Environment East, Inc. on behalf of SANDRA & FRANK ALLECIA requests a Wetland Permit and a Coastal Erosion Permit for the existing 1'/: story t1,076sq.ft. single-family dwelling; gravel driveway; 4'x24' on-grade wood walk in side yard; 12'x25' wood deck in side yard; 104sq.ft. stairs with wood walk in side yard; 4'x21' raised deck in side yard; a 13'x15' covered deck and a 10'x24' deck attached to seaward side of dwelling; 8'x54' wood walk with stairs from deck to retaining wall; along northwest side yard a 78' long wood retaining wall varying 32" to 40" in height with an 8' landward return that attaches to wood deck and planter; along southwest side of property a 38' long upper wood retaining wall varying 32" to 40" in height, and a lower 40' long wood retaining wall varying 32" to 40" in height; 4'4" wide and T long steps to beach; on southeast side of property a 28' long upper wood retaining wall varying 32" to 40" in height, and a 35' long lower wood retaining wall varying 32" to 40" in height. SCTM# 27-4-5 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my j recommendation that the proposed actions are INCONSISTENT with Policies 4.1 and 6.3 and ! therefore INCONSISTENT with the LWRP. 4.1 Minimize losses of human Iffe and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The parcel is located in a FEMA VE and AE EI 6 flood zone. The residence is located in the AE EI 6 flood zone. 5. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to meet federal flood insurance program standards. m Figure 1. SLOSH map showing tidal surge during a Category 1 Hurricane and parcel. SLOSH stands for Sea, Lake, and Overland Surge from Hurricanes. It is a computer model developed by the National Weather Service (NWS) to estimate storm surge heights and winds resulting from historical, hypothetical, or predicted hurricanes. Astronomical tides can add significantly to the water height. The model accounts for tides by specifying the initial tide level. The SLOSH model does not include rainfall amounts orwind-driven waves. These need to be combined with the model results in the final analysis of at-risk areas. SLOSH is best used for defining the potential flooding from storm surge for a location from a threatening hurricane, rather than as a predictor of the specific areas that will be inundated during a particular event. Accuracy for the SLOSH model is generally within plus or minus 20% of the peak storm surge. If the model calculates a peak storm surge of 10 feet for the event, you can expect the observed peak to range from 8 to 12 feet. The accuracy of plus or minus 20% is for a known hurricane track, intensity, and size, based on looking at surge measurements (primarily high water marks) from past hurricanes (NOAA) Structures located within these areas have the potential to suffer high, repeatable rate of loss and pose hazards to life and property during storm surge events. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The structures described above were not constructed pursuant to Southold Town Trustees review and Chapter 275 Wetlands and Shorelines permit or Chapter 111 Coastal Erosion Hazard Area. It is recommended that the Board recognize the non-turf buffer if the action is approved. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
