consideration paid by the party of the second part, does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the party of the second part forever,
ALL, that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying attd being at Arshamomaque, Town of Southold, County of Suffolk and State of New York,
designated as Lots Nos. 70, 71 and 72 on a map entitled, "Amended Map A, Peconic Bay Estates" which
was filed on May 19, 1933 in the Suffolk County Clerk's Office as Map No. 1124 being more particularly
bounded and described as follows:
BEGINNING at a point on the easterly side of Bayshore Road, distant 280.64 feet northerly from the
corner formed by the intersection of the easterly side of Bayshore Road with the northerly side of Island
View Lane;
THENCE North 16 degrees 59 minutes 20 seconds West along the easterly side of Bayshore Road 150.00
feet;
THENCE North 73 degrees 00 minutes 40 seconds East 143.00 feet to the average high water line of
Peconic Bay;
THENCE Southerly along the average high water line of Peconic Bay along a tie line bearing of South 17
degrees 45 minutes 10 seconds East a distance of 150.0] feet;
THENCE south 73 degrees 00 minutes 40 seconds West 145.00 feet to the easterly side of Bayshore Road
at the point or place of BEGINNING.
SAID premises being known as and located at 3855 Bayshore Road, Greenport, NY 11944, and on the
Suffolk County Lartd and Tax Map as District ] 000, Section 053.00, Block 06.00 and Lot 019.000.
BEING and intended to be the same premises conveyed to the party of the first part by deed dated
Decernber 24, 2002 and recorded iu the Suffolk County Clerk's Office on March 5; 2003 in Liber
D00012238 page 809.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE
AND TO HOLD [he premises herein granted unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
