Domino Telephone (631) 765-1892 Michael U~' ~i Fax (631) 765--66441 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD December 11, 2013 Mr. Sal Varano 6600 Indian Neck Lane Peconic, NY 11958 RE: SAL VARANO 6600 INDIAN NECK LANE, PECONIC SCTM# 86-7-4.3 Dear Mr. Varano: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, December 11, 2013: WHEREAS, SAL VARANO applied to the Southold Town Trustees for an Amendment to Wetland Permit #8060 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated November 15, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies 4.1 & 6.3 of the Local Waterfront Revitalization Program to the greatest extent practical through the imposition of the following Best Management Practice requirements: issuance of permit on structures; reduce the size of the existing 10'x16' platform to 100 sq. ft., and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, and, 2 0 WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirements imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, BE IT FURTHER, RESOLVED, that the Southold Town Board of Trustees APPROVES the Amendment to Wetland Permit #8060 for the as-built 3'x5' landing leading to a 3'x12.6' set of stairs to a 100sq. ft. platform with a second set of 3'x8' stairs that continue down to a 3'x5' landing which transitions to a 3'x16' walkway leading to a cantilevered 4'x4' platform with associated 3'x6' stairs to beach, and as depicted on the project plan submitted by Sal Varano, received on December 19, 2013, and stamped approved on December 20, 2013. This is not a determination from any other agency. The retaining wall was constructed; however, pre-existing beach stairs and deck were replaced. The Board required the Verano family to obtain a wetland permit for the pre-existing beach stairs and deck. Please be advised that in the Town's records for an adjacent property the pre-existing deck was a much larger roof covered deck (Gazebo). At the hearing, the Board asked Mrs. Verano to revise the plan to conform to the Trustees regulations. The deck is constructed landward of the bulkhead and over the retaining wall. I have modified the deck to add handrails which partition and separate the deck from the stairs. The handrails would make the deck less than 100 sq. ft (91 sq ft) and the walkway and stairs remain 3 ft in width. This would comply with the code which states that "Platforms associated with stairs may not be larger than 100 square feet." The cost of replacement of Storm Damaged structures has been very costly. Town of Southold PO Box 1179 54375 Main Road Southold, NY 11971 Dear Sirs: I would like to submit an application to amend an existing permit granted by the Board of Trustees regarding repairs and stabilization of the bluff at our family house at 6600 Indian Neck Lane, Peconic which was a direct result of Hurricane Sandy in October 2012 and ask for your consideration. We would like to add the repair and replacement of the stairs and deck which lead down the bluff to the beach to this permit. The omission of these entities was an oversight on my part After the hurricane there was significant damage to the property and substantial erosion of the bluff, a condition exacerbated by a Nor easter in January. As the property sits well over 25 feet above bay level, there has been a set of steps and a deck down to the beach which has been there for what we believe to be close to 100 years, which is the approximate age of the house. The steps to the beach were completely eradicated during the storm, and the steps and decking down the bluff suffered significant structural damage. As part of the stabilization and restorative process our dock builder Joshua Horton built a new retaining wall and repaired and replaced the steps and deck. Since these items had been part of the landscape of this property for decades, I was unaware that it was necessary to require a permit for these repairs. I apologize for this honest oversight. I have included with this application some dated photos showing the presence of the stairs and deck prior to this devastating storm The repairs were made with all natural untreated wood, and the treads specifically are untreated hardwood. As requested, I have also attached drawings to most accurately illustrate the present condition. The project was a significant undertaking, but it has stabilized and preserved the bluff area for hopefully decades to come. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) Ensure stability of the bluff upland of the existing bulkhead to prevent further erosion and damage as sustained through Super Storm Sandy. 2.) Protect native vegetation on the bluff and upland areas that are currently damaged, destabilized by Sandy erosion. 3.) Achieve bluff stabilization for this property as well as the adjacent properties on both sides that have retaining walls supporting the bluff. 4.) Re-vegetation of the bluff with appropriate native vegetation within the proposed fill areas and throughout the bluff where needed. Current Status of bluff and upland areas. 1.) The waterfront bluff portion of the property has been badly damaged by Super Storm Sandy leaving mature natural vegetation destroyed, the bluff badly eroded and unstable.
