WITNESSETH, that the party of the first part, inconsideration of Ten Dollars and other lawful
consideration, lawful money of the United States, paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk and State of New York.
SEE SCHEDULE `A' ATTACHED HERETO AND MADE A PART HEREOF
Being and intended to be the same premises conveyed to the party of the first part by deed dated 12/5/85
recorded in the Office of the Clerk of the County of Suffolk on 1/3/86 in Liber 9948 page 396.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HAT~EAND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the f rst part, covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the same
for any other purpose.
The word "party" shall be constn?ed as if it read "parties" whenever the sense of this indenture so
requires.

ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being in the Town of Southold, County -
of Suffolk and State of New York, known and designated as Lot No. 128 on Map
entitled, "Subdivision Map of Cedar Beach park, situated at Bawiew, and tiled in the
Office of the Clerk of the County of Suffolk on December 20, 1927 as Map No. 90, said
lot being more particularly bounded and described as follows:
BEGINNING at a point on the easterly side of a Private Road (33 feet in width) a
distance of 100.33 feet southerly as measured along the easterly side of said of said
private Road from the corner formed by the intersection of the southeasterly side of
Little Peconic Bay Lane, and the said easterly side of said private road, which said point
is also the point where the easterly side of aforesaid private road, is intersected by the
division line between lots 128 and 129 as shown on the aforesaid map;
RUNNING TI-IENCE alongsaid division line, south 67 degrees 25 minutes 20 seconds
east a distance of 209.70 feet to the shore line of West Lake as it existed in 2003;
THENCE south 0 degrees 33 minutes 50 seconds east along said Shore Line 108.75 feet
to the division line between lots 127 and 128 as shown an the aforesaid map;
THENCE along said division line north 67 degrees 25 minutes 20 seconds west a
distance of 221 feet to the easterly side of aforesaid private road; .
THENCE along said easterly side of said private Road north 1 degrees 44 minutes 30
seconds east a distance of 107.00 feet to the point or place of BEGINNING.
EXCEPTING THEREFROM that strip of land along the easterly portion of the property
that lies between the shore line of West Lake as it existed in 1986 and the easterly shore
line of West Lake as it existed in 2003.
