Trustees at their Regular Meeting on October 27, 1999:
RESOLVED, that the Southold Town Board of Trustees grant an
Amendment to Permit #4933 to reflect a reduced dredge area and a
more current sounding as required by the NYSDEC. The current
figures to be: 186 c.y. @$10 c.y. _ $1,860.
However, this determination is not a determination from any
other agency.

South Marina - Dredge marina to a maximum depth of 4 ft. below mean low water. A portion of the resultant 1800 cubic
yards of dredged meteriaL will be placed upland in the parking area and confined with haybates for dewatering purposaes.
Any excess spoil will be trucked to an appropriate upland site. Once deuatered, the dredged mecerial will be util: zed as
beach nouri shmeni for the community beach.

Dear Board,
The marinas boated in Laughbg Water are a major asset to the camnunity as well as the Town of
Southold. Boating access to Peconic Bay is a significant factor in the quality of life as well as
property values and their loss would have a significant negative impact. The dredging project is
simply to maintain this asset.
LWPOA is a non profit organization operating on a small margin, usually enough to cover
expenses plus a prudent reserve. The dredging project contemplated will require major funding
from a loan institution and payments for years to come. A number of our members are elderly,
living on fixed retirement incomes and we knew it would be a major undertaking putting us in debt,
however we feel that not to attempt this project is an unacceptable ahemative. Unfortunately the
additional fee of $12,650 you have imposed on the project has given us a shock and we may have
to reconsider the project.
It is noted that the fee imposed is done so because we could not prove the bottom land adjacent to
the South Marina is LWPOA property, therefore it was assumed to be Town property. In a
subsequent review of historical documents, to wit: a survey dated June 3Q 1938 by D.R. Young,
P.E. & L.S., Riverhead, NY, the area we are proposing to be dredged is called "NEW
CHANNEL" part of the same "NEW CHANNEL" that was cut out of LWPOA property adjacent
to our North Marina. in fact, the island that is clearly deeded to LWPOA adjacent to the South
Marina, was created by the spoils when the "NEW CHANNEL" was dug adjacent the Muskaday
Bridge Area. It appears that to deed the spoils from this channel but not the channel is an oversight
and the bottom should have been deeded to LWPOA.
In summary, to levy what appears to be an exorbitant, and somewhat arbitrary, fee on a project to
maintain a community asset, is punitive and contrary to the best interests of the Town of Southold
and LWPOA alike. It is therefore requested that the fee of $12,6501isted in your Application
Approval letter dated June 24, 1998 be rescinded.

The following action was taken by the Board of Town Trustees
during its regular meeting held on June 24, 1998 regarding the
above matter:
WHEREAS, En-Consultants on behalf of LAUGHING WATERS PROPERTY
OWNERS ASSOCIATION applied to the Southold Town Trustees for a
permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated May 28, 1998, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on June 24, 1998, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the~BOard members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grant a Wetland Permit to
maintenance dredge two irregularly shaped areas used for marina
to max. depth of -4' at MLW. Approx. 2150 c.y. of sand/silt
spoil will be dewatered on the land adjacent to the north marina
and then brought to an approved upland site. Approx. 1800 c.y.
of sand/silt spoil will be deposited on land south of the south
channel. 1265 c.y. of spoil will be from Town owned land and
will be a charge of $10 a c.y. unless ownership is proven to be
different. Haybales will be placed at south spoil area and north
area during dredging, and a ten year maintenance to run with DEC, and,
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Monday, May 7, 1973 at the Town Clerk's Office, Main Road, Southold,
New York. The meeting was called to order at 8:15 P.M. with the

of a bulkhead. This bulkhead is 6 ft. further back on the association
property at Corey Creek from where there dad been 15 boat stakes, and
the same number of boats will be moored at the bulkhead. The Board
thanked Mr. Brady for keeping the Board informed, but advised him
that since this bulkhead is entirely on the Association property, and
although the Board looks favorably on such a project, it is outside
their jurisdiction.
Mr. Carrig asked the Board's opinion on the extension of a bulkhead
on the property of William Albinson, North Bayview Road, Southold.
He had previously constructed a bulkhead entirely on Mr. Albinson's
property in 1971, and now wishes to extend it along the same line,
still entirely on his own property. The Board advised Mr. Carrig
that the proposed extension is outside the jurisdiction of the
Trustees and a permit is not required.
Mr. Carrig next discussed the application of Robert Brown, Beachwood
Lane, Southold, for permission to construct a dock,and:~float in front
of his property on Goose Creek.

ADDENDUM TO FCAF: LAUGHING WATERS PROPERTY OWNERS
ASSOCIATION
lh) Because the proposed maintenance dredging will be conducted in coastal waters, the
project must be consistem with Policies 15 and 35. With regard to Policy 15, the project
should not affect the supply of beach materials to, or cause the erosion of, adjacent
downdrift lands, because the two azeas to be dredged have been used historically as mazina
basins. Thus, the impact of the project will be only to maintain the navigational water
depths associated with that existing use. With regard to Policy 35, the effects of turbidity
from dredging the sand and silt will be localized in the mazina basin and, aided by the
presence ofthe adjacem intertidal marsh vegetation, ephemeral in nature. Therefore, there
will be no adverse effects on adjacent fish habitat. Finally, Article 15 and 25 permits will
be secured from the NYSDEC to ensure that the project will meet State dredging permit
requirements. Thus, the proposed project will be consistent with Policies 15 and 35.
2a) Because the project will occur within and adjacent to NYSDEC classified littoral zone
and intertidal wetland azeas, the project must be consistent with Policy 44. The proposed
project will be consistent with this policy because it will not affect benefits derived from
tidal wetlands, and will require a Tidal Wetlands Act permit from the NYSDEC.
2c) As the marina basins aze adjacent to the State designated significant fish and wildlife
habitat of Corey Creek, the project must be consistent with Policy 7. Although the
dredging activities will temporarily disturb the substrate by physically removing naturally
accreted sand and silt, the surrounding habitat will not be "significantly impaired" as
defined by Policy 7.
3a) Because the proposed activity will occur at a waterfront site, it must be consistent with
Policies 2, 21, and 22. The proposed dredging is consistent with Policy 21 and in fact
promotes the goals of the policy in that it will allow the continued use of the marina basins
for boating activities by maintaining navigational access to Corey Creek and Hog Neck
Bay. Policies 2 and 22 do not apply to the current project.

The proposed dredging will not adversely affect Town waters or
the adjacent tidal wetlands. The two areas to be dredged have
been used historically as marina basins and thus the impact of
the project will be only to maintain the navigational water
depths associated with that existing use. The effects of turbidity
from dredging the sand and silt will be localized in the marina
assn an ai e y t e presence o the adjacent intern a marsh
vegetation, ephemeral in nature. And, although the dredging will
temporarily disturb the creek bottom by physically removing naturally
accreted sand and silt, the surrounding habitat will not be adversely
affected.

Dear Boazd:
The Board approved our dredging project at its regulaz meeting on June 24, 1998.
However, during the meeting the Board concluded that in the absence of proof of
ownership by LWPOA, the underwater land in the channel adjacent to the South Mazina
was subject to a spoil removal fee of $10 a cubic yazd. During the meeting, an
extemporaneous calculation of the subject area indicated it to be 1,265 cubic yards and
therefore a fee of $12,650 was assessed.
On July 17, 1998 I requested an extension until we had all our permits and we knew for
sure we would proceed with the project. After reviewing historical documents and
photographs of the azea in question, LWPOA concluded that the omission of the channel
in our deed for the South marina was an oversight. I put forth that position in my letter of
September 5, 1998 and requested the fee be rescinded. Subsequently, at the Boazd's
suggestion, we have discussed the subject with the Southold Town Attorney. To date no
further action has been taken. Although we intuitively feel ow position is valid, events
have overtaken the issue.
We have now obtained permits from the NY DEC and State Departments, and the U. S.
Army COE. During the process of obtaining a DEC permit, that agency reduced the
amount of spoil that could be removed. Specifically, after requiring new soundings and
site information, the DEC reduced the area to be dredged because of the adjacent wetland
East of the channel and the fact that some waters were deeper than initially estimated. In
addition to these factors, it was discovered that an error was made when calculating the
$12,650 fee. Please note the attached recalculations using the DEC approved plan. Our
contractor, Latham Sand & Gravel, concurs with these new numbers. Accordingly, the
new calculated spoil to be removed from the channel is 177 cu. yds. (areas A, B and D as
indicated on the attached plan) and therefore the fee should be reduced to $1,770.
Notwithstanding the above, we still request that the Boazd waive this fee based on our
claims previously discussed. Please advise us on your decision as soon as possible so we
can move forwazd to make the final arrangements for this work.
