Any other activity within 100' of the wetland boundary requires a permit from this office. This is not a determination from any other agency. IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed, and these presents to be subscribed by a majority of the said Board as of this date. 0 r 4 A' I TERMS AND CONDITIONS The Permittee, Edward _V_olini, residing at 8625 Nassau Point Road, Cutchogue, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: I . That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will he no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Pennittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. EDWARD VOLINI requests a Wetland Permit to repair/replace the existing +/-100' long bulkhead using vinyl sheathing; construct an 8' return to southern side of bulkhead; repair/replace existing wood platform with stairs to beach; re-level existing 10'x12' beach house with 5'x7' deck and T wide stairs. SCTM# 118-4-13 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the actions are INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 4.1. "Minimize losses of human life and structures from flooding and erosion hazards." The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended., specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 2. Avoid reconstruction of structures, other than structures that are part of a water- dependent use, damaged by 50% or more of their value in coastal hazard areas. The structures were damaged during Tropical Storm Sandy due to the location of the structures in a vulnerable area. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for- a. structures which functionally require a location on the coast or in coastal waters. The structures (existing wood platform and existing 10'x12' beach house) do not functionally require a location on the coast and are not water dependent. 5. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to meet federal flood insurance program standards. All structures are located in the VE (velocity hazard) Flood Zone. Scope of work: • 100 linear feet of bulkhead facing Little Peconic Bay • Return wall on south side of property, approx. 8 to 10 linear feet, if neighbor on south side does not put in new bulkhead. • Wood deck (5' x 8') and stairs (3' wide) to Little Peconic Bay to be rebuilt. (Swept away by Sandy). • Wood deck at bottom of stairs, (at top of bulkhead) (10' x 10') and in front of Beach House (3' x 11') replaced. (Swept away by Sandy). • Planting of slope using indigenous plants. Description: • Existing bulkhead was damaged by Hurricane Sandy and is compromised throughout the 100 linear feet facing water. • Machinery will be used to temporarily move the wood landing and wood stairs down to bulkhead. The stairs and landing that lead down to the bulkhead are in good shape and will be reused once work is completed. They will grade the dirt so that the machinery can get down to bulkhead. Thus, the temporary retaining walls that I put in to help stop the erosion, will be taken away once work is commenced. • The existing wood frame beach house will have to be partially disassembled so that it can be moved in order to work on the bulkhead. • Once bulkhead is completed, the wood frame beach house will be moved back to where it was originally positioned. Repairs will be required and currently, per contractor, the only repairs recommended is 1) leveling the structure 2) replacing some shingles that were damaged by the storm, 3) replacing the supports for the roof overhang, 4) Repair floor inside shed. NOTE: Sole purpose of this structure is only to store life jackets, kayaks, dingy, oars, floats, etc. • Fill will be required and contractor is estimating 100 cubic yards. I asked Anne Trimble from Trimble's nursery to verify and she agreed with estimate. • Plantings on Bluff-Trimble's Nursery will perform work. Plantings will be primarily Blue Lyme Grass with some Rosa Ragusa's and Perennial Sweet Pea thrown in for accent.
