WITNESSETH,that the party of the first part, to whom letters
testamentary were issued by the Surrogate's Court, Suffolk County, New York
on September 15, 1995 and by virtue of the power and authority given in and by said last will
and testament, and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being incte at Pine Neck, in t e Village and Town of Southold, County of
Suffolk and State of New York, an being more particularly bounded and described
as follows:-
BEGINNING at a concrete monument set on the northerly line of a 50 foot private
road 319. 72 feet easterly along said line from the easterly line of Oak Lawn Avenue;
running thence along land now or formerly of Teunis S. Bergen and Norman N. Bergen,
N.7°18' E. 117 feet, more or less, to Jockey Creek; thence easterly along said
Jockey Creek 45 feet or more to the westerly line of a second private road; thence
along said line of second private road, S.7°18' W. 170 feet, more or less, to a con-

Crete monument on the northerly line of first described private road; thence along
said line of first described private road, N.82° 42' W. 45.0 feet to the point of
beginning.
TOGETHER with all the right, title and interest of the party of the first part
of, in and to Jockey Creek lying in front of and adjacent to said premises and to
the lands under the water of said Jockey Creek.
TOGETHER with a right of way for ingress and egress to Jockey Creek, Oak Lawn
Avenue and Pine Neck Road over an existing 50 foot right of way hereinabove men-
tioned.
TAX MAP SUBJECT to a right of way over an existing foot path between Jockey Creek and
DESIGNATION the upland for the purpose of passing and repassing between the right of way lying
on the easterly side of the premises herein described and other premises now or
Dist. formerly of Teunis S. Bergen and Norman N. Bergen adjacent to Jockey Creek and
Se lying westerly of the premises herein described.

Blk' TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances,

the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ-
ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the distributees or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
Subject to the trust fund provisions of section thirteen of the Lien Law.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.

RIDER TO EXECUTOR'S DEED BETWEEN MARJORY MOFFAT AND MARJORY M. STEVENS
and PETER B. STEVENS.
Said above described premises being the same as more particularly shown on an
unfiled Map entitled, "Map of Plots owned by Teunis Bergen and Norman Bergen at
Southold, New York, made by Otto W. VanTuyl, Licensed Surveyor, Greenport, N.Y. and
dated December 1943, and being therein designated as Plot "E".
Being and intended to be the same premises conveyed by Teunis S. Bergen and Norman N.
Bergen to William Moffat by deed dated April 15th, 1946, and recorded in the Suffolk
County Clerk's Office on April 29, 1946, in Liber 2557 of deeds at page 237.
