RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 641 of Laughing Waters Property Owners Association to reconstruct in kind/in place approximately 227' of deteriorated timber bulkhead. An area 3' seaward of said structure shall be dredge to a depth of 3' at MLW. The resultant spoil, approximately 50 c. y. of sand shall be utilized as backfill for the new bulkhead. RESOLVED to recommend to the Southold Town Trustees approval with stipulation of Wetland Application No. 642 of Paul Ferdenzi to construct a walkway 20' x4', hinged ramp 12' x 4' and folating dock 16' x 6'; install two 8" piles to secure floating dock. Approval is with the stipulation that the grass between the lawn .and water be disturbed as little as possible. Tabled Wetland Application No. 643 of Nicholas Theoharides. The CAC wishes to await the answers to questions posed by the NYS Department of State. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 644 of Thomas E. Boyle to repair existing concrete wall by reinforcing with rip-rap in fornt of and behind existing wal{ in an attempt to prevent collapse. Truck in fill from an upland source to place behind existing wall. Leeton Drive, Southold. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 645 of Thomas E. Boyle to construct a rock bulkhead, approximately 90'. Leeton Drive, Southold. RESOLVED to recommend to the Southold Town Trustees approval with stipulation of Wetland Application No. 646 of Robert E. Mitchell to construct a walkway 12' x 4'; and floating dock 16' x 6'; install two 2-pile dolphins to secure floating dock. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 648 of Harold Knight to constaruct a 16' angled bulkhead return on north side of porperty and backfill with 7± c.y. of clean loam to be trucked in from an upland source. Return is needed to prevent further loss of backfill from existing damaged bulkhead, Calves Neck Road, Southold. RESOLVED to recommend to the Southold Town Trustees approval with stipulations of Wetland Application No. 649 of Alfred Nadel to approve completed project. Construct 127± I. f, of timber bulkhead above mean high water to connect to existing adjacent bulkheads 11' from corner of westerly, 6' from corner of easterly and backfill with 50 c. y. of clean upland fit1. Construct timber pier, 4' x 18' catwalk, minimum of 3' above grade, 4' x 12' hinged ramp, 6' x 16' float anchored by two piles. Approval is with the stipulation that catwalk be elevated the standard 4' above grade of marsh and that runoff from roof and lawn be contained on property (suggest use of dry wells, etc.) Robinson Road, Southold. RESOLVED to recommend to the Southold Town Trustees approval with stipulations of Wetland Application No. 658 of Port of Egypt Enterprises, Inc. to erect a 25,440 square foot boat storage Building. The stipulations would be: 1. Use a pervious driveway surface. 2. Suitable dry well system for roof runoff. 3. Add pumpout station. Route 25, Southold. CONSULT 1NGWADING R iVER, N.Y, 4 channel? VICTOR BECK: The south channel. TRUSTEE FOSTER: This could go on forever, we should do something here. TRUSTEE SMITH: You mean as far as the dredge spoil? Paying for it? We . have to charge them for the dredge spoil unless they can prove otherwise. That is the only way I see out of it. They say they own it. We say we own it. Nobody knows who owns it, we have to charge them for the spoil taken out of there. If they can prove that it is there's, then we can disregard the fees. TRUSTEE FOSTER: How was that channel dug? I know John Wickham dug the other one. VICTOR BECK: I think that was dug at the same time. Because I found an old chart that shows the new channel, same goes for the south marina. I have a deed that says that Duck Island belongs to use also. It does show the connection to the new channel by the south marina. TRUSTEE FOSTER: Did anyone come in and see Jack Sherwood? VICTOR BECK: I did and he couldn't help. This is a chart that I found that shows that area and is called the new channel. That is 1930's or 40's. It is quite old. It has been there a long time. TRUSTEE SMITH: Everything that was done there, was probably dane prior to 1955. VICTOR BECK: Well, this was 1938 and it shows that new channel then. TRUSTEE KING: Is there any other comment? Do I'have a motion to close the public hearing on this one. TRUSTEE FOSTER: I make a motion to close the public hearing. TRUSTEE SMITH: Second. ALL AYES. The Board further discussed the spoil areas. They determined that approx. 2150 c.y. of spoil will be taken from the north marina and dewater on site and then be brought to an upland site. Approx. 1BOOc.y. will be taken from the south marina with approx. 1265c.y. from Town owned bottom. TRUSTEE FOSTER: I make a motion to approve the application for dredging of the north and south marinas and that they select another spoil site for the north marina and at the south marina they have to pay for 1265 c.y. If it is proved that they own it the money will be refunded at a later date. And hay bales shall be placed at spoil sites. After it is dewatered then they can remove them. TRUSTEE SMZTH: Second. Consulting on behalf of laughing Waters Property Owners Assoc. applied to the Southold Town Trustees for a permit under the provisions of the Wetland ordinance of the Town of Southold, application dated July 10, 1988, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on February 28,-1989 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED that J.M.O. Consulting ON BEHALF Laughing Waters Property Owners Association BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE T0: Reconstruct 227' of timber bulkhead and dredge area 3' seaward to a depth of 3' at MLW. Due to the fact that the New York State Department of Environmental Conservation (DEC) required an in place/in kind reconstruction, there was a considerable loss of fill from the upland. The "dredging" therefore was necessitated by the replacement technique and is part of the permit but incidental to the bulkhead and not dredging per se. You will note that the original backfill was removed prior to the structure removal. However, loss of fill due to tidal action was unavoidable. In the interest of simplifying procedures, consistent with good environmental practice, a waiver of putting the application through the process could be made. Please consider this rationale. The Board finds this enlargement is necessary to accommodate all the people who own lots in the Laughing Water section that thave deed ricPuba to keep a boat at this marina. The Board finds that the improvements will consists of a new bulkhead, some Lloating docks to replace stakes that were used by the residents to moor their private boats. All boats using this facility are awned by the residents of the area and are members of the Laughing water Property Owners Association. The Board finds that the ,public convenience and welfare and justiceswill kte served and the legally established or peaatitted use of. neighborhood property and adjoining use , districts will not_be substantially injured:and the spirit of the Ordinance will .be observed. Therefore,, it was RESOLVED that Laughing Water ~operty Owners Association, Soutiotd, New York, be GRANTED permission to improve a•private marina as applied for, on property located on the north east side Minehaha Bivd., Southold, New York. This permission ie subject to the following conditions: 1. This boat basin shall be limited in use to oaly the residents and property owners in the Laughing Water Property Owners Associatt~n . 2. There shall be no services for party boats. 3. No boats shall be rented or leased. 4. There shall be no sale of any cocanercial products. This condition is without predjudice to any future application to per- mit the sale of gasoline at the premises for the boats moored at this boat basin. 5.
