A copy of this permit and any supplementary conditions or approvals shall be available at the project site whenever authorized workis in progress. 21 The enclosed permit sign or a copy of letter of approval shall be i · protected from the weather and ~ostedin a conspicuous location at the work site until completion of authorized work. 22. At least 48 hours prior to commencement of the project, the permittee shall complete~and return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all provisions and conditions of this permit. Jorling Commissioner Re: Beixedon Estates Property Permit # 1-4738-0081~/00001-0 Dear Mr. Haje: The following special conditions were inadvertently left off the above permit. These are routine conditions attached to most dredging permits issued in Region I. Therefore, pursuant to Uniform Procedures, Part 62~.14(a) (t) this Department intends to modify your permit. The permit will be modified to include these conditions. 1) 3) 4) 5-) 6) Any debris or excess material from construction of this project shall be completely, removed from the adjacent area (upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands. The storage of cons=ruction equipment and ma=erials shall be confined to within the project work site and/or upland areas greater than 25 linear feet distant from the tidal wetland boundary. ~Ail~dredging shall, be conducted so as to leave a uniform ~o==~m elevatlon free of mounds or holes. Dredging shall be undertaken no more than once in any calendar year unless specifically authorized by the Department. Dredging is specifica!tv prohibited from June 1 through September 30 each year %o protect spawning shellfish. For maintenance dredging projects permittee shall yearly submit a Notice of Commencement specifying disposal site (updated site plan) plan) and Notice-of Completion specifying amount of dredged material deposited on approved disposal site. Ail dredged material shall be disposed on an upland site and be suitably retained so as to not reenter any water body or tidal wetland area. 9.) 10) During the dredging operation, the permittee and his contractor shall make every effort to restrict spillage of sediment during excavation and haulage. Dredging shall be accomplished with a clam shell or other closed "bucket" equipment. Excavated sediment shall be placed directly into the disposal site or conveyance vehicle. No sidecasting (double dipping) or temporary storage of dredge material is authorized. Ail side slopes of the dredged'channel will have a maximum of 1:3 slope. 12) The use of a dragline for dredging adjacent to the vegetated tidal wetland is strictly prohibited. 13) There shall be no disturbahce to vegetated tidal wetlands as a result of the permitted activity. Within 15 calendar days of the mailing of this notice of intent, the permittee may submit a written statement to the Department giving reasons why the permit should not be modified, or requesting a hearing or both. Failure of submission of this statement shall result in the modification becoming effective on February 11, 1994. This letter shall serve as an amendment to the original permit and as such, shall be posted at the job site. All other terms and conditions remain as written in the original permit. In times past, this type of project would h~ve been undertaken by a public agency (i.e. SCDPW) as it benefits many residents. However, budgetirg and other restr~ffuts have made it necessary for the residents thyselves to do the project. ~he inlet was first dredged in the 1940's to make it a navigable waterway in conJunction~rlth the Be~'~n Estates subdivision. While it may have been dredged subsequently, we have thus far beenu~hleto locate specifics. The operation will be done by a hydraulic dredge and the spoil used as beach nourishment on the adjacent downdrift beach. The dredged material consists of sand and gravel as does the receiving beach. Frcm the presentations given by perso~--~ of the Vicksburg Waterways Center of the C0E at a recent seminar, the effects of spoil of similar con- stitution on the indigenous i'auna of the spoil site is mini~l and transitory. Q~erefore, we feel it is appropriate to place the. material frGn 20 +-' above MHN to RKN without the necessity of dfking. Further, the work will be done durin~ the winter or early spring if permits are issued promptly to loosen any impact.
