STEPHEN LICATA #6679 SCTM#1000-144-5-13 Note that a Southold Town Board of Trustees permit was not found for the patio, fire pit, stone walls or pergola. STEPHEN LICATA #6679 -Request for Variance from Article XXII Code Section 280-116(8) based on an application for building permit and the Building Inspector's June 28, 2013 Notice of Disapproval concerning a permit to construct additions and alterations to an existing single family dwelling, at; 1) proposed construction at less than the code required bulkhead setback of 75 feet, located at: 670 Old Salt Road (adj. to Peconic Bay) Mattituck, NY. SCTM#1000-144-5-13. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is INCONSISTENT with the below listed LWRP polices and therefore INCONSISTENT with the LWRP: Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The "as built" oerQOla patio stone walls and fire pit were constructed without the benefit of review and/or permits. Aerial photos indicate that thev were constructed sometime between 2007 and 2010. Policy 6.3 Protect and restore tidal and freshwater wetlands. D. Provide adequate buffers between wetlands and adjacent ornearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. If the action is aooroved, it is recommended that a oeroetual landscaaed buffer (15' in width) be required landward from the concrete seawall. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Steve and Amy Licata purchased this home 7 years ago and they would like to make certain renovations that will make the home more suitable to their needs. The only changes to the structure will be on the roof with a) the construction of dormers which wilt improve the appearance of the house and b) a roof deck to be constructed over an existing screen-in porch. Finally, the "as built" pergola has not created an undesirable change in the neighborhood because, again, the structure enhances the appeazance of the rear portion of the house. (2) The benefit sought by the applicant CANNOT be achieved by some other method feasible [or the applicant to pursue, other than an area variance, because: There are no other methods to pursue as the bulkhead is fixed at 57' from the house rather than the required 75'. (3) The amount of relief requested is not substantial because: There is no increase in the building's footprint, there are ao side yard or front yard encroachments, and the exterior changes will only serve to enhance the appearance of the house. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: This is a relatively small house compared to the surrounding houses and, by adding the proposed roof structures, the exterior alterations will improve the overall appearance. The "as built" pergola has no adverse impact on the physical or envvorunental condition. Has the alleged difficulty been self-created? ( )Yes, or (X )No. Does this variance involve as-built construction or activity? (X )Yes, or ( )No. An "as built" variance is requested for an existing pergola.
