Riegel, III PROPERTY LOCATION: 3651 Crescent Avenue (corner Central Avenue, Munnatawket Avenue and Fox Avenue) Fisher's Island, NY. SCTM 1000-6-3-1 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 11, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION The Applicants' property is an irregularly shaped, conforming 91,040 sq. ft. parcel in the R-80 Zone. The northerly lot line is adjacent to Crescent Ave., and the corner of Central Ave. The easterly lot line is adjacent to Munnatawket Ave., the southerly lot line is adjacent to Fox Ave., and the westerly lot line is adjacent to Crescent Ave. Because of the proximity to public roads, the property is defined by four front yard areas. The parcel is shown, with proposed improvements and setbacks, on the survey drawn by CME Associates Engineering, Land Surveying & Architecture, PLLC, dated July 10, 2013. BASIS OF APPLICATION: Request for Variance from Article XXIII Section 280-124 and the Building Inspector's July 29, 2013 Notice of Disapproval based on an application for building permit for additions and alterations to existing single family dwelling: 1) less than the code required minimum front yard setback of 60 feet. RELIEF REQUESTED: The applicant requests a variance to construct alterations and additions in a front yard area with a setback of 2.7 feet, where a 60 feet setback is required by Code. Page 2 of 3 - October 17, 2013 ZBA#6684 - Riegel SCTM#1000-6-3-1 FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 3, 2013, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(U. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Applicants will maintain, and not further reduce, the existing, long established non-conforming front yard setback adjoining a dirt road (Munnatawket Avenue) that is generally only used as driveway access for several neighbors. The Applicants will also maintain the conforming front yard setbacks along Crescent and Central and Fox Avenues. The alterations and additions made by the Applicants will enhance the overall appearance of the premises within this residential neighborhood, without obstructing driveway access, or the travel views of any adjacent neighbors. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The Applicants' property is uniquely situated between three paved public roads, and one unpaved road (Munnatawket Ave.), all of which creates a parcel with four front yard areas. The existing single family dwelling has an existing non-conforming setback adjoining the unpaved road, and therefore the proposed alterations and additions require a variance. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing +95% relief from the code. However, the variance granted is for an existing nonconforming front yard setback adjoining an unpaved road that is primarily used only for several neighbors' driveway access. The Applicants will maintain three conforming front yard setbacks adjoining the other paved public roads. 4. Town Law 6267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The construction does not require the removal of any trees or natural vegetation. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 6267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 6267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and an addition to their single family dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Weisman (Chairperson), and duly carried, to GRANT, the variance as applied for, and shown on the survey drawn by CME Associates Engineering, Land Surveying & Architecture, PLLC, dated July 10, 2013. Subject to the following condition; Condition: 1. Applicant must obtain a CO for the "as built" shed and "as built" greenhouse within in year from the date of this decision. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Page 3 of 3 - October 17, 2013 ZRA#6684 - Riegel SCTM#1000-6-3-1 Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Riegel (SCTM No. 1000-006.00-03.00-001.000) This Memorandum is being submitted in support of the application of Richard E. Riegel, III and Amanda J. T. Riegel (Application No. 6684) for a variance relating to premises owned by them at 3651 Crescent Avenue, Fishers Island, New York (SCTM No. 1000-6-3-1). VARIANCE REQUESTED The applicants are requesting a variance to the Southold Town Zoning Code (the "Zoning Code") to permit the construction of additions and alterations to a single-family residence at their approximately 2.09-acre parcel as shown on the Site Plan-Proposed Renovations prepared for Richard E. Riegel, III and Amanda JT Riegel by CME Associates Engineering, Land Surveying & Architecture, PLLC under date of July 10, 2013 (the "Site Plan"). Underthe proposed plan, the Riegels are requesting a variance to permit (a) the demolition and reconstruction in the same footprint of a garage with a new second floor 1 above for additional living space and (b) the addition of two new covered porches and one new open porch . This variance relates to the requirements under Section 280-124 of the Zoning Code pursuant to which a lot with an area of 80,000 to 199,999 square feet is required to have a minimum front yard setback of 60 feet. Since the use of the single-family dwelling with the requested additions and alterations is a permitted use in this R-80 Zone District and the relief sought relates to the dimensional and physical requirements of the Zoning Code, the requested variance is an area variance. Town Law §267.1. Therefore, the standards of Town Law §267-b(3)(b) apply. The factors to be considered by a zoning board of appeals in making a determination regarding an area variance under Town Law § 267-b(3)(b) are as follows:(1) the benefit to the applicant as weighed against the detriment to the health, safety and welfare of the neighborhood; (2) whether an undesirable change will be produced in the character of the neighborhood or to nearby properties; (3) whether the benefit sought can be achieved in another manner; (4) whether the variance is substantial; (5) whether the variance will have an adverse effect on physical or environmental characteristics; and (6) whether the alleged difficulty was self-created. An examination of the circumstances present in the instant matter in light of the foregoing factors follows. 1. Relative Benefit and Detriment. The Riegels intend to reconstruct their garage, add living space above it, and build new porches on their 2.09-acre parcel in a residential zone. The new garage will replace the existing one in the same footprint and maintain the same ground level setback from Munnatawket Avenue of 4.0 feet. The current 2.7-foot garage overhang setback from Munnatwket Avenue will not change either as the wall of the new second floor living space will be at that distance as well. The new porches 2 will follow the lines of the dwelling; their closest locations to the street line of Munnatawket Avenue will range from 9.2 feet to 16.5 feet. There will be no detriment to the health, safety or welfare of the neighborhood by the granting of the requested variance. The use for residential purposes is a permitted use. There will be no significant increase in noise or traffic. The total lot coverage after the additions and alterations will be only about 4.4% in a Zone District where 20% is permitted. The existing nonconforming front yard setbacks of 4.0 (ground level) and 2.7 feet (second story) will not be increased and the new porches have been designed so that most of the new construction will maintain at least a 10-foot setback, with only a small portion between 9 and 10 feet from Munnatwket Avenue. Under these circumstances, the benefit of the additions and alterations for the applicants clearly outweighs any conceivable detriment to the public. 2. Character of the Neighborhood. The new garage and porches as proposed will not result in an undesirable change in the neighborhood or to nearby properties. As can be clearly seen from the photographs submitted with the application, Munnatawket Avenue is essentially no more than a driveway that serves one and perhaps two other properties. Accordingly, the visual impact of the new construction will be very limited. There are no dwellings in the neighborhood other than the Opalenski dwelling on which the new construction would have any impact whatsoever and, with a number of trees between the Riegel and Opalenski dwellings, the impact on the latter property would be slight except possibly during the winter when neither owner is likely to be present. The impact is mitigated by other factors as well. The new living space over the garage will stay within the existing footprint. Although two of the new porches will be 3 • •e~g~ built between the existing house and Munnatawket Avenue, they will have a much greater front yard setback than the current closest points of 4.0 and 2.7 feet and the height of the new construction will be less than the height of the existing dwelling. The additions use what is an already disturbed area adjacent to an existing dwelling and do not impact the vast (and essentially unusable) portion of the property to the south and west which will be left as open space. Moreover, as noted above, the impact that will result will be in the front yard defined by the least traditional "street" which is, for all intents and purposes, a driveway that is not even paved over its entire length. Finally, the addition of porches will be consistent with other houses in the immediate neighborhood and with those on Fishers Island generally. 3. Alternatives. The configuration of the Riegel property is such that the conforming building envelope is severely constrained. As shown on the Site Plan, given the four streets on which it fronts and the cut-out of the Rosenthal property, even if the parcel were now vacant and construction were being proposed for the first time and even though it is the only conforming property in terms of lot area in the immediate neighborhood, building a conforming structure of a normal size and shape would be difficult since the parcel is long and narrow and the available building envelope is only about 55 feet wide. That situation would present a classic case of "practical difficulty". Under the actual circumstances, however, the property is already improved, thereby further restricting the alternatives. As the property is now developed, since there is an existing house already tucked into the northeast corner, much of the lot area is unsuitable for expansion. Although coverage is only at 3.4% and will increase to only 4.4% under the Riegels' proposal, the only conforming direction in which the house could be 4 expanded would be to the west and a good portion of the available area on that side is already occupied by a paved turnaround. Expansion to the west is not feasible not only because of the existing turnaround but also due to the interior configuration of the house which (if expansion to the west were mandated) would require that the porches be placed off a guest bedroom or bathroom and not off the more suitable rooms like the living room and dining room. Although the existing dwelling could arguably be demolished and the entire new construction located at a more conforming setback from the street line, that alternative is not a feasible one. Given the narrowness of the conforming building envelope, some relief from the Zoning Code would probably be necessary anyway. More importantly, the current improvement has substantial value so demolition and reconstruction would be economic folly. Based upon the foregoing, while there are other alternatives to the Riegels' proposal, none of them is completely satisfactory. The current plan strikes an appropriate balance between the desires of the owners and the requirements of the Zoning Code. 4. Substantial Nature of Variance. A variance from 60 feet to 2.7 feet would normally be considered substantial. In this case, however, the degree of the variance is mitigated to a great extent because there already exists at the site a dwelling with a front yard setback of essentially the same 2.7 feet. Moreover, the new construction will either be within the existing footprint or will follow the existing house line and will become less nonconforming as the line moves from the southeast to the northwest. While the proposed additions will result in an increase in lot coverage, the ultimate coverage (about 4.4%) will be substantially less than the 20% maximum. Given the foregoing conditions, the fact that the new construction will front 5 on what is more of a driveway than a "street", and the lack of practical alternatives, the substantiality of the variance is not as significant as the absolute numbers might otherwise suggest. 5. Impact on Physical and Environmental Conditions. The impact on physical and environmental conditions at the site will be slight. Only small portions of this 2.09-acre parcel will be subjected to additional development and those portions are already disturbed either by the existing garage or by a lawn. The garage will be rebuilt in its current footprint and no significant regrading will be necessary for any of the new construction. 6. Self-Created Hardship. Self-created hardship is not an issue in this case. Proper permits are being applied for prior to construction. The applicants are not seeking to legitimize any illegally built structures. CONCLUSION For the foregoing reasons and in the interests of justice, the variance requested in order to permit the Riegels to make the planned additions and alterations to their residence should be granted.
