty designated as Lot #28
of Corey Creek Estates because the lot is in wet~ands by definition.
Vote of the Board: Ayes: Horton, Harris, Hataier, Stoutenburgh
Nay: Nickles
Trustee Niekles voted in the negative because he feels the
recommendation.should not be for denial on the strength of the
fact that the Department of Envirommenta! Conservation has approved
it and he is able to get Health Department permits for water and
cesspools.
A letter i~s to_be written 2o.Al!De Hansen requesting him
~o remove his boat from Town Creek ~s there has'bean some
~ifficulty in that it has drifted into other boats. The Town
!tHighway is to be requested to remove the steel stakes on the soUth
side of the culvert at Town Creek at concrete wall built last,year.
!This is at 2heYoungs Avenue Extension.

RESOLVED to approve the application of Anthony Zotto to place
'50 lb. mushroom anchor and chain at Little Creek~with the
condition~that Philip Horton be called for exactlocation.

On motion made by Trustee Hataier, seconded by Trustee Harris,
it was
RESOLVED bo approve the application of Richard M. Osmer
to place offshore stake with pulley line to onshore stake off
right-of-way at Goose Creek.

On. motion made by Trustee Stoutenburgh, seconded by Trustee

RESOLVED to approve the amended application of Harold I.
Thomas which will include buffer posts to keep boat off shore.
Th-~will be no dredging, no structure in the waterway and no
encroachment on upland areas. This will be to the south on the
property.

On motion made by Trustee Hataier, seconded by Trustee.Harris,
it was
RESOLVED to approve the application of George Johnnidis to
place 125 lb. mushroom anchor off public property at Mattituck
Creek with the condition that it be placed not to interfere with
other boats moored and it will not swing out into the channel.

The following letter was received from theNassauPoint
Property Owners Association directed to the Board of Trustees.
Gentlemen:
Over the years we have observed the Petrucci boat marina on Skunk
Lane in Cutchegue expand to a sizeable operation. We have been
told that this business was started before residential zoning was
adopted for this area. While this property is not on Nassau Point,
our members have aa interest in its use as it is on the only access
road to our area, A~Parentl~; t~i~ business has not bee~so!d.and
we are interested in making sure that this non-conforming use ms
not expanded in the £uture.
We would appreciate receiving from the Zoning Board of Appeals and
the Board of ~Trustee'Scopies ofthe most recent permits which define
how this land may be used~commeroially and what defined areas may
be dredged and ~ul~headed and used for the mooring of boats. We
are also interested in what business can be carried on (i.e. sale of
gasoline, rest rooms, food and beverage sales, storing of boats off-
season etc.). Our Board of Directors may then observe the continued
compliance with the permits and report any exceptions to the proper
Town of Southold officers.
We feel that the Town of Southold has provided a valuable tool in
its use of property and waterfront uses. We hooe that we can help
in this area of protec,tion for the Town and the Residents of Nassau
Point.

The Board of Town Trustees directed that a letter be written to
the Nassau Point P~operty Owners Association informing them that
this Board does not have jurisdiction over this man-made waterway.
A copy of the Southold Town Board of Appeals letter of June l, 1978
to Mr. Angelo G. Petrucci will be forwarded to the Association for
its information.
The following letter was received from the Southold Town
Baymen's Association~
The Baymen's Association has been active for years reviewing
applications made to the Army Corps of Engineers relating to water-
front projects, bulkheads, etc. A large number of these applications
were for additions to existing projects. The original pro~ects were
installed either before permits were required or at a later date and
applications to the ~my Corps and the Tovrn were ignored by the
landowners. It would appear, we feel, that a law should be enacted
where landowners who proceed v~ith work of this nature should be
penalized in some form.
Perhaps another approach that might help to stem these unlawful
procedures could be as follows:

Notify all dock builders that it will be necessary for them to be
~resentedwith a permit issued by the Army Corps and the Town of
Sauthold before they are allowed to proceed with anywork they have
~contraoted for with a landowner. Further, it was suggested that
~dock building permits issued by the Town Trustees be posted during
the construction period in a conspicuous location, much the same
-~as the procedureof theBuilding Department.
~s a footnote, our observations have be'eh that the Army Corps
'~tands on a premises "We do not intend to prosecute at this time".
It is not the-Association's function nordo we wish to create~-
· problems for past "bad boys" but we do feel the Town'shOuld not be
~required toindulge in the "error of their ways" for the future.

that their comments have been noted and the Board is aware of the
problem.

The secretary informed the Board that it was becoming difficult
if not impossible to process these mooring renewals because of
the time factor involved. She requested that the Board consider

this at the time the budget i~ prepared.
On motion made by Trustee Nickles, seconded-by Trustee Harris,
it was
RESOLVED to approve the amended plau of Henry P. Smith with
the dock being chauged to 92 feet in length and the placement of
four ~emPorary pilings which will' be removed at the time the float
is completed.
Vote of the Board: Ayes: Horton, Harris, Hataier, Nickles,

There being no further business to come before the Board,
Trustee Hataier.made a motion, seconded by Trustee Harris and
carried to adjourn the meeting. Meeting adjourned at 9:36 p.m.
