That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. CAMPO applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 23, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 18, 2013, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 • . The property I am proposing a Rock Revetment on is 1165 Fisherman's Beach RD. Cutchogue know on the survey as lot #18 I HAVE OWNED THE PROPERTY Since 1986 and as of 1996 the property in question which I have surveys of and would like to present to the Board AT THIS TIME /Shown marked in green is the property Sq. Footage at 13,079 sq. ft. above the High water mark, the current surveys on the same lot today show a much lesser amount of only 10,126 sq. ft. which means the property because of the more aggressive storms in recent years has lost almost 3.000 sq. ft. It has been said that as the erosion process occurs grass grows back and helps stabilize the area eroded, not true As has been proven by the 1996 survey each occurring storm erodes the new vegetation and keeps eroding further landward. The shed on the property as shown in the 1996 survey is approx. 37 ft. from the high water mark, again marked in green whereas today it's only 12 ft. I see the only logical and sensible way to stop the erosion process is to erect the rock revetment as shown and approved by the DEC. THIS WILL NOT ONLY CURE THE EROSION PROBLEM BUT WILL ALLSO PREVENT THE EROSION OF SILT AND DEBRI FROM GLOGING THE SHALLOW WATER WAYS ABUTTING THE PROPERTY. A ROCK REVETMENT IS MORE ESTATICALLY CONDUCIVE TO THE AREA THAN ANY OTHER TYPE OF BULK HEAD and it will give me piece of mind in not losing any more land area. At this rate in fifteen years or less lot #18 could be totally under water and much less time for the shed. I am urging the board in conjunction with the DEC approval to approve the Rock Revetment AS SHOW. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work. 3. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous location on the worksite and adequately protected from the weather. a. Storage of Equipment, Materials The storage of construction equipment and materials shall be confined within the project work area and/or upland areas greater than 75 linear feet from the tidal wetland boundary. 5. Backfilling All peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads or other approved shoreline stabilization structures shall be completed prior to placement of any fill material behind such structures. 6. No Equipment below Apparent High Water Equipment operation below (seaward) apparent high water is strictly prohibited. 7. Clean Fill Only All fill shall consist of clean sand, gravel, or soil (not asphalt, slag, flyash, broken concrete or demolition debris). No Beach Excavation For Fill No excavation of the beach is authorized for the purpose of obtaining fill or stone materials. 9. Plant Beach Grass The area of fill placement shall be planted with American Beach Grass planted 12 inches on center during the first growing season following placement, but not more than 6 months following the placement of fill. The pennittee shall maintain a beach grass survival rate of at least 85% after 3 years. Any grass planted after April 15 of any calendaz year shall be irrigated. 10. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activities. 11. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from construction of this project shall be completely removed from the adjacent azea (upland) and removed to an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas. 12. State Not Liable for Damage The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which maybe caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 13. State May Order Removal or Alteration of Work If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfaze of the people of the State, or cause loss or destruction of the natural resources of the State, the owner maybe ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to such extent and in such time and manner as the Depaztment of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 14. State May Require Site Restoration If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. is. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. Cutchogue. I was told by the Board on site at the time of inspection that I should submit to the DEC. first. As per your suggestion I did submit to the DEC. Enclosed is the approved letter, permit and stamped survey from the DEC. I understand that I need the approval of the Board of Trustees on this matter to move forward. I hope the Board of Trustees will grant the recommendations approved by the DEC. I have owed the property for 26 years and in the last seven years I have lost 8 feet of my property. I see no other alternative to stop the erosion process but a stone revetment that will blend in with the natural surroundings and give me the best possible solution to not losing more land which I can not afford. Herewith I am submitting to the Board of Trustees for a building permit to erect the Rock Revetment approved by the DEC. Nassau Point. I had hired Mr. Mark Schwartz to represent my reasoning for wanting a rip rap wall across the Northerly side of lot 111-1-25. Mr. Schwartz said he found out too late when the Board of Trustees was going to convene at the property and never got there in time. Mr. Schwartz asked me if I would like to speak to a board member, I said yes. Friday 8/24/12 late afternoon I got a call from a Mr. Dave Bergan a member of the board of Trustees to meet this past Saturday to discuss the matter at the site. Mr. Bergan explained that the board might be willing to allow some rip rap wall at the most easterly end of the site where the wood bulkhead ends now and possibly a little east of the shed going west of the shed to the westerly point of the site. I brought up the point that I have lost 15 feet of land since 2006 to 2012. In 2006 the existing shed was 30 ft. from the high water mark now its 15 ft. from the high water mark. Mr. Bergan's argument was that certain areas have since become gradual sloping and some grasses have taken root. My argument was if you look under the existing bushes you will see a lot of their roots exposed and an eroded bluff behind them. This lot is in all legality a single and separate lot tax lot # 111-1-25 and has lost approximately one quarter of its land surface in the time specified above I am fearful that the trend we are in of above normal storms will cause further loss of land. To stop that type of erosion without future worries and fewer problems why not do a complete rip rap wall to stabilize the site. I would be willing to concede on the depth that was proposed in the survey (by Nathan Taft Corwin dated April 25 2012) of the rip rap wall even though some property surface will be lost forever. I see the Boards priority of not disturbing areas that seem to have taken hold but that is only a temporary situation until the next major storm occurs and totally wipes out the fragile growth. Take into consideration those 30 yrs. of growth prior to the succession of major storms and it still got eroded anyway in the last 6 yrs. My main concern in this matter is to reclaim land that was lost if possible and to stabilize the area permanently and still give the area in effect a natural soft look. A rip rap wall is a financial burden forme at this time but I think it's worth the sacrifice for myself, my children and future generations of my family to enjoy this beautiful area with at least a degree of protection and less worry. Nor'easters are the storms that most affect this side of the property and we get at least one a year. I hope The Board of Trustees can see my concerns in this matter and I thank you all for the opportunity to express my opinion in this letter.
