(631) 765-1809 • Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF NOVEMBER 17, 2011 ZBA FILE: #6514 NAME OF APPLICANT: Martin Kosmynka for KOS, LLC SCTM#1000-96-1-1.4 PROPERTY LOCATION: 50 Commerce Drive (Middle Road aka NYS Route 48), Cutchogue, NY SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 11, 2011 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject parcel is located in the LI zone, it is improved with self storage buildings. The area of the site is 133,594 sq, ft., it has 148.06 ft. of frontage on Commerce Dr., 390.42' on the westerly property line, 327.24' on Middle Rd., 354.76 along the easterly property line and 277.90' along the northerly property line as shown on the site plan prepared by DiGiovanni & Associates Architects dated 7.19.11. BASIS OF APPLICATION: Request for Variance from Art. XV, Section 280-63, (bulk area and parking regulations) and the Building Inspector's September 7, 2011 Notice of Disapproval based on a building permit application to construct a carport at; 1) less than the minimum front yard setback of 100 feet, 2) more than the maximum lot coverage of 30%. RELIEF REQUESTED: The applicant is requesting to construct a commercial carport 40'X45', in the front yard area over a portion of the existing parking area to protect metal mobile storage units from inclement weather conditions that cause rusting. The code required front yard setback is 100 feet and applicant is requesting 15.67 feet and the code required lot coverage is 30% maximum and the request is for 32.7%. ADDITIONAL INFORMATION: This application was submitted to the Southold Town Planning board for comments. In a memo dated October 18, 2011, the Planning Board stated they have no objection to the variances requested. The Zoning Board received three letters from neighbors in support of this application. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 3, 2011 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property Page 2 of 3 -November 17, 2011 ZBA File#6514 - KOS, LLC CTM: 1000-96-1-1,4 and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The parcel is a Light Industrial Zoned parcel, improved with four large storage buildings, office and an apartment for the caretaker. Surrounding parcels are all commercial in nature and the proposed carport and location are in keeping with the area. The carport will be open on all sides. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject parcel contains two front yards and the location of the existing improvements make the proposed location of the carport the only area available. 3. Town Law §267-b(3)(b)(3). The variance granted herein is substantial for the front yard setback variance, it represents an 84% relaxation from the code. The lot coverage requested is not substantial only representing a 9% variance from the code. However, the proposed location fronts on a cul-de-sac that gets very little traffic and the proposed carport will be placed on an area that is already paved on the subject property. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this commercial industrial park will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant has agreed to place gutters on the carport leading into the existing drainage on site, so all roof runoff will be contained on site. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created, the applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a commercial carport, while preserving and protecting the character of the neighborhood and the health, safety and welfare of this I-I industrial district. . RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried, to GRANT, the variance as applied for, and shown on the site plan and elevations prepared by DiGiovanni & Associates Architects dated 7.19.1 1 and labeled A-l. Subject to the following condition: 1. Based upon the carport's proximity to the street, all roof runoff shall be contained in on-site storm drains. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The 40'x 45' carport would be used as a staging area for customers to have temporary access to containers. The carport is proposed to be built on an existing asphalt area; and WHEREAS, the applicant submitted an application for site plan review on September 21, 2011; and WHEREAS, at a Work Session on October 17, 2011, the Planning Board accepted the application for review; and WHEREAS, the Southold Town Planning Board, pursuant to State Environmental Quality Review (SEQR) 6 NYCRR, Part 617.5 (c) (7) has determined that the proposed action is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5 (c) (7) "construction or expansion of a primary or accessory/appurtenant, non- residential structure or facility involving less than 4,000 square feet of gross floor area and not involving a change in zoning or a use variance and consistent with local land use controls..." and not subject to review under SEQRA; and North Fork Self Storage Carport Page Two December 13, 2011 WHEREAS, on October 26, 2011, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, on October 27, 2011, the Southold Town Architectural Review Committee reviewed and determined that the proposed carport structure was acceptable; and WHEREAS, on November 1, 2011, the Southold Fire District determined there was adequate fire protection and emergency access for the site; and WHEREAS, this action is exempt from review by the Suffolk County Planning Commission because the "...site plan proposes less than 5,000 s.f. of new or renovated floor area..." and is identified as a matter of local determination; and WHEREAS, on November 14, 2011, a public hearing was held and closed by the Planning Board for the above-referenced site plan; and WHEREAS, on December 6, 2011, the Southold Town Engineer reviewed the above- referenced application and has determined the project to provide adequate drainage and the proposed drainage meets the minimum requirements of Chapter 236 for Storm Water Management; and WHEREAS, on December 7, 2011, the Town of Southold LWRP Coordinator reviewed the above-referenced project and has recommended the proposed project be found consistent with Southold Town LWRP policies; and WHEREAS, on December 12, 2011, the Southold Town Chief Building Inspector reviewed and certified the proposed site plan as a permitted use in the Light Industrial Zoning District; and WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code §280-131 B (5), has the discretion to vary or waive the parking requirements for site plan applications where doing so would not have a detrimental effect on the public health, safety or general welfare, and will not have the effect of nullifying the intent and provision of the Site Plan Requirements chapter of the Town Code. The Planning Board has found that this application is eligible for a waiver of parking requirements because there is no need to provide for additional parking - the application is for an accessory structure that will not be open to the public or generate more vehicular traffic than the site already attracts; and WHEREAS, at a Work Session held on December 12, 2011, the Planning Board found that all applicable requirements of the Site Plan Regulations Article XXIV, §280 - Site Plan Approval of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board hereby waives the parking requirements as noted above; and be it further North Fork Self Storage Carport Pape Three December 13, 2011 RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; and be it further RESOLVED, that the Southold Town Planning Board grants Approval to the site plan entitled "North Fork Self Storage", prepared by DiGiovanni & Associates, Architects on July 19, 2011 and authorizes the Chairman to endorse the site plan. Please note the following requirements in the Southold Town Code relating to site plans: 1. Any outdoor lighting shall be shielded so the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. 2. All storm water run-off from grading, driveways and gravel areas must be contained on site. 3. Approved Site Plans are valid for three years from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 4. Any changes from the Approved Site Plan shall require Planning Board approval. 5. Prior to the issuance of a Certificate of Occupancy, the Planning Board must inspect the site to ensure it is in conformity with the Approved Site Plan, and issue a final site inspection approval letter. Should the site be found not in conformance with the Approved Site Plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. A copy of the Approved Site Plan is enclosed for your records. One copy will also be sent to the Building Department and the Town Engineer/Highway Department.
