Dear Mr. Finnegan:
This letter is in response to a conversation between Adam Yablonsky and a clerk named Elizabeth in the
office of the Boazd of Trustees regarding an upcoming project in the Town. I wanted to take the opportunity to
clarify that conversation and re-present the support for LIPA's exemption from local approvals and permitting
requests.
Attached you will find two (2) letters pertaining to a similaz issue in 2011. As you will see, LIPA's
counsel cited the Public Authorities Law that the utility follows. Supervisor Scott Russell had met with LIPA
District Manager Mr. Steve Tricarico and Project Manager Mr. Bob Parkinson on the project and discussed it in
detail recently. Mr. Adam Yablonsky has filed the necessary Notice of Commencement as required by New
York State Department of Environmental Conservation General Permit # 1-9901-0001 1/0001 3.
I apologize for any confusion over the matter and appreciate your time, understanding and cooperation.
As always, LIPA enjoys a good working relationship with the Town and looks forwazd to continuing our efforts
to improve electric reliability to your constituents, our customers.

Dear Ms. Hulse:
This letter is submitted in response to your letter of July 13, 2011 and discussions you
had with Adam Yablonsky in which you requested support for LIPA's exemption from local
approvals and permitting requirements.
As you correctly indicated in your letter, LIPA has received a New York State wetlands
permit which allows the proposed work to proceed. LIPA is however exempt from the local
wetlands permit requirement. This exemption is. consistent with the language in the Public
Authorities Law by which LIPA derives its power. Section 1020-g mandates that LIPA is
authorized "to apply to the appropriate agencies and officials of the federal and state
governments, for such licenses, permits or approval of its plans or projects as it may deem
necessary or advisable, and to accept such licenses, permits or approvals as may be tendered to it
by such agencies or officials, upon such terms and conditions as it may deem appropriate."
(emphasis supplied) Local agencies are omitted since there are State agencies, such as the New
York State Office of General Services, which serve as the construction permitting agencies.
Pursuant to 19 NYCRR 448.3(e) the Office of General Services is charged with .the
responsibility for administration and enforcement of the New York State Uniform Fire Protection
and Building Code.
We appreciate your consideration and look forward to working with you. It is my
understanding that you have been provided with the documents that LIPA has filed with the
DEC. Please let me laiow if you have any further questions.

LIPA intends to commence work at Pewnic Substation, south of Mill Lane in Peconic.
Referenced in the June 24~h notice was NYS DEC authorization under general wetlands
permit#I-9901-00011/00013.
Please be aware that the description of the work contemplated falls within the
jurisdiction of the Southold Town Trustees as well and requires a wetlands permit prior to
commencement of work. To that end, your office may apply for a permit with the Office
of the Board of Trustees.

I spoke to Mr. Yablonsky, who indicated that because LIPA is a state authority, that they do not apply for
discretionary permits with local municipalities. They have not made applications for work in any of the
east end towns, and will only apply for mandatory permitting, such as road openings.
I requested that he forward a written response to our inquiry for reference.

I received your letter dated July 13, 2011 (copy attached) today and tried leaving a
voice message at your office. Unfortunately, I got disconnected twice.
In any event, as the subject work is being undertaken by the Long Island Power
Authority - a NYS authority - we have been proceeding with this project under the
assumption that no local discretionary permits were necessary. As far as I know, this
has been common practice across Long Island since LIPA took over the electric
transmission and distribution system several years ago.
I have informed the Project Manager to hold off on any of the work addressed in the
NYSDEC General Permit notification until this matter can be resolved.
It would be greatly appreciated if you would email or call me at the phone number
below to discuss this further.
I hope to speak with you soon.

The latest information I have this morning regarding this project is that per the plans received on April 4, 2013, the
project is determined to be non-jurisdictional. The drill pit is approx. 100' beyond the freshwater wetland boundary,
approx. 100' beyond the high tide water line, and that the scope of the work beyond the drill pit being performed is to
be underground. No emergency permit is required at this time, however, if the project did change to where it fell within
our jurisdiction, the project should be re-reviewed for the possibility of requiring some type of permit application and
the LIPA exemption would have to be investigated further.

The submarine cable runs underground between the terminus of Island View Lane in
Southold to Crescent Beach located at the intersection of Shore Road and West Neck
Road, on Shelter Island. The project is located within the regulated area of Southold Bay
south of Pipes Cove and the regulated area of Wecks Pond and associated freshwater
wetlands south of West Neck Road. See map.

Proiect Description
The project will replace a 13 KV submarine distribution cable between Southold and
Shelter Island. The existing cable was damaged during Hurricane Sandy in October,
2012 and is currently out of service. Cable replacement is critical to meeting summer
electrical demands on Shelter Island, which is now being served by only two distribution
cables -one from North Haven and one from Southold. The proposed project will
replace the damaged cable with a 15kV cable installed within a 10" diameter high
density polyethylene (HDPE) conduit and two spare conduits will also be installed at this
time. The submarine portion of the project will be installed using Horizontal Directional
Drilling (HDD), with the entry and exit pits being located in paved roadways upland of
mean high water. The total length of the project is approximately 4030 feet. The HDD
portion of the project is approximately 3480 feet. At Southold, the upland portion of the
project will include the installation of approximately 240 feet of cable by conventional
trenching, while on Shelter Island, approximately 310 feet of cable will be installed by
conventional trenching. The new cable will be installed a minimum of 20 feet below the
bottom of Southold Bay. At Southold, the cable will terminate at a new riser pole to be
installed on the north side of Bay Shore Road. On Shelter Island, the cable will
terminate at a new riser pole to be installed on the north side of West Neck Road. See
enclosed drawings.
