Scripps PROPERTY LOCATION: 2745 Pine Tree Road, (adj. to Little Creek) Cutchogue,NY SCTM#1000-104-3-6 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 2, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 5, 2013. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION Parcel is an improved 33,184 sq. ft. lot, with a two story framed dwelling and an accessory garage. It has 108.67 feet on the west side of Pine Tree Rd, 373.12 feet on the southerly property line, 359.21 feet on the northerly property line and 116.63 feet on Little Creek. As shown on site plan prepared by Frederick R. Weber, Architect dated May 30, 2013. BASIS OF APPLICATION: Request for variances from Article XXIII Section 280-124 and Article III Section 280-115 and the Building Inspector's June 13, 2013 Notice of Disapproval based on an application for a building permit for additions and alterations to existing single family dwelling at; 1)Less than the code required minimum side yard setback of 15 feet; 2) Proposed construction will result in existing accessory garage in a location other than the code required rear yard. RELIEF REQUESTED: The applicant requests variances to construct an addition onto an existing home with a 9 ft. side yard setback. The proposed construction will place the existing accessory garage partially in the side yard. ADDITIONAL INFORMATION: All additions and alterations being proposed are landward of the bulkhead structure and tidal wetlands. This applicant had three prior variances the first #5295 in 2003 for additions to Page 2 of 3 August22,2013 ZBA#6668—Scripps SCTM#1000-104-3-6 accessory garage with habitable space was denied, 45685 in 2005 for a dormer addition within the side yard setback which was granted as applied for and #6069 in 2007 was for additions and alterations within the side yard setback, combined side yard setbacks and within 75 feet of the bulkhead which was granted. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 8, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: I. Town Law 5267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The requested variances consist of two additions to the front of the existing home, a total of 422 square feet. The proposed additions 186 square foot addition will place the existing accessory garage partially in the side yard area, an area not permitted by code. The single side yard exists at 9 feet. The proposed additions to the front of the dwelling are modest in size and will not impact the immediate neighborhood, which consists of several waterfront homes on similar size parcels. 2. Town Law 5267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The parcel consists of an existing home centered on a waterfront parcel with a non-conforming side yard. The existing architectural layout of the interior rooms requires that the proposed expansion be located in that area, thereby expanding the non-conformity and requiring a variance. With regards to the existing accessory garage, the only option for the applicant to pursue other than a variance would be to remove or move the existing garage to a conforming location in the front yard area, which would be unreasonably expensive. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial. Putting the accessory garage partially in the side yard represents 100% relief from the code. However, the proposed additions to the home will not change the existing placement of the garage on the subject property where it has been located without detriment for many years. The proposed additions at 9 feet from the side yard represent a 40% relief from the code which requires a single side yard of 15 feet. However the additions will maintain the existing side yard and are proposed in the only logical location relative to the interior layout of the existing house. 4. Town Law &267-11h(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will not have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant is requesting a variance that occurs often when accessory structures are unattached and constructed parallel to the primary dwellings. In the past the board has granted the applicant variances to have a single side yard setback of 9 ft. (see ZBA file No. 6069 and ZBA Ref. No 5685). 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. The grant of this variance is the minimum action necessary and adequate to enable the applicant to make additions onto an existing structure while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dames, seconded by Member Weisman (Chairperson), and duly carried,to Page 3 of 3 August 22,2013 ZBAk6668—Scripps SCTMN1000-104-3-6 GRANT the variances as applied for and shown on the site plan dated May 30, 2013 and architectural drawings dated October 1, 2012 last revised May 30, 2013 titled Addition/Renovation Scripps Residence and Elevation page dated June 22, 2013.by Frederick Weber Architect. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
