CONCH OUT, LLC, a Connecticut limited liability company having an office at 3 Stanton Place, Mystic,
Connecticut 06355,
party of the second part,
WI7NESSETH, that the party of the first part, without consideration paid by the party of the second part, does
hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL those certain plots, pieces or parcels of land, with the buildings and improvements thereon erected, situate,
lying and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, known and
designated as Lots 48 and 49 as shown on the "Plan of Peninsula at Fishers Island owned by Charles W. Hedge
and Frances G. Thorp, made by Chandler8 Palmer, Engineers, Norwich, Connecticut, 1913", and filed in the Office
of the Clerk of the County of Suffolk on March 11, 1913 as Map No. 223, said plots, pieces or parcels of land when
taken together being more particularly bounded and described on Schedule A hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from Charles
T. Farley and Marilyn D. LoCurto Farley, dated June 14, 1999 and recorded in Ehe Office of the Suffolk County
Clerk on July 1, 1999 in Liber 11973 page 122.
TOGETHER with~all right, title and interest, if any, of the party of the first part, in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also
all the estate which the said decedent had at the time of decedent's death in said premises, and also the estate
therein, which the party of the first part has or has power to convey or dispose of, whether individually, or by virtue
of said will or otherwise; TO HAVE AiVD TO HOLD the premises herein granted unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose. The
word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

erected, situate, lying and being at Fishers Island, Town of Southold, County of Suffolk and
State of New York, more particulalry bounded and described as follows:
Lots 48 and 49 as shown on "Plan of Peninsula at Fishers Island" and filed in the Office
of the Clerk of the County of Suffolk on March 11, 1913 as Map No. 223, said Lots when
taken together are bounded and described as follows:
BEGINNING at an iron pipe found on the northwesterly side of a twenty (20) foot right of
way where the same is intersected with the northeasterly line of land now or formerly of
Barry Rosenberg, et al.; and
RUNNING THENCE North 51 degrees 37 minutes 00 seconds West along said land now
or formerly of Barry Rosenberg, et al., 194 feet, more or less, to the approximate high
water line of West Harbor;
THENCE in a northerly direction along said approximate high water line of West Harbor,
65 feet, more or less, to the southwesterly line of a twelve (12) foot right of way as shown
on said filed map;
THENCE South 51 degrees 37 minutes 00 seconds East along said southwesterly line of
the twelve (12) foot right of way, 230 feet, mare or less, to an iron pipe at the intersection
