Present were: Audrey Horton, Acting-Chairperson Jack McGreevy, Member John Stein, Member Lauren Standish, Secretary Absent were: Peter A. Young, Chairman Doug Hardy, Member Derek Bossen, Member William McDermott, Member CALL TO ORDER The meeting was called to order at 4:40 PM by Acting-Chairperson Audrey Horton. ANNOUNCEMENTS The Fishers Island Town Board Meeting will be held on Wed., August 7, 2013. Peter Young and John Stein will attend and represent the CAC. Audrey Horton announced that this will be her last meeting as she has sold her home and will be relocating out of state. She will follow-up with a resignation letter to the Town Clerk. Audrey has made valuable contributions to the CAC and she will be sorely missed. ' 2' APPROVAL OF MINUTES Moved by John Stein, seconded by Jack McGreevy, to Approve the Minutes of June 12, 2013. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT 8 COASTAL EROSION PERMIT APPLICATIONS Moved by John Stein, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of MICHAEL MANTIKAS to demolish the existing dwelling and construct new dwelling and foundation within the same footprint. Install new sanitary system and remove old according to Suffolk County Health Dept, and install a new drywell. Located: 80 Oak Court, East Marion. SCTM#37-6-3.3 Inspected by: John Stein Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of ALBERT & BARBARA REIBLING to remove and replace 151 If. of storm damaged bulkhead with new vinyl bulkhead. Replace 30 cy. of clean fill lost during storm. Replace 27'X 9' deck and 4'X 8' stairs to beach lost during storm. Located: 75 Island View Lane, Greenport. RESOLVED to SUPPORT the application of FEHIM & SEVGI UYANIK to construct alterations to existing dwelling including roof pitch and connection to addition, and one- story addition 55'X 46' to existing dwelling with 10'X 33' patio on grade, cut back existing 440 sf. patio adjacent to top of bank/bluff and reduced in size to 200 sf., new sanitary system in front yard more than 100' from bulkhead, and install drywells in conformity with drainage code, and haybales along top of bank during construction. SCTM#44-1-4 Inspected by: John Stein Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of SHAMGAR CAPITAL, LLC/DANIEL BUTTAFUOCO to construct additions and alterations to an existing two-story single-family dwelling; eliminate the existing sanitary system and replace with new sanitary system to the west of the dwelling; redirect current driveway; and install drywells and roof gutters and leaders. Located: 1165 Kimberly Lane, Southold. MELHADO to install a floating dock and ramp and to remove five (5) dead trees. Located: 820 Smith Drive South, Southold. SCTM#76-3-21.3 Inspected by: John Stein Vote of Council: Ayes: All . 4. Motion Carried Moved by John Stein, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of DAVID TURNER to remove and construct new 60' bulkhead using vinyl sheathing and in same location as existing with two returns to remain in place; 3' wide stairs with handrails; and 24 cy. of clean sand fill at the bulkhead. Plant 10' area at top of embankment with indigenous plants; new crushed stone driveway leading to the garage; and install three (3) drywells for roof run-off. Demolish existing dwelling down to foundation and demolish garage and shed. Repair foundation and construct new dwelling with atwo-story extension, new garage and sanitary system. BOYD to repair/reconstruct in place a 3'X 24' stair/platform to bulkhead, a 13'X 7' platform, 3'X 7' stairs to beach, reconstruct 15' return with vinyl and for the existing 140' bulkhead. Backfill area with 25 cy. clean sand. Located: 3880 Paradise Point Rd., Southold. SCTM#81-3-9 Inspected by: John Stein The CAC Supports the application with the Condition the beach stairs are retractable and constructed with untreated materials. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of PAUL GROBEN to replace in same location 50' of fixed dock @ 4' wide, 28' of fixed ramp @ 3' wide, a 3' wide aluminum removable ramp @ 12' in length, a 4' wide X 16' long floating dock secured by 2 sets of mooring pilings. All lumber treated except railings and decking. Located: 3705 Wells Rd., Peconic. WETLAND to terrace and revegetate the slope of the bank including jute stapled to bluff, coirlogs at base of bluff and coirlogs placed on bluff staked with 4' hardwood stakes. Located: 6485 Nassau Point Rd., Cutchogue. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by John Stein, it was RESOLVED to SUPPORT the application of 9820 NASSAU POINT, LLC to restore and stabilize storm eroded embankment as follows: excavate and remove vertical sheer/lip at top of embankment and regrade to shift top of embankment landward and re-establish more stable angle of repose; use approx. 30 cy. of resultant material together with approx. 30 cy. of clean sand trucked in from an approved upland source to renourish face of embankment with native plantings; such as Cape American beach grass, switchgrass, Virginia Rose, and/or Northern bayberry. Located: 9820 Nassau Point Rd., Cutchogue. SCTM#118-6-10 Inspected by: Audrey Horton, Jack McGreevy The CAC Supports the application with the Condition of a 20' non-turf buffer and recommends a return along the southeast corner of the property. Located: 435 West Rd., Cutchogue. SCTM#110-7-11.3 Inspected by: Jack McGreevy, Audrey Morton The CAC Supports the application with the Condition the beach stairs are retractable and recommends the corners of the bulkhead are redesigned because the existing design could compound the problem. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by John Stein, it was RESOLVED to NOT SUPPORT the application of PATRICA GILCHRIST-MANCINO to construct 102' vinyl bulkhead return along the easterly property line; remove existing concrete rubble from property and backfill return with approx. 50 cy. clean sand to be trucked in from an approved upland source; re-set any temporarily relocated concrete rubble located in adjacent roadway against seaward face of return; and remove and replace landscape walls and columns associated with driveway and parking area, as needed. SCTM#117-10-15 Inspected by: Jack McGreevy, Audrey Horton The CAC does Not Support the application based on the following: Public access has been denied; • There is an open electrical wire within the lawn area; and • Recommend the property owner and the Town submits a joint application to redesign the road end. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Audrey Horton, it was RESOLVED to SUPPORT the application of DAVID & ELIZABETH ROSS to install approx. 135 If. of 1-2 ton stone armor (over +/-100 Ib. core stone on filter cloth) along toe of and atop existing buried steel bulkhead; and restore storm eroded berm area landward thereof with approx. 400 cy. clean sand to be trucked in from an approved upland source and revegetated with Cape American beach grass (planted 12"-18" on center). Located: 170 Park Ave., Mattituck. SCTM#123-8-24.1 Inspected by: Audrey Horton, Jack McGreevy y The CAC Supports the application with the Condition the returns (rip-rap) are extended along the east and west ends. WALLERIUS to reconstruct in-place 104' of bulkhead utilizing vinyl sheathing; install two 10' vinyl returns; reconstruct, as necessary, 3.5'X 5' walk, 3.5'X 18' stairs, 3.5'X 8' walk and install a new 4'X 4' platform, 3.5'X 14' beach access steps, and truck in 50 cy. clean sand and restore bluff with native plantings. Located: 4230 Peconic Bay Blvd., Laurel. SCTM#128-4-24 Inspected by: Audrey Horton, Jack McGreevy The CAC Supports the application with the following Conditions: • Awell-written bluff stabilization plan; • Retractable beach stairs; Installation of drywells to contain roof run-off; and • Installation of a 3' non-turt/vegetated buffer. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by John Stein, it was RESOLVED to SUPPORT the application of ROBERT A. POTDEVIN to reconstruct 103' bulkhead using vinyl sheathing, reconstruct 10' return; and reconstruct as necessary with untreated lumber existing stairs, platforms and beach access steps. Located: 4250 Peconic Bay Blvd., Laurel. SCTM#128-4-23 Inspected by: Audrey Horton, Jack McGreevy The CAC Supports the application with the following Conditions: • Awell-written bluff stabilization plan; • Retractable beach stairs; • Installation of drywells to contain roof run-off; and • Installation of a 3' non-turf/vegetated buffer. Vote of Council: Ayes: All Motion Carried 8 AMANDA J.T. AND RICHARp E. RIEGEL to construct 80 If. of 5' wide fixed wood pile and timber pier with water and electric utilities, stairs to beach and a 25'X 6' wide "L" including two new and three replacement tie off piles. Recap an existing stone wharf with concrete, 30 cy. over 750 sf. and landward of the apparent high water line. Located: 3651 Crescent Ave., Fishers Island. SCTM#6-1-18 The CAC did not make an inspection, therefore no recommendation was made. DISCUSSION AND RECOMMENDATION OF APPLICATION5 TO AMEND WETLAND & COASTAL EROSION PERMITS THOMAS APREA to Amend Wetland Permit #6884 to replace in-place the south bulkhead 75' and the west bulkhead 62', within the interior of the boat slip. Located: 500 Beach Court, East Marion. SCTM#37-7-9.1 The CAC did not make an inspection, therefore no recommendation was made. Moved by John Stein, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of GABRIEL SCIBELLI to Amend Wetland Permit #6354 to extend west return 60' and ground level to protect from property to the west where bulkhead is not being maintained. Located: 450 Cedar Point Drive East, Southold. SCTM#90-2-15 Inspected by: John Stein Vote of Council: Ayes: All Motion Carried JAMES & JANET D'ADDARIO to Amend Wetland Permit #4995 to extend existing bulkhead @19" to adjacent bulkhead of SCTM#126-5-3.1 and for the existing retaining walls landward of the bulkhead at top of bank and bottom of bank @ 98' in length. Located: 8860 Peconic Bay Blvd., Laurel. SCTM#126-5-4 The CAC did not make a recommendation because a member observed a possible Wetland Code violation. The house was being demolished and a large number of trees were being removed. BRIAN DeBROFF to Amend Wetland Permit #7890 and Coastal Erosion Permit #7890C to remove mortared stone seawall 58 If. and rebuild using larger stone 75 cy. over 250 sf. Located: 271 Gloaming Ext. Fishers Island. SCTM#10-9-14 The CAC did not make an inspection, therefore no recommendation was made. 9 John Stein will attend the next regular meeting of the Board of Trustees scheduled for Wed., July 17, 2013 at 5:30 PM. The next meeting of the Conservation Advisory Council has been set for Wed., August 14, 2013 at 4:30 PM at Down's Farm Preserve.
