En-Consultants on behalf of 9820 NASSAU POINT, LLC requests a Wetland Permit to restore
and stabilize storm eroded embankment by excavating and removing vertical sheer/lip at top of
embankment and re-grade to shift top of embankment landward and re-establish more stable
angle of repose; use approximately 30 cubic yards of resultant material together with
approximately 30 cubic yards of clean sand trucked in from an approved upland source to re-
nourish face of embankment; install between two (2) to four (4) wood terrace retaining walls to
stabilize re-nourishment; and re-vegetate embankment with native plantings, such as Cape
American beach grass, switchgrass, Virginia rose, and/or Northern bayberry. Located: 9820
Nassau Point Road, Cutchogue. SCTM# 118-6-10
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nig ficant
beneficial and adverse effects u Jon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus each answer must be exalained in detail, listin¢ both supaortine and non-
supportin¢ facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

The proposed project will have [he effect of restoring and stabilizing [he storm eroded embankment by removing [he vertical sheer/lip at [he top of the
embankment and regrading to shift the top of the embankment landward and reestablish amore stable angle of repose; stabilizing and renourishing the
slope with terrace retaining walls and material trucked in and gained from the excavated top of embankment; and revegetating the embankment with
native vegetation. The project will thus employ a primarily vegetative/non-structural or "soft" approach to restoring, maintaining, and enhancing the
storm eroded natural protective resource with the supplemental use of "hard" stabilization, i.e., terrace retaining walls, only [o the minimum extent
necessary to increase the likelihood of success of the proposed renourishmen[ and revege[a[ion. Therefore, the project will be consistent with the goals
and policies of Policy 4.
