WITNESSETH, that the party of the first part, to whom the letters testamentary were issued by the Surrogate's Court
of the State of New York for the County of Nassau on April 23, 2013,
and by virtue of the power and authority given in and by said last will and testament, and in consideration of
$245,000.00 dollars,
paid by [he party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
and being in the Orient, in the Town of Southold, County of Suffolk, and State of New York, known and designated as
Plot No. 7l, on a certain map entitled "Map of Orient-By-The-Sea, Section Two, situate at Orient Point, Town of
Southold, Suffolk County, New York, owned and developed by Woodhollow Properties, Inc. #5 Glen Lane, Glenwood
Landing, New York, Otto W. Van Tuyl and Son, Licensed Land Surveyors, Greenport, New York" and filed in the Office
of the Clerk of the County of Suffolk on October 26, 1961, as Nap No.3444, ABS No. 3840 and being more particularly
bounded and described according to said map as follows:
BEGINNING at a point on the northerly side of North Sea Drive where the same is interested by the division line between
lot 34 as shown on a certain map entitled "Map of Orient -By-The-Sea, Section One filed November 21, 1957, as map no.
2777 and lot 71 on aforesaid map. which point is also distant 106.55 feet westerly when measured by the line along the
northerly side of North Sea Drive, from the corner formed by the intersection of the northerly side of North Sea Drive and
the westerly side of Three Waters Lane;
RUNNING THENCE north 85 degrees 57 minutes 40 seconds west along the northerly side of North Sea Drive 172.86
feet to a point which point is also the intersection of the division line between lots 71 nd 72 on aforesaid map with the
northerly side of North Sea Drive;
THENCE north 4 degrees 02 minutes 20 seconds east along last mentioned division line 125 feet to a point nn the
southerly line of land lot 31on file map no. 2777;
THENCE south 85 degrees 57 minutes 40 seconds east along the southerly lines of lots 31, 32 and 33 on map no. 2777,
172.86 feet to a point which point is the division line between lot 34 on map no. 2777 and lot 71 on aforesaid map;
THENCE south 4 degrees 02 minutes 20 seconds west along last mentioned division line 125 feet to the northerly side of
North Sea Drivo, point or place of BEGINNING.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof;
TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in
said premises, and also the estate therein, which [he party of the first part has or has power to convey or dispose of,
whether individually, or by virtue of said will or otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever.
AND the party of the first part covenants [hat the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration For this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
