C er FINDINGS,DELIBERATIONS AND DETERMINATION ZBA FILE: 6689 MEETING OF OCTOBER 17,2013 NAME OF APPLICANT: Johnny Donadic PROPERTY LOCATION: 325 Willow Point Road, (adj. to a canal) Southold, NY SCTM#1000-56-05-26 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 11, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated September 22, 2013. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION The parcel is 18,217.38 square feet in an R-40 district. The parcel fronts Willow Point Road for 148.92 feet, the eastern boundary is 127.44 feet, the western boundary is 148.73 feet and the northern boundary, which is bulk-headed at a canal, for 110.04 feet. The parcel is improved with a one story frame- stone-vinyl residence, an in-ground swimming pool and floating docks with metal landing and ramps. All as shown on the survey of the parcel prepared by Elizabeth G. McQuilkin, L.S., dated January 31, 2011, last revised July 31, 2013 and August 21, 2013 to add Proposed additions and Lot Coverage. BASIS OF APPLICATION: Request for Variances from Article XXII Code Section 280-116(B) and Article XXIII Code Section 124B and the Building Inspector's August 14, 2013, amended August 23, 2013 Notice of Disapproval based on an application for building permit for additions and alterations to existing single family dwelling: 1)proposed construction at less than the code required bulkhead setback of 75 feet, 2)more than the maximum code permitted lot coverage of 20%. RELIEF REQUESTED: The applicant requests a variance to construct alterations and a second story addition to the existing dwelling at 39.6 feet from a bulkhead where the Code requires a minimum distance of 75 feet. Page 2 of 3—October 17,2013 ZBA#6689—Donadic SCTM#1000-56-5-26 ADDITIONAL INFORMATION: This parcel was granted a variance for lot coverage not to exceed 23.6% in Appeal # 4602 dated 10/8/1998. In this Appeal before us (#6689), the applicant proposes additions and alterations at 22.969% of lot coverage which is less than the 23.6% granted in Appeal #4602, therefore the Board finds the request for a variance for lot coverage of 22.969% is not necessary. At the hearing, the applicant's agent submitted an aerial showing the two story dwellings in the neighborhood. Additionally, four letters of support were submitted from neighbors. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 3, 2013, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed two story addition is in character of this neighborhood because this neighborhood consists of a majority of two story residences. The proposed additions will not be a detriment to nearby properties because they will be within the code conforming side yard setbacks. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The majority of the existing residence exists within a non- conforming bulkhead setback and any proposed second story addition to this residence will require a bulkhead setback variance. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 47% relief from the code. However, the proposed second story addition is within the existing foot print of the residence and is characteristic of this neighborhood. 4. Town Law 067-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing alterations and a second story addition to the existing residence at a 39.6 foot Bulkhead setback, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Schneider, seconded by Member Dames, and duly carried, to GRANT, the variance for a 39.6 foot Bulkhead setback as applied for, and shown on the survey of the parcel prepared by Elizabeth G. McQuilkin, L.S., dated January 31, 2011, last revised July 31, 2013 and August 21, 2013 to add Proposed and Lot Coverage, and the architectural plans prepared by James Curtiss, R.A., sheets A.01 thru A.07 inclusive, dated 5.1.13. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Page 3 of 3—October 17,2013 ZBA#6689—Donadic SCTM#1000-56-5-26 Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. In Your letter, you indicated that a request was submitted one year ago and since that date the plan has been significantly reduced. We reviewed your letter and the Zoning Board of Appeals determinations No. 4602, dated September 30, 1998, and No. 6689, dated October 17,2013, as well as your prior de minimus request of February 1,2017. In the 1998 determination, the applicant was granted relief for exceeding 20%(23.6%) lot coverage for an"as-built"gazebo. The determination also referenced the swimming pool built in 1977 in accordance with permits issued by the Town Building Inspector. In the 2013 determination, the Board granted variance relief for less than the code required bulkhead setback of 75 feet and determined that lot coverage exceeding 20% (22.969%) was not necessary since earlier relief was granted for 23.6%. At that time,no demolition of - structures was proposed. Your client is now proposing 22.309% lot coverage, which includes demolition and replacement of an in-ground swimming pool. It has been and continues to be the Building Department's assessment that once a structure is demolished, the corresponding certificate of occupancy will be extinguished, a notice of disapproval shall issue once a building permit is applied for, and an area variance for lot coverage relief will be required in order to rebuild. This decision is consistent with other determinations we have issued to applicants having identical circumstances, and, therefore,we concur with the Building Department's decision. It is noted that by a recent town code change, the Zoning Board of Appeals no longer has jurisdiction regarding distances of bulkheads from structures; Page 2,DeMinimus Denial Donadic, SCTM No. 1000-56-2-26 nonetheless, this Board has the authority to grant variances for any improvements that require lot coverage relief. Therefore, our prior decision has not diminished and still stands. As a result, the proposed change is not de minimus in nature. Should you wish to pursue replacing the swimming pool, you will need additional variance relief with a new application and a public hearing. Please contact our office for any additional questions or concerns. Sine, e , Leslie.Kane Weisman Chairperson/Department Head CC: Michael Verity,Building Department i PATRICIA C. We submitted a request one year ago and since that date the plan has been significantly reduced. The existing cement in- ground swimming pool has storm damage and a building permit was requested to replace the in ground pool. The proposed work is as follows: 1. replace existing swimming pool (built in 1977 with CO) in kind and in place, and connect backwash to existing drywell (to code); 2. replace existing 51'6" wood double retaining wall landward of the existing bulkhead(B) in place, raise by 8" for storm protection to "existing grade" and replace 2 wood walls with one concrete wall. 3. replace existing stone patio on grade with 1,346 sq.ft. of bluestone patio set in sand/stone dust also "on grade"; all as shown on Site Plan prepared by Donadic dated January 25, 2018 My client is replacing the structures with less than the lot coverage approved by your Board in appeal #4602 dated 9/24/98 and confirmed in appeal #6689 dated 10/17/13. (approved for 23.6% and proposed is 22.309%) For your convenience I am enclosing the variance and Trustees permit history of the property: The subject property was granted variances in 1998 and 2013. Variance #4602 dated 9/24/98: The lot coverage of existing structures (house with decks, attached garage, sunroom, wood decks around the pool, in-ground swimming pool and existing gazebo) exceeded 20% lot coverage. The Board granted lot coverage of 23.6% (or 4,289 square feet); Zoning Board of Appeals Re: Donadic February 16, 2018 Page 2 Thereafter the Trustees approved (6118108 permit#6917) replacing the wood decking around pool with pavers, wood deck, wood walkway, drywells and wood retaining wall with bluestone pavers and 8" concreteretaining gcretel to rets Hing wallsool deck evel rem(bestone ain today. pavers to be pervious). These pavers and Variance #6689 dated 10/17/13 was for a variance for setback to the bulkhead for additions and alterations to the house and proposed lot, coverage. The Board found that "the request for a variance for lot coverage of 22.969%, as requested, is not necessaW', The concrete retaining wall and pavers were replaced in 2008 (see Trustees permit). The variance for setbacks from the bulkhead is no longer applicable and this project will not exceed the previously approved lot coverage of appeal #4602. The existing wood retaining wall is maintaining the existing grade between the rear yard and the adjacent bulkhead. The grade of the property is even along the house and pool. The proposed project is replacing the storm damaged improvements previously permitted. We would respectfully request a de minimis determination in order to expedite the building department and Trustee review. Thank you for your consideration. Very_tr , (a ricia C. McQuilkin, L.S,dated January 31, 2011 last revised August 21, 2013 and the architectural plans prepared by James Curtiss, R.A.,Sheets A.01 through A.07 inclusive dated May 1, 2013. In plain English, the variance authorized the renovation of the dwelling including the construction of second-floor additions over the eastern and western portions of the building'and the raising of roof section in the central.-portion otthe story frame residence which residence;exists at 39.6 feet from an existing bulkhead. Since the granting of the variance, the _ applicant has scaled down the proposed construction to eliminate the easterly and westerly second-floor additions choosing instead to partially demolished and renovate the dwelling. Attached herewith please find the January 31, 2011 survey, the May 1, 2013 architectural plans for your easy reference which fully describes the October 2013 approved project along with two sets of architectural plans also prepared by James Curtiss,Architect issued for ZBA review dated May 20, 2015.The May 2e 2015 plans provide a calculation such that 30.2-%of the area of the dwelling is to remain. Less than 75%of the dwelling would be removed thereby not constituting a demolition as that term is currently defined in the Town's Zoning Law. Moreover, the setbacks as authorized in the October 17, 2013 variance decision would be maintained. There would be no change to the survey effecting bulkhead setbacks or lot coverage. By way of this correspondence,) request a-"diminimus amendment"to the approved variance decision authorizing the redevelopment of the existing dwelling consistent with the May 20, 2015 architectural plans prepared by James Curtis, R.A. REASONS: (1) An undesirable change will not be produced in the C'l1ARACTER of the neighborhood or a detriment to nearby properties if granted, because: The neighborhood around the subject property contains a large majority of 2 story houses, including most of the directly adjacent neighbors. Thus, we believe that no undesirable changes will be affected on neighborhood. (2) 'Che benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The 2nd story additions will be within the current footprint of the house. Unfortunately, the house sits within 75'of the bulkhead on the property, causing the 2nd story additions to be 43 feet and 57 feet from the bulkhead, and the reconstructed roof of the sunroom to be 39.6 feet from the bulkhead. Furthermore,as the property is currently above the 20%coverage limit, any increase in coverage, even the modest one that the applicant is proposing, will trigger a variance. (3) The amount of relief requested is not substantial because: The vast majority of the proposed construction will take place within the footprint of the existing home. Because this construction is within 75 feel of the bulkhead,a variance is required. Additionally, the applicant is proposing a modest 105 square foot increase in coverage in the form of a latticework structure on the landward side of the existing dwelling. This constitutes a.581%increase in coverage, from 22.388%to 22.969%. (4) The variance will NO1' have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The house on the property has existed for many years without adverse effect on the physical or environmental conditions in the neighborhood. () Has the alleged difficulty been self-created' Yes,orNo. .Are there Covenants and Restrictions concerning this land: Fv—]No. Yes (please furnish copy). No. 4602—CLIFFORD AND RUTH CORNELL 1000-56.5-26 STREET& LOCALITY: Lot *24 at Willow Point, 325 Willow Point Road, Southold DATE OF PUBLIC HEARING: September 24, 1998 FMDffA5S0FFACT PROPERTY FACTS/DESCRIPTION; The above-referenced property Is located along 1NIllow Point Road with frontage along an underwater canal (Budd's Pond), Southold. The June 5, 1998 survey map prepared by Joseph A. Ingegno, L.S. shows that the property size Is 18,216.04 sq. ft., or .418 of an acre In size (to the filed map line). The property Is Improved with a one-story frame house with alladied garage, sunroom and wood deck areas. Accessory in-ground swimming pool and gazebo structures exist in the rear yard (north of the dwelling). The property has 110.04 ft. of bulkhead, and a wood retaining wall near the northerly edge of the in-ground pool/deck areas. BASIS OF APPEAL: Building Inspector's September 4, 1998 Notice of Disapproval with respect to the "as built" 2.8 ft. setback, and two other Notices of Disapproval dated July 28, 1998 with respect to lot Coverage and Section 100-33. (Note: Section 100-244B for nonconforming lots). AREA VARIANCE RELIEF REQUESTED BY APPLICANT: Applicant has applied for a building permit for the"as built"78 sq. ft. accessory gazebo structure which is located In the northeasterly yard area, at a set back of 2'9" from the side property line, Instead of the minimum 3 ft. required by Code. Also requested is a total lot Coverage of 4,289+- sq, ft calculated for all building area, which is Confirmed by the Building Inspector to be 646 sq. ft. over the allowable 20% (3,643 sq. ft. + 646 sq. ft. = 41289 sq. ft.). The total lot size is 18,216 sq. ft. Page 2 - September 30, 1998 Apps. No. 4602: 1000-56-S-26 (Cornell) Southold Town Board of Appeals REASONS FOR BOARD ACTION. DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable'change in character of neighborhood or a detriment to nearby properties because the gazebo is a small decorative structure with open sides located in the rear yard. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the swimming pool was built in 1977 and the decks were built in 1983, all in accordance with permits Issue by the Town Building Inspector. Requiring the removing of enough of the existing structures to bring the total lot coverage down to 20% is not feasible. In addition, requiring the applicant to move the gazebo three Inches to meet the side yard setback Is not necessary because the structure Is located In the rear yard where three Inches will not be noticed. (3) The requested area variance is not substantial. The gazebo will add 78 square feet, less than two (2%) percent, to the total lot coverage. (4) The situation is self-created. (5) In considering this application, the Board deems this action to be the minimum necessary and adequate, and at the same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community. RESOLU770NIACTION_ : On motion by Member Dinizio, seconded by Chaifrrlan Goehringer, It was RESOLVED, to GRANT the variance, as applied for, SUBJECT TO THE CONDITION that the lot coverage not exceed 23.6% (or 4,289 square feet) at any time now or in the future. VOTE OF THE BOARD: AYES: MEMBERS GOEHRI R, DINIZIO, TORTORA, COLLINS, AND HORNING. This Resolution was duly GERARD P.
