New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: I . That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes frill liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be [he estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board a[ a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. i'hat the work involved will be subject [o the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That [here shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. James F. Fitzgerald, Jr. Proper-T Permit Services PO Box 617 Cutchogue, NY 11935 RE: COVE CONDOMINIUMS OWNERS ASSOCIATION MAIN BAYVIEW ROAD, SOUTHOLD SCTM# 87-5-26 8~ 23.9 Dear Mr. Fitzgerald: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, October 19, 2011 and again on Wednesday, September 18, 2013 regarding the above matter: WHEREAS, Proper-T Permit Services on behalf of COVE CONDOMINIUMS OWNERS ASSOCIATION applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated September 28, 2011, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 19, 2011 and again on September 18, 2013, at which time all interested persons were given an opportunity to be heard, and, z WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of COVE CONDOMINIUMS OWNERS ASSOCIATION to maintenance dredge to 3' below mean low water approximately 82 cubic yards from channel at entrance to Association docking area and as needed, within the docking area itself; dredge as necessary in the same areas to maintain width, depth and full accessibility of entrance channel and docking area on a maximum of four additional occasions during the next ten (10) years; spoil will be removed to an approved upland location for deposition; and as depicted on the site plan submitted by Proper-T Permit Services, last dated June 15, 2011 and stamped approved on September 18, 2013. SCTM#87-5-20 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that with the LWRP provided that the Board considers the following best management practice: § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. For the record, and your information in case this comes up again, here is the chronology: • 10/19/11: Trustees, at their regular meeting, state that they have no objection to the project but require the approval of Suffolk County. • l 1/16/11: Made first contact with live person at County. It was Scott Hilary (formerly of Southold Planning Department!). • 11 /18/11: Sent Hilary copies of all documents from Trustee application. • 12/16/11: Sent Hilary a copy of Mark Terry's report on the project, at his request. • 4/30/12: Called Hilary, left message on machine. • 5/1/12: Called Hilary, he's gone for the day. • 6/8/12: Called Hilary, he said it's not DPW°s job, he'll call "Real Property" and get back to me. • 6/ 11 / 12: He was gone for the day. • 6/13/12: He called, they're "trying to establish jurisdiction". • 6/22/] 2: He called, "if s with the County Attorney's office". • 7/25!12: I called him, left message, no response. • 8/14/12: I called him. He continued to resist my efforts to "get around him, maybe go to Ed Romaine". He'll keep trying. • 8{28/12: Got two suggested contacts from Hilary. No luck with either one. • 8/30/12: Wrote, sent email to Ed Romaine, pleading for help. He replied inunediately, said he'd forward my email to the boss at DPW and follow up. • 9/19/12: Recd documents from DPW with notice that we needed proof of County as "additional insured". • 9/24/ 12 - 7/2/ 13: During this period, it was thought/assumed that the contractor would provide insurance coverage, that the contractor had already been "approved", insurance- wise, by the County, the contractor said he was not involved, the County said the insurance explanation had not been received and must have been lost in the mail, the POA ~S~`~ a subsidiary of THE PECONIC EASTERN CORPORATION representative called the County and was told the contractor's insurance was OK, the County later said it did not recall that phone call, and on, and on, and on. • 7/3/13: The POA's insurer provided an insurance certificate, and it was sent to the County for signature and processing. • 7/29/13: Received the signed permit from the County And so it goes... The project is certainly beneficial in supporting and maintaining an existing use of the coastal location, without any incremental increase in development in the area. NOT APPLICABLE The maintenance dredging does not involve changes to or the addition of any above-ground or above-water structures and upon its completion its effects will not be visible either from land or from the water. It is compatible with other existing shoreline structures and activities in the area, and will not adversely affect the dy- namic landscape elements (tidal fluctuations, seasonal vegetation changes; sea- sonaUdiurnal changes in ambient light) which might contribute to ephemeral visual qualities. The project is located in the Corey Creek Significant Coastal Fish and Wildlife Habitat, but the nature of the project, considering that it is the maintenance dredg- ing of an existing approved docking azea, is such that there will be no new impacts on any of the resources listed in the NYSDOS narrative as revised in 2002.
