The site is generally moderately sloped, sandy gravel earthen materials, vegetated with grass, shrubs, ground cover and trees; the bank is overgrown with vines (bittersweet and the like). The frontage of the property is approximately 250 feet along Hay Harbor at the southerly end abutted by the Bonsal family to the west and the Crisps to the east. The waterfront consists of a sandy beach at the base of the steeply sloped coastal bluff and otherwise a vegetated eroding coastal escarpment. The beach host a fringe marsh of spartina alterniflora A section of the bluff fronting on Hay Harbor has sloughed and several small areas have sloughed as well as a result of hurricane surges and wind induced waves in the past couple of years. The Baccile home is at the top of the bluff. Mr. Baccile must restore the badly eroded toe of the bluff fronting on Hay Harbor from the east point over to the Bonsal property. The work will consist of placement of stone filled "Gabion"baskets and soil fill behind. This work is being kept landward of the apparent high water line(spring high water level) and the tidal wetlands vegetation. This supplemental narrative has been prepared in accordance with the requirements of Town of Southold, Ordinance No. 6, 2004, related to docks and shorefront improvements. In addition, various coastal policies under the New York State Coastal Management Act are addressed herein for review by the New York State Department of State. DESCRIPTION OF WORK As mentioned in the introductory paragraph, this project is to restore the badly eroded toe of a vegetated coastal bluff in accordance with existing guidelines set forth in the Town of Southold ordinance No. 6, 2004. It is envisioned that this toe stabilization will be built from west to east utilizing the following general sequence and methodology. ➢ This project will be built from land using small machinery and manual workforce. ➢ Stone fill products will be delivered to the site in bulk and transported down the path toward the dock facility using small machines and subsequently out onto the beach between the toe of the bluff and the tidal wetlands vegetation. ➢ Gabion baskets will be assembled and filled with stone in place. At low tide, the beach above the apparent high water line will be excavated down to 1 foot above MLW and crushed stone on a geo-tech fabric will be placed in the trench as the gabion foundation. 1 ➢ Materials will be placed by hand, shovel, wheel barrow and small machinery in the designated areas. ➢ The fringe of spartina alterniflora north of the line of gabions will be marked off for preservation and be left untouched by the workers efforts. ➢ Access to the point will be from the path running north and west from the dock facility. ➢ The work is being prosecuted mostly with manual labor. The work and access area will be laid out to avoid existing vegetation on the shore and the roots of existing plants on the eroding bluff will also be preserved to the practical extent and avoided during the stone placement process. REQUIREMENTS OF SECTION 97-25 OF THE WETLANDS LAW 6,2004 The permittee acknowledges that the validity of this permit is subject to the approval of other governmental or municipal authorities. The permittee does, by the acceptance of this permit, assume all responsibility for operations undertaken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the permittee also agrees to indemnify and save harmless the Town of Southold and its officers. The permittee gives consent to the Town and its officers, employees and agents to enter upon the premises where such operations are being conducted to make such inspections to determine whether said operations are being conducted in conformity with the permit. The permittee will notify the Trustees in writing one week prior to initiation of any and all operations. The permittee will notify the Trustees in writing upon completion of operations such that the site can be inspected for issuance for a certificate of compliance. In response to Sub-section 2a and the General Rules for Standards of Residential and Commercial Docks,the following additional information is offered. 1. Permits for the work are being applied for through the Town, NYS DEC and a coastal zone consistency determination by the NYS DOS. This project is above (landward of)the USACOE spring high water jurisdiction line. 2. This project is to restore the badly eroded toe of a coastal bluff. No bulkhead structures will be built in this project. 3. Upon receipt of the permit for this project, appropriate permit numbers will be affixed to a sign on the beach for identification from the water. 4. There is room to walk under the existing pier on the east side of the point at low tide. Foot traffic in this area is rare, if at all. There is not pier construction or alteration in this project. NEW YORK STATE COASTAL MANAGEMENT PROGRAM These application documents include a copy of the Federal Consistency Assessment Form utilized for the New York State Coastal Management Program under the jurisdiction of the New York State Department of State. The following policies have been identified as pertinent to this application and the reason for consistency associated with this project is outlined in each respective case. Policy 2 Water Dependent Uses—This project is to restore the stability of a coastal bluff and preserve shoreline vegetation on the bluff as well as preserving fringe growth of tidal wetland vegetation on the beach. This work is required because of wave induced scour and undermining of the toe of the bluff during Hurricane Sandy. Policy 5 —Use of Existing Developed Shorefront—This project restores existing natural shorefront at the site. The project scope of work is not really relevant to "Developed Shorefront". Policy_ 7 — Significant Fish & Wildlife Habitat— Protection of significant fish and wildlife habitat has been considered in the development of this project scope of work. The stone filled gabions will be placed at the toe of the bluff over un-vegetated shoreline fringe of'exposed sand and gravel and will not jeopardize the integrity of existing two spartina fringe outcrops. Thus there should be an environmental benefit to the project because of the protection of the existing bluff vegetation including trees and shoreline vegetation without adverse affect on the spartina. Policy 8 — Protection & Preservation of Habitat—Protection and preservation of habitat has also been considered in this project and the stone fill is being kept to its minimal configuration consistent with standards and restrictions set forth in the Wetlands Law,No. 6, 2004 set forth by the Town of Southold and standards of the NYS DEC. This project will help to retain the existing balance of land, wetlands vegetation, trees,brush and other vegetation and habitat on the bluff. Policy 11 — Minimize Damage to Natural Resources - The gabion retaining wall has been laid out in such a way so as to minimize damage to natural resources as identified in Policy 7 above. Gabions are porous and sand which sloughs down the hill into the gabions will continue to replenish beach sand. Policy 14 —No Measurable Increase in Flooding - This project does not adversely affect water flow and circulation in Hay Harbor or flooding potential of the area. Flood levels all around Fishers Island are dictated by coastal water levels in Long Island Sound and Block Island Sound and this gabion retaining wall will have no adverse influence on those tidal and flooding conditions. Policy 15—No Dredging--Dredging is not proposed or required in this project. Policy 19 —Impact on Public Access—Public access will not be jeopardized or impeded as a result of this project. As a matter of fact, there is almost no public access usage of the public trust lands or waters at this site and the work being done exclusively on private property. The intertidal zone hosts only narrow fringes of tidal wetlands vegetation and the shallow sub-tidal waters do not present any opportunity or enticement for public access in the area. Poligy 20—Public Trust Compatibility with Existing Adjoining Properties and Land Uses-Public Trust compatibility with existing adjoining properties and land uses has also been considered in this project. 3 Nearby properties have small docking facilities similar to this one and gabions at this site landward of the apparent high waterline will not interfere with existing or proposed facilities on immediately adjoining properties. Neither adjacent sites have the same need for shoreline protection and stabilization as the Baccile's property. Policy 21 —Water Dependent Recreation—This project is consistent with water-dependent recreational opportunities policies set forth in this section. None of the adjacent or nearby recreational boating facilities will be affected by the proposed bluff stabilization work. Policy 24—Scenic Resources Impairment or Loss -This policy is designed to protect existing property and will not impair or cause loss of scenic resources. The work will barely be visible except from nearby, from the water in Hay Harbor. The reason gabions are being used is so that vegetation on the bank will grow into the gabions, taking on the same appearance as the bank and holding the gabions tight to the bluff. Policy 25 — Enhance Overall Scenic Quality - The shoreline restoration will be consistent with the scenic quality of the area and prevent loss of scenic resources as described in Policy 24 above. Polite 44—Preserve and Protect Tidal Wetlands — It is acknowledged that the fringe of tidal wetland vegetation along the Baccile shorefront below the bluff is a designated resource. The gabion placement location landward of the fringe growth utilizes the existing un-vegetated strip of the shoreline in order to avoid adverse wetlands impact. Placement of the stone fill using manual methods will also help to avoid adverse impacts. SUMMARY Recent significant storms and hurricanes have caused significant damage to the coastal bluff at this site and it must be stabilized so the bluff vegetation can remain and re-establish to a reasonable extent.This project is designed to be a living shoreline. This project represents a restoration of a significant coastal feature and provides protection against erosion while maintaining existing tidal wetlands vegetation on the Baccile property on Fishers Island. A copy of the NYS DEC and Town of Southold applications are attached as substantiation for this project. This project is landward of the USACOE spring high water jurisdiction limit. Photograph 1 This photograph shows the actual location of the slough,or landslide,immediately below the Baccile home fronting on Hay Harbor. The bluff is more than 30 feet high plus is almost entirely homogeneously sand,based on the geotechnical analysis conducted late in 2013. The stable slope is dependent on enhancing the retainage characteristics of the toe. For that reason,gabions will be assembled to form a 10 foot high retaining wall around the entire face of the bluff. Photograph 2 This photograph shows the easterly end of the Baccile property looking in a southerly direction from Hay Harbor, approximately 300 feet off shore. The focus of this view is to show that there are relatively small sloughed sections of the bank all along its face. These small collapses indicate the general instabilities of the very steep sand bluff and the need to create a toe retention structure in the form of the gabion wall for the full length of the bluff owned by the Baccile family. The bank above the gabion wall is stable with grass and moss. Other vegetative features include the clump of vines and saplings in the upper center of the photograph. There is no vegetation along the shoreline south of the pier until the neighbor's property is reached. The waves come ashore in a series of 20 or so with wave heights of a foot and wave heights of approximately 10 feet. They all break on the shore or at the base of the gabion wall landing depending on tidal elevations. Notable in this photograph is the change in sediment color and grain size along the right hand edge of the photograph. The vegetation just left of center in false indigo bush, based on the onsite study by Mr. Richard Snarski, prominent wildlife biologist and botanist and it was determined that this is the best vegetative measure to help stabilize the lower edges of the bank. Since it is slow growing, it will be planted alongside spartina pentinada. The spartina will grow up quickly but will not be long lasting and the false indigo will grow more slowly and take over in a matter of a couple of years. Details on the drawings show how the two will be planted between coir logs and protected by trees such as those shows in this photograph which will be anchored close to sho9re to break the waves and protect vegetation until its root mass is properly established. a - D D EC 1 1 K13 Board fT e FSK 'h �&� w �r Jx Photograph 4 This photograph shows the north section of the wall from about 50 feet off shore looking from the pier. In this picture the growth of false indigo bush and the natural accumulation of trees along the shorefront are shown to indicate the desired result of the shoreline restoration project. The remainder of the bank exposed by the removal of the gabions will be staked with excelsior mat, impregnated with various coastal blend salt tolerant grass seeds which will hopefully establish themselves along this un-vegetated exposed section waiting for the false indigo to grow and protect it more fully from exposure to the river. Ii Nwr • TERMS AND CONDITIONS The Permittee, Peter Baccile, residing at Equestrian Avenue, Fishers Island, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: I . That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The line of armor stone were placed approximately 5 years ago under a DEC permit issued by Mr. Chuck Hamilton. It is clearly visible that the soils from the eroding bank has washed through the stone and out onto the beach. It is felt that the placement of uniform gradation of stone from 1 inch to 12 inches in diameter would help to stabilize and protect this area from inundation induced erosion. The degree of erosion on the bank in this case is clear. Vegetation is almost obliterated on the sediments at the base of the bluff. The site is generally moderately sloped, sandy gravel earthen materials, vegetated with grass, shrubs, ground cover and trees; the bank is overgrown with vines (bittersweet and the like). The frontage of the property is approximately 500 feet along Hay Harbor at the southerly end abutted by the Bonsai family to the west and the Crisps to the east. The waterfront consists of a sandy beach at the base of the steeply sloped coastal bluff and otherwise stone and boulders alike. It is Mr. Baccile's desire to restore the badly eroded toe of the coastal bluff around the east point over to the Crisp property. The work will consist of placement of stone and soil behind an existing line of armor stone originally placed at the previous toe of the bank not even 5 years ago. This supplemental narrative has been prepared in accordance with the requirements of Town of Southold, Ordinance No. 6, 2004, related to docks and shorefront improvements. In addition, various coastal policies under the New York State Coastal Management Act are addressed herein for review by the New York State Department of State. DESCRIPTION OF WORK As mentioned in the introductory paragraph, this project is to restore the badly eroded toe of a vegetated coastal bluff in accordance with existing guidelines set forth in the Town of Southold ordinance No. 6, 2004. It is envisioned that this restoration will be built utilizing the following general sequence and methodology. ? This project will be built from land using small machinery and manual workforce. ? Stone fill products will be delivered to the site in bulk and transported down the path toward the dock facility using small machines. ? Materials will be placed by hand, shovel and wheel barrow in the designated areas. ? The small patches of spartina altemiflora north of the dock facility will be marked off for preservation and left clear of the workers efforts. ? Access to the point will be from the path running north and west from the dock facility. ? The work is being prosecuted with manual labor. The work and access area will be laid out to avoid existing vegetation on the shore and the roots of existing plants on the eroding bluff will also be preserved and avoided during the stone placement process. 1 0 • REQUIREMENTS OF SECTION 97-25 OF THE WETLANDS LAW 6, 2004 The permittee acknowledges that the validity of this permit is subject to the approval of other governmental or municipal authorities. The permittee does, by the acceptance of this permit, assume all responsibility for operations undertaken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the permittee also agrees to indemnify and save harmless the Town and its officers. The penmittee gives consent to the Town and its officers, employees and agents to enter upon the premises where such operations are being conducted to make such inspections to determine whether said operations are being conducted in conformity with the permit. The permittee will notify the Trustees in writing one week prior to initiation of any and all operations. The permittee will notify the Trustees in writing upon completion of operations such that the site can be inspected for issuance for a certificate of compliance. In response to Sub-section 2a and the General Rules for Standards of Residential and Commercial Docks, the following additional information is offered. 1. Permits for the work are being applied for through the Town, US ALOE, NYS DEC and a coastal zone consistency determination by the NYS DOS. 2. This project is to restore the badly eroded toe of a coastal bluff. No dock modification or bulkhead structures will be built in this project. 3. Upon receipt of the permit for this project, appropriate permit numbers will be affixed to the most seaward face of the pier for identification from the water. There will be no planned alterations to the existing pier. 4. There is room to walk under the pier at low tide. Foot traffic in this area is rare, if at all. NEW YORK STATE COASTAL MANAGEMENT PROGRAM These application documents include a copy of the Federal Consistency Assessment Form utilized for the New York State Coastal Management Program under the jurisdiction of the New York State Department of State. The following policies have been identified as pertinent to this application and the reason for consistency associated with this project is outlined in each respective case. Policy 2 -Water Dependent Uses - This project is to restore the stability of a coastal bluff and preserve shoreline vegetation. Policy 5 - Use of Existing Developed Shorefront - This project restores existing natural shorefront at the site. The work is not really relevant to "Developed Shorefront". 2 Policy 7 - Significant F& Wildlife Habitat - Protection of siJocant fish and wildlife habitat has been considered in the evelopment of this project layout. The stone fill will be placed to the shoreward side of the existing armor stone over un-vegetated shoreline fringe of exposed gravel and will not jeopardize the integrity of existing two spartina fringe outcrops. Thus there should be an environmental benefit to the project because of the protection of the roots of existing trees and shoreline vegetation. Policy 8 - Protection & Preservation of Habitat - Protection and preservation of habitat has also been considered in this project and the stone fill is being kept to its minimal configuration consistent with standards and restrictions set forth in the Wetlands Law, No. 6, 2004 set forth by the Town of Southold and standards of the NYS DEC. This project will help to retain the existing point of land, wetlands vegetation, trees, brush and other vegetation and habitat on the point. Policy 11 - Minimize Damage to Natural Resources - The fill to be placed has been laid out in such a way so as to minimize damage to natural resources as identified in Policy 7 above. Policy 14 - No Measurable Increase in Flooding - This project in no way adversely affects water flow and circulation in Hay Harbor or flooding potential of the area. Flood levels all around Fishers Island are dictated by water levels in Long Island Sound and Block Island Sound and this fill will have no adverse influence on those tidal and flooding conditions. Policy 15 - No Dredging= Dredging is not required in this project. Policy 19 - Impact on Public Access - Public access will not be jeopardized or impeded as a result of this project. As a matter of fact, there is almost no public access usage of the public trust lands or waters at this site and the work being done is almost exclusively on private property. The intertidal zone hosts only to a small extent small patches of tidal wetlands fringe vegetation and the shallow sub- tidal waters do not present any opportunity or enticement for public access in the area. Policy 20 - Public Trust Compatibility with Existing Adjoining Properties and Land Uses Public Trust compatibility with existing adjoining properties and land uses has also been considered in this project. Nearby properties have small docking facilities similar to this one and armor stone at this site will not interfere with existing or proposed facilities on immediately adjoining properties. Policy 21 - Water Dependent Recreation - This project is consistent with water-dependent recreational opportunities policies set forth in this section. Policy 24 -Scenic Resources. Impairment or Loss -This policy is designed to protect existing property and will not impair or cause loss of scenic resources. The work will barely be visible except from nearby, from the water. Policy 25 - Enhance Overall Scenic Quality - The shoreline restoration will be consistent with the scenic quality of the area and prevent loss of scenic resources as described in Policy 24 above. Policy 44 - Preserve and Protect Tidal Wetlands - It is acknowledged that the fragmented patchy vegetation of dune grass along the Baccile shorefront behind the existing armor stone is a designated resource, however, its value in terms of ecological significance is minimal area the actual area of growth. The fill placement location landward of the armor stone has taken advantage of the existing un-vegetated strip of the shoreline in order to avoid adverse wetlands impact. Placement of the stone fill using manual methods will also help to avoid adverse impacts. 3 SUMMARY This project represents a restoration of a significant coastal feature and provides protection against erosion while maintaining existing patches of tidal wetlands vegetation on the Baccile property on Fishers Island. A copy of all US Army Corps of Engineers, NYS DEC and Town of Southold applications are attached as substantiation for this project. The shoreline has eroded almost the full length of the armored bank alone the east edge of the Property which make visible scars and encouraees further damage environmentally as well as aesthically. The public trust lands and waters constitutes the area between the mean high water line and mean low water line and the resources are from the high tide line out. There is virtually no public use of the waterfront in this area and the restoration of the shoreline protection landward of and above the apparent hip_h water line are not likely to influence or change this fact. WORKING COAST POLICIES Policy 10. Protect Southold's water-dependent uses and promote siting of new water-dependent uses in suitable locations.
