SUFFOLK COUNTY ADMINISTRATIVE CODF: This application was reterred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 15, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county -wide or inter -community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated 6/4/2013. PROPERTY FACTS/DESCRIPTION Subject property is a non -conforming 32,108 square foot lot located in the R40 zone. It is improved with a two story frame dwelling with attached garage and rear deck. It has 100.00 feet on Wells Avenue (aka Wells Road), 265.15 feet along the south property line, 141.45 feet along Jockey Creek and 288.17 feet on the northern property line as shown on the survey dated August 26, 2010 revised September 9, 2010, prepared by John C. Ehlers, LS. BASIS OF APPLICATION: Request for Variance Article XXII Section 280-116 (B) and the Building Inspector's April 8, 2013 Notice of Disapproval based on an application for building permit to construct an accessory in - ground swimming pool, additions and alterations to an existing single family dwelling at; 1) less than the code required bulkhead setback of 75 feet. RELIEF REQUESTED: The applicant requests a variance to construct additions and alterations to the dwelling and construct an in -ground swimming pool with a bulkhead setback of 36'3feet where the code requires a 75 foot bulkhead setback. Page 2' of 3 — June 20, 2013 Z13A#6655 — Va tola SCTM# 1000-70-4-15.1 AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. On June 10, 2013, the applicants' architect submitted a revised site plan increasing the setback to 40.4' feet at the closest point from the proposed raised terrace to the bulkhead, thereby bringing the application into more conformity with the code. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 6, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 6267-b(3)(b)(D_ Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. A swimming pool is a common accessory to residential homes in this neighborhood. Many homes in this area have non -conforming bulkhead setbacks. The proposed rear yard location for the swimming pool and related attached split level raised terrace will not be visible to the street. 2. Town Law &267-b(3)(b)(2) The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance, because of the location of the existing dwelling, the fact that the existing bulkhead wraps around to the sides of the subject property, and the unsuitability of a front yard location for a swimming pool in this neighborhood. However, the grant of alternative relief which increases the setback to the wrap around bulkhead by removing a proposed stone planter on the attached raised patio will bring the variance request into more compliance with the code. 3. Town Law &267-b(3)(b)(3) The alternative relief granted herein is mathematically substantial, representing 47% relief from the code. However, this is mitigated by the fact that the existing bulkhead wraps around to the sides and bulkhead setbacks are greater at other points on the subject property. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and an increased setback for this project to the bulkhead. The applicant will install a drywell for pool dewatering and a 15 foot wide landscaped non -fertilization buffer on this sloping property, landward of the bulkhead per recommendations of the LWRP Coordinator. 5. Town Law 4267-b(3)(b)(5) The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions to the existing dwelling and a raised split level patio around an in -ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
