PROPERTY LOCATION: 13200 Main Road, Mattituck, NY SCTM# 1000-114-11-9.1 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 13, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTSlDESCRIPTION: The parcel is 13,568 square feet and is in a Hamlet Business Zone. The parcel is L-shaped with 72.5 feet of road frontage along the Main Road (S.R. 25), is improved with a 2 story frame structure and a frame garage, as shown on the "Survey of Property", prepared by Nathan Tafr Corwin Ili, L.S., dated January 11, 2012 and last revised February 28, 2013. BASIS OF APPLICATION: Request for Variance froth Article X Section 280-45 C(f) and the Building Inspector's June 5, 2013 Notice of Disapproval based on an application for building permit to convert a dwelling to two apartments and office space, at: 1) the proposed apartments will comprise of more than the code permitted maximum 40% of the principal building. RELIEF REQUESTED: The applicant proposes to convert an existing 2 story structure into two 600 sf. apartments and anon-medical office. The total areas of the proposed two apartments will comprise 58.5% (1200 sf.) of the structure's total floor area where the code permits a maximum of 40%. The request is for an additional 18.5% (380 sf) of the structure's total floor area to be converted to apartment use. The total floor area is 2050 sf. ADDITIONAL INFORMATION: The applicant had previously proposed creating three dwelling units in the subject 2 story structure, one of which required an area variance for insufficient area and was then granted a variance under Appeal #6540. The applicant had to revise the proposed plan granted under Appeal #6540 due to Suffolk County Health Department requirements The Southold Town Planning Board, in a memorandum to the Zoning Board of Appeals, dated February 7, 2012, stated its support for the conversion of this structure into multiple dwelling units (apartments). Page 2 of 3 - September 19, 2013 ZBAN6677 -Goggins SCTMp1000-114-11-9.1 FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 5, 2013, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the requested variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. There are no proposed exterior changes that would create an undesirable change in the character of the neighborhood. The proposed accessory apartment use within the subject existing structure is a permitted use in this Hamlet Business Zone. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing structure's total floor area is insufficient to create two apartments at 600 sf. each and anon-medical office space that comply with the Code requirement that the apartments combined floor areas shall not comprise more than 40% of the principal building/structure. To add the deficient 1000+/- square footage to the structure in order to create a Code conforming maximum combined apartment floor areas of 40%, by means of new construction of an addition, would not be economically feasible in this Hamlet Business zone. 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 45% relief from the code. However, the conversion of the existing structure, in this Hamlet Business Zone, into multiple apartments furthers the goal of the Town's Comprehensive Plan by improving the availability of housing. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this Hamlet Business district will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed conversion of the existing structure to apartments and non-medical office uses is subject to site plan approval by the Planning Board, whose function, among others, is to mitigate any adverse impact the proposed action(s) may pose to the physical or environmental conditions in the neighborhood. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant could create apartments with less square footage and comply with the code requirement, however the applicant testified that smaller apartments would not be as marketable and would not be economically feasible as it may not promote an adequate return on investment. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of creating two apartments whose combined floor areas are greater than the code permitted 40% of the principal building/structure, in a Hamlet Business Zone, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: [n considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider ,seconded by Member Weisman (Chairperson), and duly carried, to GRANT the variance as applied for, as shown on the survey by Nathan Taft Corwin III, L.S. dated January 11, 2012 and last revised Feb 28, 2013. . CONDITION: l .Applicant must obtain site plan approval from the Planning Board. 2. Subject to final first and second floor plans with corrected square footage for the proposed two apartment units and the proposed non-medical office space. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this applicatlon when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. BASIS OF APPLICATION: Request for Variance from Article I Section 280-45 and the Building Inspector's December 22, 201 I, amended January 9, 2012 Notice of Disapproval based on en application for building permit to convert a dwelling to multiple dwelling units (3) at: t) one unit at less than the code required minimum of 850 square feet. RELIEF REQUESTED: The applicant proposes to convert an existing dwelling into three dwelling units. Two of the proposed dwelling units having the Code conforming 850 sq. ft., the third dwelling unit is proposed at a nonconforming 486 sq, ft. The applicant requests an area vaziance to create the third dwelling unit having 486 sq. ft., requiring a 43% or 364 sq. ft. relief from the Code required 850 sq. ft. ADDITIONAL INFORMATION: The Southold Town Planning Board, in a memorandum to the Zoning Board of Appeals, dated February 7, 2012, stated its support for the requested variance. Town Law &267-b(3)(b)(1), Grant of the requested variance wi{I not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. There are no proposed exterior changes that would create an undesirable change in the character of the neighborhood. The proposed multiple dwelling use within the subject existing dwelling is a permitted use in this Hamlet Business Zone. The property has ample room to allow for all tenants to park on [he subject parcel. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling's total habitable floor area is insufficient to create three dwelling units that comply with the Code requirement of 850 sq. ft. per dwelling unit. To add the deficient 364 squaze footage, to create three Code conforming size dwelling units, by means of new construction of an addition, would not be economically feasible in this Hamlet Business zone. 3. Town Lew &267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 43% relief from the code. However, the proposed subject dwelling unit at 486 square feet is 36 square feet or 8% larger than what the Code permits as an accessory apartment in a one family dwelling in the A-C, R-40, R-80, R-120, R-200 and R-400 Zones. Furthermore the conversion of an existing dwelling, in a Hamlet Business Zone, into multiple dwellings (apartments) furthers the goal of the Town's Comprehensive Plan by improving the availability of affordable rental housing. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have en adverse impact on the physical or environmental conditions in the neighborhood. The proposed conversion of the existing dwelling to multiple dwellings is subject to site plan approval by the Planning Board, whose function, among others, is to mitigate any adverse impact the proposed action(s) may pose to the physical or environmental conditions in the neighborhood. 5. Town Law 5267-b(3Nb)(5). The difficulty has been self-created. The applicant could create only two (larger) dwelling units and therefore not require a variance for a third having insufficient area, however the applicant testified that alternative would not be economically feasible as it may not promote an adequate return on investment. 6, Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy, in a Hamlet Business Zone, the benefit of one of three dwelling units within an existing dwelling to consist of 486 sq. ft., while preserving and protecting the character of [he neighborhood and the health, safety and welfare of the community. OFVnership. The "Owner" of the Unit shall be registered with the Town Housing Registry and shall hold a Certificate of Eligibility issued by the Special Projects Coordinator ("SPC") of the Town in accordance with the Town Code. Household income shall be determined at the time of determination of eligibility. 2, Occupancy or Rental of Unit. (I) Occupancy of Unit. (4) In no event will the Town approve a lease unless the tenants aze families/individuals listed on the Town Housing Registry in possession of a Certificate of Eligibility issued by the SPC. (5) The maximum rental amount and maximum incomes of tenants shall be as determined by the Town as set forth in §280-30 and §280-31 of the Town Code. (6) No lease shall be for a period of more than two (2) years. (7) Pursuant to §280-31 of the Town Code, the Owners shall submit an annual report to the SPC no later than May 315' of each calendaz year in writing certifying the amount of rent received by Owners for the prior yeaz and that the lease complies with the provisions of the Town Code. Owners shall include in any lease the requirements that Tenant submit an annual report to the SPC certifying the tenant's household income for the prior year no later than May 31~` of each yeaz. 3. Event of Default. The occurrence of any of the following shall constitute an event of default: (A) A tenant ceases to occupy the Unit as his principal residence without obtaining the Town's written approval to sell or lease the Unit; (B) Owners lease or rent the Unit to a tenant prior to obtaining the Town's approval thereto, or allows another person to reside in the Unit; or Owners lease the Unit at a monthly rental rate in excess of the affordable monthly rental rate determined by the Town; (C)Owners fail to submit an annual compliance report, or if leased, the tenant fails to submit an annual compliance report as required under §280-31 in a timely manner; (D) Owners fail to perform or keep or abide by any term, covenant or condition contained in this Declazation, or fails to comply with any other provision of Chapters 34 and 117 or §280-24 through §280-33 of the Town Code; -2- • • ~ (E) If any written representation or statement made to the Town by Owners with respect to qualification or certification for eligibility as a Tenant, including the annual compliance report, is untrue in any material regazd; 4. Remedies Available to the Town. (A) If an event of default occurs, the Town may issue a Notice of Default requiring Owner to cure the default. (B) In the event Owners fail to cure the default within a 30-day period afrer receipt of the Notice of Default, the Town may, in its sole discretion, extend the period to cure such default if Owners are diligently proceeding to cure such default, or the Town may pursue any judicial or administrative remedy available at law or equity (including administrative and judicial remedies prescribed in the Town Code). (C) The Town may commence a civil action to enjoin any violation or to compel specific performance of this Declaration and to recover damages therefore. Monetary penalties aze imposed by the Code, and such penalties aze not the exclusive remedy available to the Town. (D) In addition to the rights otherwise set forth herein, violations of this Declaration by any person, corporation, or other entity, whether a principal, agent, employee or otherwise, including 13200 Main Road Corp. or Owners, shall be punishable in accordance with the provisions of §280-33 and/or § 117-10 of the Town Code. (E) In the event that legal action is commenced by 13200 Main Road Corp., Owners or Town to enforce any of the terms of this Declazation or the Town Code, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs arising from said action. 5. Successors and Assigns. The provisions of this Declaration of Covenants and Restrictions shall run with the land and bind the Property for the benefit of the Town in perpetuity. 6.. Amendments. This Declaration may not be changed or terminated, nor any of its provisions waived, except by written instrument signed by the Town, or if such amendment would be at variance with any provision of the Town Code, in accordance with Town procedure for Code amendments. 7. Notices. Any and all notices, elections, approvals, consents, demands, requests, responses and other communications pemutted or required hereunder shall be in writing and shall be deemed to have been properly given and shall be effective upon receipt or refusal thereof if delivered personally, or by recognized overnight courier, or three (3) days after deposit thereof in the United States mail, postage prepaid to the address of such party provided to the Tax Assessor. (A) No remedy herein conferred upon or reserved to the Town is intended to be exclusive of any other remedy or remedies and each and every such remedy shall be cumulative and shall be in addition to every other remedy given hereunder or now or hereafter existing at law or in equity. Delay or failure of the Town to exercise any of its rights under this Declaration or the Town Code shall not be deemed a waiver thereof. (B) If any portion or portions of this Declaration shall be held invalid or inoperative, then all of the remaining portions shall remain in full force and effect, and, so faz as is reasonable and possible, effect shall be given to the intent manifested by the portion or portions held to be invalid or inoperative.
