(631) 765-1809 • Fax (631) 765-9064 MINUTES SPECIAL MEETING THURSDAY JULY 25, 2013 A Special Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held at the Southold Town Hall Annex, Capitol One Bank Building, First Floor Conference Room, 54375 Main Road at Youngs Avenue, Southold on Thursday July 25, 2013 commencing at 5 00 P.M. Present were Leslie Kanes Weisman, Chairperson/Member Gerard P. Goehringer, Member George Horning, Member (via video conferencing) Ken Schneider, Member Eric Dantes, Member Vicki Toth, Zoning Board Assistant Call to Order at 5:20 P.M. by Chairperson Weisman. STATE ENVIRONMENTAL QUALITY REVIEWS' A. New Applications reviews (pending). EXECUTIVE SESSION: 5 20 P.M. Motion was offered by Chairperson Weisman seconded by Member Goehringer to enter into Executive Session. Vote of the Board Aves All This Resolution was duly adopted 5-0 . 5:59 P.M. Motion was offered by Chairperson Weisman seconded by Member Goehringer, to exit Executive Session. Vote of the Board: Ayes All This Resolution was duly adopted (5-0) POSSIBLE BOARD RESOLUTION TO CLOSE THE HEARING ON KEVIN GALLAGHER and DOROTHY GALLAGHER #6662 - This is a request for a Waiver of Merger under Article II, Section 280-10A, to unmerge Land identified as SCTM #1000-70-10-61.7, based on the Page 2 -Minutes Special Meeting held July 25, 2013 Southold Town Zoning Board of Appeals Building Inspector's January 9, 2013, updated March 21, 2013 Notice of Disapproval, which states adjoining conforming or nonconforming lots held in common ownership shall merge until the total lot size conforms to the current bulk schedule (minimum 40,000 square feet in this R-40 Residential Zone District) this lot is merged with lot 1000-70-10-62.1, located at: 1800 Park Way and 40 Beachwood (adj. to Goose Creek) Southold, NY. SCTM#'s 1000-70-10- 61.1 & 62.1. BOARD RESOLUTION: Motion was offered by Chairperson Weisman, seconded by Member Goehringer, to close the hearine reserving decision. Vote of the Board: Aves: All. This resolution was duty adopted (5-0) POSSIBLE BOARD RESOLUTION TO CLOSE THE HEARING ON JOHN ABBOTT #6663 Request for Variance from Article XXII Code Section 280-116(B) based on an application for building permit and the Building Inspector's April 24, 2013 Notice of Disapproval concerning a permit for construction of a 10'X15' covered deck/gazebo, at. 1) less than the code required bulkhead setback of 75 feet, located at: 8630 Peconic Bay Boulevard, (adj. to Great Peconic Bay and Private Road) Laurel, NY. SCTM #1000-126-5-1. BOARD RESOLUTION: Motion was offered by Chairperson Weisman, seconded by Member Horning, to adiourn the hearine to August 8 2013 at 2:00 u.m. Vote of the Board: Aves: All This resolution was duty adopted 5-0 . The Board proceeded with the Agenda as follows: DELIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: The Board continued with agenda items, and commenced deliberations on the following applications. RESOLUTION ADOPTED: Motion offered by Chairperson Weisman, seconded by Member Goehringer, to set the next Regular Meeting with Public Hearings to be held August 8, 2013 at 8:30 AM. Vote of the Board: Aves: All. This Resolution was duly adopted (5-0). B. RESOLUTION ADOPTED: Motion offered by Chairperson Weisman, seconded by Page 3 -Minutes Special Meeting held July 25, 2013 Southold Town Zoning Board of Appeals Member Goehringer, to approve minutes from Regular Meeting held July 11 2013. Vote of the Board: Aves: All. This Resolution was duly adopted (5-0) C. POSSIBLE AMENDED DECISION: Brown #6652, discuss possibly amending condition #2. BOARD RESOLUTION: Motion was offered by Chairperson Weisman seconded by Member Goehringer to amend Condition #2. Vote of the Board: Aves: Members Weisman (Chairperson) Goehringer Schneider Dantes Navs: Member Hornine. This Resolution was dul~pted (4-1) WORK SESSION A. Requests from Board Members for agenda items. B. Further discussion on accessory Cabanas/bath houses on bulkhead. C. Withdrawal of ZBA #6657, MCMANUS. D. Code Enforcement Officer update. E. New B&B template. There being no other business properly coming before the Board at this time, Chairperson declared the meeting adjourned.
