This memorandum is in response to a request made by the Zoning Board of Appeals on July 17, 2013 and is a
supplement to the memorandum dated June 23, 2013 provided to the Zoning Board of Appeals. The applicant is
requesting a Variance from Article XXII Code Section 280-116(6) based on an application for building permit and
the Building Inspector's April 24, 2013 Notice of Disapproval concerning a permit fora 10'X15' covered
deck/gazebo, at; 1) proposed structure at less than the code required bulkhead setback of 75 feet, located at:
8630 Peconic Bay Boulevard, (adj. to Great Peconic Bay and Private Road) Laurel, NY. SCTM#1000-126-5-1.
1. The Board of Trustees Wetland Permit (TR8012) allows the applicant to re-establish the top-of-bluff
(slope) landward of the proposed gazebo structure, which is consistent with the location of the top-of-buff
prior to the massive erosion on the property as a result of Tropical Storm Sandy (Figure 1). The revised
plan/survey submitted (dated July 12, 2013, by Nathan Taft Corwin) shows the top of bluff in an area that
is drastically different than the top of bluff location approved by the Trustees and the location of the top of
bluff prior to Tropical Storm Sandy.
It is recommended that the applicant restore the top of bluff pursuant to the Board of Trustees
approved plans (Figure 2) prior to review of a proposed Gazebo location.
It is critical that the restored bluff slope is engineered to achieve the maximum stabilization of the toe
(achieved by the new bulkhead) and soils (achieved by slope and re-vegetation). Re-vegetation of the
bluff slope to "pre storm conditions" is referenced on the survey and permit approved by the Board of
Trustees, however, a re-vegetation plan has not been submitted.

Gentlemen:
At the hearing yesterday, Mr Goehringer requested that I have new surveys
prepared reflecting the government's FLOOD ZONE, or "V.E." line on my
property to comply with a suggestion from Mark Terry of the LWRP. I have
enclosed 8 copies of the new surveys reflecting this.
Also at the suggestion of the Board, I had the proposed location of the
replacement covered deck placed landward this line. This is also reflected on the
new surveys.
I also had the surveyor include the distance of the "V.E." line from the back of the
bulkhead (11 feet) as well as the distance of the "V.E." line from the corner of the
house (44 feet).
I trust this alteration adheres to the recommendation of the Zoning Board. If not,
or if I can be of further help in expediting the matter, please contact me as soon
