SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 11, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION The parcel is 11,672 square feet in an R-40 district it is improved with a 1- 1/2 story frame house and a cottage. The parcel is waterfront to Marion Lake. The parcel fronts Truman's Path for 50 feet at its eastern boundary, the northern boundary to an adjoining property is 236.97 feet, the southern boundary to an adjoining vacant parcel is 227.34 feet, and the western boundary to Marion Lake is 50 feet, as shown on the Site Plan prepared by Frank W. Uellendahl, R.A. dated 8/22/2013, referencing a survey by Young & Young dated 11/26/2012, and the survey of property prepared by Roderick Van Tuyl, P.C. dated 5/28/1974 for Robert Ketcham. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's May 17, 2013, amended June 24, 2013 Notice of Disapproval based on an application for building permit for additions and alterations to existing single family dwelling, at; 1) less than the code required minimum side yard of 10 feet, 2) less than the code required minimum combined side yards of 25 feet. RELIEF REQUESTED: The applicant requests variances to construct a proposed first floor screened-in porch with second floor terrace/deck above and first floor decking having a 5.3 foot side yard, where the code requires a minimum of 10 feet, and a 15.3 foot combined side yard where the code requires a minimum of 25, as shown on the Site Plan of Swanson Residence, sheet A-1, dated 08/22/2013, prepared by Frank W. Uellendahl, R.A. ADDITIONAL INFORMATION: In addition to the subject principal dwelling, there exists a cottage on this parcel that is in violation of CO # Z5983 dated July 1, 1974 which requires the cottage to be made into an accessory building with no kitchen or cooking facilities. Said cottage has a kitchen and cooking facilities in place as of Page 2 of 3 - October 17, 2013 ZBAN6681 - Swanson SCTM# 1000-31-12-6 10/3/2013. A letter was received by the Board on October 15, 2013 from the applicant's architect re-confirming that this application includes a proposal to remove the existing kitchen and convert the existing full bath to half bath per code for an accessory structure. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 3, 2013, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed screened-in porch with terrace above and first floor decking are common features to a dwelling and will not change the character of the neighborhood. The southerly nearby property is presently undeveloped and will not be affected by the proposed construction. 2. Town Law &267-W)N(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. Any proposed addition in either side yard will require side yard variances and the proposed additions would not be feasible if located in the front yard or rear yard because they would not function well with the existing layout of the interior spaces and basement access. 3. Town Law 4267-b(3)(b)(3). The variances granted herein for a side yard and combined side yards are mathematically substantial, representing 47% and 39% relief from the code, respectively. However, the variance relief is mitigated by the narrow width of the subject property, which is substantially narrower than adjacent properties, and the location of the existing house. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing the proposed additions and alterations to the existing dwelling having a single side yard setback of 5.3 feet and a combined side yard setback of 15.3 feet, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF T14E BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Schneider, seconded by Member Dantes, and duly carried, to GRANT, the variances as applied for, and shown on the architectural drawings entitled "Swanson Residence", sheets A-1 dated 8/22/2013, A-2 dated 8/22/2013, A-3 dated 8/22/2013 and A-4 dated 6/28/2013, prepared by Frank W. Uellendahl, R.A. Subject to the following condition; CONDITIONS: 1. Continued construction to the principal dwelling shall only commence upon the satisfaction of the Building Inspector's determination that ALL conditions and requirements of C.O. #Z5983 have been met, specifically that the "cottage" has been converted to a conforming accessory structure. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require anew application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Like the applicants' home they were built in the 1960s and 1970s as summer cottages at a time when setback regulations allowed these cottages to be built much closer to the bluff line. Many owners have since converted their cottages into larger, more comfortable year round residences which is what the applicants are currently in the process of doing. A permit was issued on 02/0612013 to construct interior alterations and a dormer addition. In the next building phase the owners would like to apply for a setback variance to construct a screened porch and deck off the kitchen and LR on the south side of the building. There is no room facing Lake Marion to create a screened porch due to the closeness of the top of the bank. The proposed spaces will provide the owners with much desired easy access to the outdoors without changing the character of the neighborhood and allowing for more privacy for themselves as also for their neighbors. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: due to the location of home on the lot there is no other way to gain a usable porch and deck with a view of the lake. The 50 ft wide lot does not allow the proposed construction on the landward side of the existing dwelling where access to the basement and the septic system is located. The applicants are aware of the fragile situation along the waterfront and opted out to seek a variance on the lake side of the dwelling. When the Building Department issued a permit to construct a new 1 bedroom house closer to the bluff line in 1974 the building inspector noted that the existing dwelling was to become an accessory building with no kitchen or cooking facilities. The subject application indicates that the existing kitchen will be removed and the existing bathroom will be turned into a half bath, the future use of the cottage will be restricted to a work shop. The accessory building has its own septic system which is located between the cottage and the new dwelling. I had the existing septic system inspected last year, it's a ca. 7 ft wide and ca. 8 ft deep concrete block tank which is in very good condition, however the septic waste line needed to be replaced due to root damage which will prevent any waste and water seepage in the future. The six adjacent consecutive lots north of the Swanson's property are all 75 feet wide with much greater options to avoid having to apply for a side yard variance. The adjacent lot to the south is 100 feet wide. The Swanson's lot is the narrowest one with only 50 feet in width which leaves the applicants with no choice other than locating it in the south facing side yard.
