AGREEMENT
TH15 AGREEMENT, this 13~day of September 2013, by and between D. Claeys Bahrenburg
(hereinafter "Bahrenburg"), residing at 300 West Bay Avenue, Orient, New York 11957 and
Theodore A. Strauel and Nathalie T. Strauel, {hereinafter "Strauel"} both residing at fi80 Croton
Lake Road, Bedford Corners, NY 10549.
WHEREAS, Bahrenburg is the owner in fee of premises known as 300 West Bay Avenue,
Orient, NY 11957, designated on the Suffolk County Tax Map as District 1000 Section 024.00
Block 02.00 Lot 020.000, by deed dated May 31, 2012, and recorded October 10, 2012 in the
Suffolk County Clerk's Office in Liber 12707 Page 802, more fully described in Schedule A-1
attached hereto and made a part hereof (hereinafter "Lot 20"); and
WHEREAS, Strauel is the record owner of premises known as 220 Bay Lane, Orient, NY 11957,
designated on the Suffolk County Tax Map as District 1000 Section 024.00 Block 02.00 Lot
021.00, by deed dated September~~, 2013, and intended to be recorded simultaneously with this
agreement, mare fully described in Schedule A-2 attached hereto and made a part hereof
(hereinafter "Lot 21"); and
WHEREAS, at present there is a common driveway on the survey made by Kenneth M.
Woychuk Land Surveying, PLLC dated 08/01/13 (hereinafter "the Woychuk survey"}, a copy of
which is attached hereto; and
WHEREAS, the parties hereto wish to establish the rights and obligations with respect to the said
common driveway for themselves, their heirs, successors and assigns;
NOW THEREFORE, in consideration of the mutual promises contained herewith, the parties
agree as follows:
1. The parties hereto acknowledge that common boundary line between Lot 20 and Lot
2l on the Woychuk survey is North 54 degrees 44 seconds 30 seconds East, 230.84
feet to land now or formerly of Hossenlopp Trust;
2. That Bahrenburg as owner of Lot 20 makes no claim of ownership, use or need to
access that portion of the present common driveway southeast of the common
boundary line;
3. That Strauel as owner of Lot 21 makes no claim of ownership, use or need to access
that portion of the present common driveway northwest of the common boundary
line;
4. That the parties to this Agreement their heirs, successors and assigns shall have the
right to construct a fence, shrubbery or other such border along the common boundary
line which will separate the present common driveway; and
5. This Agreement shall run with the land and shall be binding on the heirs, assigns and
successor in interest of the parties hereto.
IN WITNESS WHEREOF, the parties have hereunto set their hands and seals to be hereunto
affixed and these presents to be signed on the day and year first above written.

BEGINNING at a point on the southeasterly corner of premises herein described, said point being the following
three courses and distances from the intersection formed by the easterly side of the King Right of Way with the
northerly side of Village Lane or Main Street:
