VICTORIA E. SCOLARO, Trustee of The Marrelly Family Trust UlI dated April 17, 2Q13, currently
maintaining an office address at 4 Seabrook Lane, Stony Brook, New Yark l 1790
party afthe second part,
WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of the
second part, the heirs ar successors and assigns of the party of the second part forever.
ALL that certain plat, piece ar parcel of land, situate, lying and being at Sauthald, in the
Town of Sauthald, County of Suffolk, State ofNew York, known and designated as Lot 7
as shown an a certain map entitled "Subdivision Map of Long Pond Estates, Section One,
situate at Southold, Town of Southold, County of Suffolk, State of New Yark" and filed
in the Suffolk County Clerk's Office an December 27,1985 as Map Na. 837.
This conveyance is subject to all of the terms and conditions of the protective covenants recorded
affecting the subject premises.
Together with an easement over the streets as shown on the filed map far ingress and egress to the
public highway, the bed of such street being reserved herein for dedication to the Town of
Southold.
Said premises being known as and by District 1000, Section 55, Block 7, Lot 4 on the Land and
Tax Map of the County of Suffolk and as and by the street address Long Creek Drive, Southold,
New York.
This covenant is subject to the utility easement recorded June 17,1981 in Liber 9018 page 550 in
the af~ce of the Clerk of the County of Suffolk, the right~af way agreement recorded in Liber
8541 cp 192 and the utility easement recorded in Liber ] 0130 cp 303.
The party of the f rst part, does hereby reserve to herself, far the duration of her lifetime, the use
and occupancy of the premises conveyed, with full enjoyment thereof.
BEING AND INTENDED TO BE the same premises conveyed to C. Kenneth Morrelly and
Catherine A, Morrelly, his wife, by Deed of Jeffrey D. Farchelli, dated July 11, 1990 and
recorded in the Ofljce of the Suffolk County Clerk on July 30,1990 in Liber 11110 at page 413,
T~~ETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises; TO I-IAVE AND TD HOLD the premises herein granted unto the party of the second part,
the heirs or successors and assigns of the party of the second party forever.
AND the party of the first part covenants that the party of the f rst part has not done ar suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first~part, incompliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total
of the same far any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this Indenture so requires.
