Present were: Peter Young, Chairman Jack McGreevy, Member John Stein, Member William McDermott, Member Doug Hardy, Member Lauren Standish, Secretary Absent were: Derek Bossen, Member CALL TO ORDER The meeting was called to order at 4:40 PM by Chairman Peter Young ANNOUNCEMENTS Chairman Peter Young announced the resignation of Audrey Horton. If anyone knows of someone who has interest in serving, please have them submit a resume to the Town Clerk's office. John Bredemeyer, Trustee and Michael Collins, Town Engineer will attend the next CAC meeting and discuss MS4. REPORTS 2 Peter Young and John Stein attending the Town Board meeting held on Wed., August 7th on Fishers Island. It was a beautiful day and encouraged the other members to attend in the future. APPROVAL OF MINUTES Moved by John Stein, seconded by William McDermott, to Approve the Minutes of July 10, 2013. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by John Stein, seconded by William McDermott, it was RESOLVED to SUPPORT the application of ORIENT WHARF COMPANY, INC. for the long term maintenance and repair of all existing facilities including the continued and seasonal repair and employment of fixed and floating docks and use of the marina facilities in their current locations and configuration with no adverse impact on the adjacent tidal wetlands or waters of the Town. Located: 2110 Village Lane, Orient. SCTM#24-2-28.1 Inspected by: Peter Young, John Stein, William McDermott The CAC Supports the application using best management practices and provisions are made for containment of stormwater run-off along the whart. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by William McDermott, it was RESOLVED to SUPPORT the application of THE MARY DEMARTINO QUALIFIED PERSONAL RESIDENCE TRUST to resheath landward side of approx. 142 If. of existing timber bulkhead with vinyl sheathing; resheath landward side of existing 18' easterly timber return with vinyl sheathing and extend vinyl sheathing approx. 10' landward (north); install sister pilings on seaward side of existing bulkhead and return; backfill and renourish storm eroded areas landward of return with approx. 50 cy. of clean sand to be trucked in from an approved upland source; and replant disturbed portions of 15' wide vegetated slope with native vegetation. Restore damaged bluff via cut and fill (with the inclusion of 400 cy. of additional fill obtained from an approved upland source, and install a 10' tall, 20' wide, 190' long rock revetment to protect the toe of the bluff from future storm damage and erosion. Build a set of beach access stairs from top of the bluff, over the revetment, and down to the beach. The total length of the staircase will be 68' 10" and will descend 32'. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by William McDermott, it was RESOLVED to SUPPORT the application of DRIFTWOOD FAMILY FARMS, INC. for a 10-Year Maintenance Permit to repair and maintain certain structures. The project consists of excavating a new pond. Approx. 38,000 cy. of material will be excavated. The surface area of the new pond will be approx. 1.96 acres. The project also consists of excavating to remove trash from the old farm operation dump, constructing three new 12" culverts with tide gates, repair breach in earthen dike and repair and restoration of existing earthen dikes. The proposed mitigative measures shall be in accordance with NRCS (USDA) dike specifications as well as any conditions required of the Town Trustees, NYSDEC & USACOE. To enhance the damaged berm areas and maintain the undamaged areas, this permit requests approval to remove all woody vegetation for the purpose of maintaining the rehabilitated berms and existing berms from future failure. Located: South Side of Route 25 and East of Narrow River Rd., Orient. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by William McDermott, it was RESOLVED to SUPPORT the application of JOE LICCIARDI & CATHERINE PING to improve on an exiting 106' rock revetment to protect the toe of the bluff from future storm damage and erosion. Included in this improvement will be a core stone base under the revetment, and a 6' wide non-turf buffer at the top of the revetment. Construct a set of beach access stairs from the top of the bluff, over the revetment, and down to the beach. Located: 50 Cleaves Point Rd., East Marion. SCTM#38-2-31 Inspected by: John Stein, William McDermott, Peter Young The CAC Supports the application with the Condition of a 12' non-turf buffer and to align the rock revetment with the adjacent property to the east. SCTM#40-1-20.2 Inspected by: John Stein, William McDermott, Peter Young The CAC Supports the application with the Condition measure are taken for erosion mitigation. 5 Vote of Council: Ayes: All Motion Carried Moved by William McDermott, seconded by John Stein, it was RESOLVED to SUPPORT the application of ARTHUR TORELL to construct asingle- family dwelling and garage, install pervious driveway, parking and underground utility lines, sanitary system, gutters and drywells for roof run-off and a 25' non-disturbance buffer landward of the edge of wetlands. Located: 365 Westwood Lane, Greenport. CLANCY to construct approx. 120 If. of vinyl retaining wall landward of tidal wetlands boundary and backfill with approx. 25 cy. of clean sand/loam fill to be trucked in from an approved upland source, and construct 4'X 2' steps. Located: 1150 Blue Marlin Dr., Southold. SCTM#57-1-33 Inspected by: John Stein, Peter Young, William McDermott The CAC does Not Support the application because the retaining wall is tantamount to a bulkhead. A less obtrusive structure should be made in alignment with the neighboring properties. Anon-turf buffer was not depicted on the plan and mowing is occurring up to the phragmites. Vote of Council: Ayes: All Motion Carried Moved by William McDermott, seconded by John Stein, it was RESOLVED to SUPPORT the application of RAY 8~ JOYCE VASTOLA to construct new second-floor, new windows and siding on existing house, new swimming pool and terraces, and new sanitary system and drywells. Located: 2795 Wells Ave., Southold. SCTM#70-4-15.1 Inspected by: John Stein, Peter Young, William McDermott The CAC Supports the application with the Condition the pool backwash is directed into drywells and additional drywells to contain all run-off from the structures and patio areas. The project requires an adequate engineered drainage plan and the project was not staked as of August 14, 2013. 6 Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of ILSE TROMBONE to reconstruct the bulkhead and retaining wall that were damaged by Superstorm Sandy. Two 10' returns will be added to the end of the bulkheads as per DEC recommendation. The beach house with attached deck will remain unmodified. The reconstructed bulkhead, including returns will be 185'7", and the reconstructed retaining wall will be 35'6". Located: 9180 Nassau Point Rd., Cutchogue. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of EDWARD VOLINI to replace/repair 100' bulkhead compromised/destroyed by storm, using vinyl sheathing. Repair/replace wood platform and steps, repair accessory beach house 10'X 12', 3' stairs, and 5'X 7' deck, and new 8' return. Located: 8625 Nassau Point Rd., Cutchogue. SCTM#118-4-13 Inspected by: Jack McGreevy, Doug Hardy The CAC Supports the application, however, the bulkhead should be aligned with the neighboring bulkheads and the bluff should be stabilized. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of DAVID WEILD to restore wetlands damaged by Superstorm Sandy; rebuild area with hand-placed sand, slope new edge approx. 45 degrees and hand stack stones and sand fill. Plant flat area with Spartina Patens and sloped area with Spartina Alterniflora between stones. The restoration of the wetland should minimize further loss through erosion. Located: 10450 New Suffolk Ave. Cutchogue. SCTM#116-6-5 Inspected by: Doug Hardy, Jack McGreevy The CAC Supports the application with the recommendation the applicant considers the vulnerability to future storm erosion. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by William McDermott, it was RESOLVED to SUPPORT the application of PRUDENCE HESTON to rehabilitate the existing earth berms damaged by Superstorm Sandy. The proposed mitigative measures shall be in accordance with NRCS (USDA) dike specifications as well as any conditions required of the Town Trustees, NYSDEC & USACOE. To enhance the damaged berm areas and maintain the undamaged areas, this permit requests approval to remove all woody vegetation for the purpose of maintaining the rehabilitated berms and existing berms from future failure. Located: West of New Suffolk Rd. and South of Cedars Rd., Cutchogue. SCTM#109-5- 23.3 Inspected by: Doug Hardy, Jack McGreevy The CAC Supports the application using best management practices. Vote of Council: Ayes: All Motion Carried MARTHA KENNELLY for the existing dock consisting of a 33'X 42" fixed dock, 10'X 36" ramp and 10'X 11' floating dock and a low bulkhead of 47.25'. Located: 2000 Deep Hole Dr., Mattituck. SCTM#123-4-2 8 The CAC did not make an inspection, therefore no recommendation was made. Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of JOE SBARRA to construct a 4'X 50' catwalk, install a 6'X 20' floating dock and two 8" round end piles to hold the floating dock in place, install a 26' long ramp to connect the catwalk to the floating dock, and construct a set of steps from the upland bank to the foot of the catwalk. Located: 3200 Cox Neck Rd., Mattituck. SCTM#113-8-5 Inspected by: Jack McGreevy, Doug Hardy The CAC Supports the application with the Condition the dock does not extend beyond 1/3 the width of the creek. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Peter Young, it was RESOLVED to SUPPORT the application of PETER BACCILE to place 75 cy. of stone backfill behind an existing line of armor stone over an area of 1500 sf. at and above the apparent high tide line by mechanical and manual methods to restore shorefront protection of an eroding coastal bluff. Located: Off Equestrian Ave., Fishers Island. SCTM#9-3-11 Inspected by: John Stein, Peter Young The CAC Supports the application with the Condition efforts are made to save all existing trees in the subsequent wetland area. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by John Stein, it was RESOLVED to SUPPORT the application of JAMES BAILEY to restabilize a storm- damaged shoreline by removing existing rocks located landward of existing concrete blocks and stockpiling them for reuse, upright those concrete blocks which have rolled over and align them. Landward of the concrete blocks install a 2"-4" thick layer of crushed stone, install geotextile filter fabric and replace rocks adding additional rocks as needed to provide a tightly grouped mass. Excavate a 10' area to 5' in depth, install geotextile filter fabric, install a 4" thick crushed stone filter layer and install an armored layer riprap revetment utilizing a minimum of 3' dia. rocks. In the areas where there are no concrete blocks remove and stockpile existing rocks, excavate a 12' area to 5' in depth, install geotextile filter fabric, install a 2"-4" crushed stone filter layer, install armor layer rip rap revetment utilizing a minimum of 3' dia. rocks with a 2:1 slope and install topsoil at the top 9 of the slope as needed. In the western portion of the property install one row of 2-5 ton rocks at the toe of the existing slope and toe-in rocks to existing grade. Located: 474 Wilderness Point Rd., Fishers Island. SCTM#12-2-6.15 Inspected by: Peter Young, John Stein Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND WETLAND & COASTAL EROSION PERMITS Moved by William McDermott, seconded by Doug Hardy, it was RESOLVED to NOT SUPPORT the application of PHILLIP & JENNIFER STANTON to Amend Wetland Permit #7727 to legalize the existing gate, tackle box and 5' wide decking on the 14' extension. Located: 845 Maple Lane, Southold. SCTM#64-1-29 Inspected by: Peter Young, John Stein, William McDermott The CAC does Not Support the application and recommends removal of the illegal structures and compliance with the original permit. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by John Stein, it was RESOLVED to SUPPORT the application of LYLE & KATHLEEN GIRANDOLA to Amend Wetland Permit #8002 to move the upper retaining wall back 3-5' for a total of 15' from existing lower bulkhead to be in alignment with the neighbor's bulkhead to the west; raise the height of the upper retaining wall by 1-2'; and cap the lower bulkhead with the grate style capping just like to the neighbor to the west. Located: 3040 Peconic Bay Blvd., Laurel. SCTM#128-6-10 Inspected by: Doug Hardy, Jack McGreevy The CAC Supports the application with the Condition the stairs are retractable. The applicant is subjected to erosion from the neighboring bulkheads. Bulkheads should be constructed in alignment with neighboring bulkheads.
