Landward of a substantial man-made structure greater than 100' in length which was constructed prior to 9/20/77. Landwardof the 10' above mean sea level elevation contour on a gradual, natural slope. Landward of the topographic crest of a bluff, cliff or dune which is greater than 10' in elevation above mean sea level.  ' Listed in Part 661.5 of 6NYCRR (Tidal Wetlands Land Use Regulations) as a use not requiring a permit or notification letter of approval. Therefore, no permit is required under the Tidal Wetlands Act (Article 25 of the Environmental Conservation Law). Please be advised, however, that no construction, sedimentation or disturbance of any kind may take place seaward of the 10' contour or topographic crest without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or uegetation in this area as a result of your project. Such precautions may include providing adequate work area between the i0' contour or topographic crest and the project (i.e. a 15' ~o 20' wide construction area) or erection of a temporary fence, barrier, or hay bale berm. Please note that any additional work, or modification to the project as described, may require authorization by thi~ Department. Please contact this office if such are contemplated. As you recall, I was calling to see if I could receive a refund for the $150.00 fee that I paid to the Town Board of Trustees (receipt No. 32200, copy enclosed), for a permit to build a 14'X14' deck in my back yard on the bluff, in Greenport. We paid the fee back in September of 1987 but never got to building the deck in 1988 and 89 because we were trying to resolve a very costly water problem that keeps flooding our downstairs every time it rains too much. We finally decided to build it this year and found out that the permit had expired. We applied for an extension which you gave to us Only to find out from the building department that the Trustees no longer had jurisdiction over building a deck on the bluff. They of course denied the permit, as they said they would, and suggested that we apply to the Zoning Board of Appeals. We did, only to find out that we had to pay another $150.00 fee. When I asked Mr. Jerry Goehringer about this, he thought that we might be entitled to a refund of the first $150.00 from the Town Board of Trustees since they no longer could issue those permits. We have gotten ou~ aproval from the D.E.C. Anything that you could do to help us get a refund would be greatly appreciated. It seems quite expensive to pay over $350.00, so far, for licensing fees for a 14'X14' deck. Thank you for your help. If you need to contact me, I can be reached at my office every day, 516-753-1000.
