It may have seen similar to the Building Department but the Landmark situation is different. Reinckens purchased two lots. One of those lots had a house on it with a pre-existing certificate of occupancy. The decision indicates the Reinckens failed to maintain the lots in single and separate ownership as their predecessors had. In Selwyn, there were two (2) vacant adjoining lots. When a building permit application was made for one lot, there was a determination that the two (2) lots were merged and had to be subdivided. A building permit had not been issued for either lot. Landmark purchased a single lot (tax lot 4). The lot adjoining it and which is claimed to be merged was sold as a separate lot and was treated as a separate lot when it received a building permit, had a house constructed and received a certificate of occupancy, all of which occurred 16 years ago. The owner of this adjoining lot has a mortgage. The Town cannot now require that owner (tax lot 3) to participate in a subdivision exercise to unmerge his lot. Effectively that owner would be penalized for what was a Town mistake not a property owners mistake in merging lots. These matters are significantly different and distinguishable and should be treated separately. The Building Department needs to reconsider its position. This is not an application to subdivide. I don't represent that owner and do not have any authority to place a notice at her/his property. More importantly I suggest a different concept must be adopted. This is not two (2) vacant parcels which have merged. The adjoining parcel had a building permit, a house constructed, a Certificate of Occupancy issued and has continuously paid a separate tax bill. In effect, a separate lot exists and can be transferred as a separate lot. This is understandably a unique situation but I believe it should be separately addressed and not considered as a subdivision. There is no vacant lot adjoining the subject parcel. The lot recognition section of the Town Code 280-9(B) states that a lot which is not recognized cannot have a building permit or other development entitlements. Whether implicitly or explicitly, the adjoining lot has been recognized. This application is for a variance for an undersized lot and I request that it be treated in that fashion.
