VanTuyl, licensed surveyor, Greenport, N.Y., dated Feb. 27, 1948 and filed in the Office of the Clerk of the County of Suffolk on the 22nd day of November, 1948 as and by the Map No. 1663. beginning at the southwesterly corner thereof and at a point of intersection formed by the easterly side of a public highway known as Williams Road and the northeasterly side of a public highway known as Smith Drive North; Running Thence in a general northerly direction along the easterly side of said Williams Road, North 4 degrees 30 minutes East a distance of 173.00 feet to the existing high water mark of West Creek; Running Thence in a general easterly direction along the existing high water mark of said West Creek, a distance of 85.32 feet to a point; Running Thence South 22 degrees 23 minutes 10 seconds West a distance of 183.00 feet to the northeasterly side of said Smith Drive North; Running Thence in a general northwesterly or westerly direction along the northeasterly side of said Smith Drive North, as the same curves a distance of 30 feet to the point or place of beginning. Being the same premises as that registered to Phyllis Michaels on August 30, 1979 in certificate of Title No. 110,479. TOGETHER with all right, title and interest, If any, of the Grantor in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the Grantor in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the Grantee, the heirs or successors and assigns of the Grantee, forever. AND the Grantor covenants that the Grantor has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the Grantor in compliance with Section 13 of the Lien Law, covenants that the Grantor will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the Improvement and will apply the same first in the payment of the cost of the improvement before using any part of the same for any other purpose. The words Grantor and Grantee shall be construed as if they read Grantors or Grantees wherever the sense of this indenture so requires.
