and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying
the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose. The word
"party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

All that certain plot, piece or parcel of land, situate, lying and being at East
Marion, Town of Southold, County of Suffolk and State of New York, known and
designated as Lot No. 117 on a certain map entitled, "Map of Pebble Beach
Farms, East Marion, Town of Southold, Suffolk County, New York," and filed in the
Office of the Clerk of Suffolk on June 11, 1975 as Map No. 6266, and more
particularly bounded and described as follows:
BEGINNING at a point on the northwesterly side of the road known as The Strand,
and which said point being the division line between Lot numbers 116 and 117 on
said filed map,and;
DUNNING THENCE along said division line on a course of North 37 degrees 21
minutes 31 seconds West, a distance of 358.52 feet to a point;
THENCE North 26 degrees 39 minutes 49 seconds East, a distance of 9.58 feet to a
point;
THENCE North 52 degrees 20 minutes 37 seconds East, a distance of 31.67 feet to
a point;
THENCE North 47 degrees 52 minutes 35 seconds East, a distance of 32.98 feet to

and;
RUNNING THENCE along said division line on a course of South 37 degrees 45
