(631) 765-1809 • Fax (631) 765-9064 Q7 o~lno~a ~owtt tlatw FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF SEPTEMBER 19, 2013 ZBA FILE # 6674 NAME OF APPLICANT: Frank Marsilio SCTM-1000-115-12-15 PROPERTY LOCATION: 1080 Deep Hole Drive, (adj. to Deep Hole Creek) Mattituck, NY SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATNE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 13, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 26, 2013. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The property is adjacent to Deep Hold Creek with 100.15 feet bulk-headed frontage on its western side. The property runs 216.88 feet on the northern side, 222.32 feet on the southern side, and 100 feet on Deep Hole Drive. The property is improved with a one story frame dwelling and an accessory garage located in the front yard. A floating dock and ramp extends from the bulkhead into the creek. There is a shed which is primarily on the neighbors' property which slightly encroaches onto the applicant's property. The frame dwelling is in Zone X. All is shown on a survey by John T. Metzger L.L.S. dated October 27, 2010 and last updated on January 4, 2013. BASIS OF APPLICATION: Request for Variance from Article XXII Section 280-116(B) based on an application for building permit and Building Inspector's June 28, 2013 Notice disapproval concerning a permit to construct additions and alterations to an existing single family dwelling, at; 1) proposed construction at less than the code required bulkhead setback of 75 feet. RELIEF REQUESTED: The applicant requests a variance to construct an addition to an existing dwelling at 72 feet from an existing bulkhead, where the code requires a bulkhead setback of not less than 75 feet. Page 2 of 3 -September 19, 2013 ZBA Filek6674 - Marsilio SCTMi/ 1000-I15-12-IS ADDITIONAL INFORMATION: During the hearing testimony was taken that the neighbor on the south side of the property has a similar variance to the one being requested. Also, the property has a NYS DEC permit to construct additions to the existing dwelling. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 5, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1I. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed deck/covered porch addition is proportional with the overall size of the house and would have a reverse hip roof that blends in with the existing hip roof. The covered porch would not be seen from the street and can only be viewed from the creek side of the house. Other houses in the neighborhood have covered porches facing the creek. 2. Town Law &267-b(31(b1(21. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed deck extends from the existing structure six feet wide and a six feet wide deck is desirable for outdoor dining and entertaining. A three foot wide deck would be code conforming with a setback of 75 feet however it would not be as usable. 3. Town Law &267-b(31(b1(31. The variance granted herein is not mathematically substantial, representing 4% relief from the code. 4. Town Law &267-b(3I(b)(41 No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(6I(5). The difficulty has been self-created. The applicant purchased the parcel afrer the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a covered porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Goehringer, and duly carried, to GRANT, the variance as applied for, and shown on the Architectural prints by Niemann Architecture last dated June 20, 2013 labeled Tl, T2, S1, S2, EX, and AO-A3, and the stuvey by John T. Metzger L.L.S. dated October 27, 2010 and last updated on January 4, 2013. Subject to the following condition; CONDITION: 1. Drywells shall be installed as per Architectural prints by Niemann Architecture labeled S1 and last dated June 20, 2013. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed !n this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. State May Order Remova( or Alteration of Work If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work, obstructions, or hazazds caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. State May Requve Site Restoration If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Envirormtental Conservation may lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 5. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 6. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous location on the worksite and adequately protected from the weather. 7. Notice of Commencement At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, [he bottom portion of the form must also be signed and returned, along with photographs of the completed work. s. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from ~ construction of this project shall be completely removed from the adjacent area (upland) and removed to i an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer aeeas. 9. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be stabilized with appropriate vegetation (gasses, etc.) immediately following project completion or prior to permit expiration, whichever comes first. [f the project site remains inactive for more than 48 hours or planting is impractical due to the season, then the azea shall be stabilized with straw or hay mulch or jute matting until weather conditions favor germination. lo. Long-term Plant Survival The 700 square foot buffer shall be planted with native shrubs and the permittee shall ensure a minimum of 85% survival of plantings by the end of five growing seasons. If this goal is not met, the permit holder shall re-evaluate the restoration project in order to determine how to meet the mitigation goal and submit plans to be approved by the office of Regional Habitat - TW ii. Area of Disturbance for Structures Disturbance to the natural vegetation or topography greater than 25 feet seawazd of the approved structure is prohibited. 12. Applicatioes For Permit Renewals, Modifications or Transfers The permittee must submit a sepazate written application to the Department for permit renewal, modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. NOTTFICATTON OF OTHER PERMiTTEE OBLIGATTONS i Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification The permittee, excepting state or federal agencies, expressly agrees to indemnify and hold harmless the Department of Environmental Conservation of the State of New York, its representatives, employees, and agents ("DEC") for all claims, suits, actions, and damages, to the extent attributable to the permittee's acts or omissions in connection with the permittee's undertaking of activities in connection with, or operation and maintenance of, the facility or facilities authorized by the permit whether in compliance or not incompliance with the terms and conditions of the permit. This indemnification does not extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or intentional acts or omissions, or to any claims, suits, or actions naming the DEC and arising under Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision under federal or state laws. Item B: Permittee's Contractors to Comply with Permit The permittce is responsible for informing its independent contractors, employees, agents and assigns of their responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee. Item C: Permittee Responsible for Obtaining Other Required Permits The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of- way that may be required to carry out the activities that are authorized by this permit.
