Schermeyer Town Clerk Generated 9/12/2013 Page 2 Southampton Town Board -Letter Board Meeting of September 10, 2013 TOWN BOARD RESOLUTION 2013-883 item # e.~ ADOPTED DOC 1D: ffi$97 a Notice of Adoption to Amend Chapter 330 (Zoning) to Change the Zoning Map Classification on a Certain Parcel (SCTM 900- 341-2-6)frnm Hamlet Office/Residential (HO) to Hamlet Commercial/Residential (HC), East Quogue WHEREAS, achange-of-zone application was received by the Town of Southampton Town Clerk on June 4, 2013; and WHEREAS, said application proposes to rezone one parcel of approximately 32,747 square feet (.78 acres) from Hamlet Office/Residential (HO) to Hamlet Commercial/Residential (HC) in East Quogue; and WHEREAS, said parcel is located on the south side of Montauk Highway (CR 80) approximately 427 ft. west of Walker Avenue, and identified on the Suffolk County Tax Map as 900-341-2-6; and WHEREAS, the intended use of the subject parcel is hardware and equipment rental operations, which would occupy an existing 7,000 sq. ft. vacant building that was previously used as a retail patio furniture store; and WHEREAS, the requested HC zone permits the same design and performance standards as HO zoning, but would allow for the above-referenced use as a permitted use in the HC district and also would continue the already-established HC district in this location so that there is greater consistency in the zoning pattern for this Hamlet; and WHEREAS, the Town Board held a public hearing on the subject application on August 13, 2013 where the rezoning request was largely supported by the community; and WHEREAS, the proposed action meets the criteria of an Unlisted Action, and the Town Board conducted an uncoordinated review; and WHEREAS, by Resolution No. 2013-865, the Town Board of the Town of Southampton as Lead Agency adopted a Negative Declaration for the subject action; now, therefore BE IT RESOLVED, that Local Law No. 18 of 2013 is hereby adopted as follows: LOCAL LAW NO. 18 of 2013 A LOCAL LAW amending the Town's Zoning Map (Chapter 330, Zoning) to change the zoning classification of a certain parcel from Hamlet Office/Residential to Hamlet Commercial/Residential in East Quogue, Town of Southampton. BE IT ENACTED by the Town Board of the Town of Southampton as follows: SECTION 1. Legislative Intent The 1999 Comprehensive Plan Update recommended preserving the residential character found along ~~Main Street" hamlet centers like the area at and near 585 Montauk Highway in Generated 9/12/2013 Page 3 Southampton Town Board -Letter Board Meeting of September 10, 2013 the Village of East Quogue by applying the Hamlet Commercial/Residential (HC) and Hamlet Office/Residential (HO) zoning classifications to replace the Village Business (VB) designation. Given the scale of the existing land uses along Montauk Highway through the village, the Comprehensive Plan Update recommended adoption and implementation of the HO-HC zoning for specific parcels in order to accomplish the following objectives of the Plan: • Creating low impact attractive neighborhood centers with a rural character, • Obviating the need to travel long distances for convenience shopping, and • Providing an orderly transition in uses, density and bulk between residential, retail and office development along the central business corridor. The Plan specifically recommends the subject parcel at 585 Montauk Highway be zoned HC, with properties east of the parcel zoned HO. The HC zone allows for the new intended use of the subject parcel as a hardware and equipment rental operation, while the current HO zoning distinction does not. Creating a zoning line modification of HO to HC allows the parcel owner to reuse the existing 7,000 sq. ft. vacant building (formerly a retail patio furniture store) in a manner consistent with the nature of the Hamlet Center. The zoning line modification intends to extend the easterly boundary of the existing HC zoning designation 108 linear feet along the south side of Montauk Highway to the easterly side of the subject parcel. This HC zone would involve much the same design and performance standards as the HO zoning, but would also allow (by special exception) the uses allowed in the Village Business districts, in addition to housing, offices and other HO uses. SECTION 2. Amend the Zoning Map of the Town Code as follows: The subject parcel located at 585 Montauk Highway in East Quogue (Suffolk County Tax Map #900-341-2-6) shall be re-zoned from the current Hamlet Office/Residential (HO) to Hamlet Commercial/Residential (HC) and the Town's Department of Geographic Information Systems shall effect this change on the Town's zoning map and within the Town's databases. SECTION 3. Severability If any section or subsection, paragraph, clause, phrase or provision of this law shall be judged invalid or held unconstitutional by any court of competent jurisdiction, any judgment made thereby shall not affect the validity of this law as a whole or any part thereof other than the part or provision so adjudged to be invalid or unconstitutional. SECTION 4. Effective Date This Local Law shall take effect upon the filing of this Local Law with the Secretary of State pursuant to the Municipal Home Rule Law.
