Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Provide all proposed Best Management Practices that will further each policy. Incomplete answers will require that the form be returned for completion. DEVELOPED COAST POLICY Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III -Policies; Page 2 for evaluation criteria. X Yes _ No Not Applicable The proposed erosion protection restoration is consistent with existing plans and programs of the 'Gown because it helps to protect the nature of the shoreline, the coastal bluff, from eroding to the point where it sloughs which could cause extensive damage to existing environmental resources and the stability of the home site. Some vegetation has been lost and erosion is at the point of undermining mature trees along the shore. Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. See LWRP Section III -Policies Page 3 through 6 for evaluation criteria. Yes No X Not Applicable 2 . ~ Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. See LWRP Section HI -Policies Pages 6 through 7 for evaluation criteria _N Yes No Not Applicable The coastal bluff on which the Baccile's home is situated is wooded and heavily vegetated alone the shore. The shoreline has eroded almost the full length of the armored bank along the east edge of th_e property which make visible scars and encourages further damage, environmentally as well as aesthically. This proiect is well iustifiied. NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III -Policies Pages 8 through 16 for evaluation criteria. x_ Yes No Not Applicable This proiect is completely consistent with the policy. While the material is stone, a natural product, it will be supplementing the scour protection of the existing armor stone and recreating lost habitat and the protection of root base along the shoreline which can support vegetation including tidal wetlands species. Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III -Policies Pages 16 through 21 for evaluation criteria. Yes No X Not Applicable This project will not have any affect on suitability of or availability of drinking water on Fishers Island Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. X Yes No Not Applicable This proiect is consistent with this policy because it proposes the natural stabilization of the shoreline above the intertidal zone bottom sediments through which adjacent tidal wetlands vegetation may spread. The site is heavily shaded by trees surrounding the cove. Tidal wetland vegetation alone the shoreline is patchy as shown on the survey. No adverse impact on tidal or submerged vegetation is anticipated as a result of the proposed proiect. The stone configuration shown on the drawings provides an optimum balance between acceptable design and shoreline protection standards without depriving the wetlands vegetation the opportunity to spread. Policy 7. Protect and improve air quality in the Town of Southold. See LWRP Section [II - Policies Pages 32 through 34 for evaluation criteria. Yes No X Not Applicable There is no solid waste or hazardous substances to be generated from this project. PUBLIC COAST POLICIES Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. See LWRP Section III -Policies; Pages 38 through 46 for evaluation criteria. Yes No X Not Applicable This project is being built upon and emanating from private land above (landward ofl public trust lands and waters of the State The public trust Lands and waters constitutes the area between the mean high water line and mean low water line and the resources are from the high tide line, out These environmental resources are being protected by the design standards which are acceptable to the NYS DEC as well as the Town. There is virtually no public use of the waterfront in this area and the restoration of the shoreline protection landward of and above the apparent high water line are not likely to influence or change this fact. WORKING COAST POLICIES Policy 10. Protect Southold's water-dependent uses and promote siting of new water-dependent uses in suitable locations. See LWRP Section III -Policies; Pages 47 through 56 for evaluation criteria. X Yes No Not Applicable This project is to restore the effectiveness of shoreline protection for a damaged and eroding coastal bluff This residential usage of the site while not considered water dependent, is consistent with zoning and current land use planning documents of the Town and is therefore consistent with the State's Coastal Management requirement while protecting existing habitat and resources. Policy 11. Promote sustainable use of living marine resources in Long Island Sound the Peconic Estuary and Town waters. See LWRP Section III -Policies; Pages 57 through 62 for evaluation criteria. ' ~C vE 4 'y' . ti:.. h. Photograph 1 This photograph shows the eroded point along the easterly edge of the Baccile property looking north from the pier. The line of armor stone were placed approximately 5 years ago under a DEC permit issued by Mr. Chuck Hamilton. It is clearly visible that the soils from the eroding bank has washed through the stone and out onto the beach. It is felt that the placement of uniform gradation of stone from 1 inch to 12 inches in diameter would help to stabilize and protect this azea from inundation induced erosion. The degree of erosion on the bank in this case is clear. Vegetation is almost obliterated on the sediments at the base of the bluff. The landscaped bank of the Crisp property is visible in the upper left hand corner. W~I`{, -y, 4 Photograph 4 This photograph shows the stone landward of the steps which run from the Baccile dock down to the shoreline on the north side of the structure, east of the bank. While the vegetation and growth on the bank is significant in terms of leafy branchy cover, it is completely inadequate to protect the bank from eroding under exposure from flooding conditions in Hay Harbor and even the mildest wave conditions.
