Apparently, most of the clearing occurred outside or landward of the generally required 50' buffer. • In closing, I believe this matter has been scheduled for a continuation of the hearing before the Board of Town Trustees on Wednesday, June 22, 2005 at 7:00 P.M. at which time I respectfully request a final disposition of this matter consistent with the above proposal. Based on a field measurement I took from the delineated wetlands boundary, it appears that most of the felled trees were located more than 50 feet from the wetlands boundary and therefore landward of the buffer area the Town Board of Trustees typically requires be established and maintained adjacent to wetlands. Therefore, I do not believe that the Town should or would require you to offer any revegetation or other remediation for the removal of these trees. Based on my ol7servation of the adjacent sites, however, it does appear that clearing of brush and other ground vegetation has occurted within the usually required 50-foot buffer area. Although it appears [hat a significant portion of this material may have been invasive vines or other noxious vegetation, clearing and/or replacement of such vegetation within a wetland buffer area is not allowed in Southold Town without written permission from the Board of Trustees. Therefore, 1 expect that the Town would require you to revegetate this area with native vegetation, but because there was no significant clearing of trees, this should be a relatively elementary task. Due to the small fringe of freshwater wetland vegetation that exists immediately landward of the more brackish and/or tidal wetland area, replacement vegetation could include a few small red cedar trees; shrubs such as bayberry, sweet pepperbush, and arrowwood viburnum; and anon- woody understory species such as switchgrass. i would also recommend the immediate removal of the brush and leaf litter left adjacent to and in the wetland area. Because this material was left predominantly in areas dominated by Phragmites, however, it would not be necessary to revegetate or take additional remedial action in these areas, as the Phragmites will naturally reclaim those areas before the growing season has ended. Should you require any additional input from me regarding this site, please let me know. Sincer~ly yours, Rob~~t~. Herrmann Coastal Management Specialist PATRICIA A. FINNEGAN J09HUA Y.
