(631) 765-1809 • Fax (631) 765-9064 (~~7°)`` Southold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION ZBA FILE: 6683 MEETING OF OCTOBER 17, 2013 NAME OF APPLICANT: Marjorie Snyder and Ann Nottes SCTM#1000-33-2-29 PROPERTY LOCATION: 1245 Inlet Pond Road (comer Green Hill Lane) Greenport, NY SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION Subject property is located in a R40 zone district and is a non-conforming lot containing 15,929 square feet. It is improved with a one story single family dwelling with attached garage. It has 115.00 feet along Inlet Pond Road, 142.02 feet on the western property line, 115.22 feet along the northern property line and 135.00 feet on Green Hill Lane as shown on the survey dated 02-10-99 prepared by John C. Ehlers, LLS. BASIS OF APPLICATION: Request for Variance from Article XXIII Section 280-124 and the Building Inspector's July 25, 2013 Notice of Disapproval based on an application for building permit for additions and alterations to existing single family dwelling: 1) less than the code required minimum front yard setback of 35 feet. RELIEF REQUESTED: The applicant requests a variance to construct additions and alterations to the existing dwelling at 20.58 feet from the front yard (Green Hill Lane) where the code requires 35 feet. ADDITIONAL INFORMATION. Several letters of support were received from the applicants' neighbors. FINDINGS OF FACT/ REASONS FOR BOARD ACTION- The Zoning Board of Appeals held a public hearing on this application on October 3, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1) Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed addition is one story and the roof height will be the same as the existing dwelling. The property is screened by thick plantings that block the view of the dwelling from the road. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. A second story addition would not be in keeping with the character of the existing one story house or its existing interior layout, and an addition on the other side of the dwelling would require an undesirable access through the existing attached garage. Therefore, the location of the proposed addition in the second front yard is the only logical and functional possible placement. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 41% relief from the code. However, the property has two front yards and the layout of the interior of the dwelling further complicates the ability to conform to the code. The property is heavily landscaped on the road sides and the addition will not be visible from the road. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and to enable the applicant to enjoy the benefit of an addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Weisman (Chairperson), seconded by Member Dames, and duly carried, to GRANT, the variance as applied, based upon the site plan prepared by Frank Uellendahl, Architect dated 06-20-13 and building plans dated 06-20-13 labeled A1.2a,A1.2, A2.0, A3.0 thru A3.3 and A4.0. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. An undesirable change will not be produced in the CHARACTER of the neighbor or a detriment to nearby properties if granted, because: The variance will be in keeping with the existing character of the house; the roof height and roof angle are the same as existing, and the exterior finishes will be as close as possible to the existing house. Furthermore, the variance does not share an adjacency with other properties. All views into the property are heavily screened, if not completely blocked, by a thick planting bed consisting of old growth deciduous trees and conifers. This landscape buffer will remain unchanged. The one-storey, two-bedroom house shall remain a one-storey, two bedroom house. (See views 8, 9) 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance. because: The house is planned in such away that prohibits additions on any other side of the house. The same benefit could be achieved by adding a second storey, but this would significantly change the character of the original house, as well as intrude on the neighboring properties. The variance allows for the benefit being sought to be built without having to add a second storey. 3. The amount of relief requested is not substantial because: The property consists of two front yard setbacks of 35': the front yard and side yard both have a setback of 35'. The addition is encroaching on the 35' setback, but still remains 70' from the side property line. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: All views into the property are heavily screened, if not completely blocked, by a thick planting bed consisting of old growth deciduous trees and conifers. The house and the proposed addition are very difficult to see from the road and all neighboring properties. Additionally, the proposed variance is only one storey high. It copies the existing character of the house, which remains consistent with what was built in 1970. The addition's roofline is the same angle, and its height is equal to the height of the existing house. All architectural treatments are in keeping with the existing house, and the general neighborhood: cedar shakes and white trim. 5. Has the alleged difficulty been self created? D< Yes, or } No Why: The difficulty is that expansion is hemmed in by either setbacks or existing architecture. The existing house is built right on the North and East setbacks, and adding anything to the West or South sides would block all natural light to the rest of the house.
