New York, known and designated as Lot No. 87 and a triangular part
of Lot No. 88 situat in the most northeasterly corner of said lot and
having a frontage of 10 feet on Old Shipyard Lane , on a certain map
entitled, "Subdivision Map of Founders Estates, situate at Southold,
Suffolk. County, New York, survey completed March 18 , 1927 , Otto W.
Van Tuyl, C.E. , Greenport, NY" , and filed in the Office of the Clerk
of the County of Suffolk on May 10, 1927 as Map No. 834 , said lot Nc
87 and portion of Lot N0. 88 being in one parcel bounded and describes
as follows: BEGINNING at a point on the easterly side of Founders
Path distant 112 . 96 feet northerly from corner formed by the inter
section of the easterly side of Founders Path with the northwesterly
side of Old Shipyard Road. Said point also being where the division
line between lots No. 87 and 88 as shown on said map intersect the
easterly side of Founders Path; RUNNING THENCE along the easterly sic
of Founders Path north 31 degrees 38 minutes 40 seconds west, 75 . 38
feet to the division line between lits 86 and 87 as shown on said ma
THENCE along said division line north 64 degrees 05 minutes east,
193 . 93 feet to the westerly side of Old Shipyard Road; THENCE along
the westerly side of Old Shipyard Road, south 10 degrees 15 minutes
seconds west, 51. 31 feet; THENCE south 64 degrees 05 minutes west-
75 . 00 feet to the easterly side of Founders Path, the +point or place
of BEGINNING.
Said premises being known as 1635 Founders Path , ,_ Southold, NY
Grantors being the same as Grantees in Deed dated June 19 , 1995 ,
recorded June 27 , 1995 in Liber 11730 cp 883.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
