(631) 765-1809 • Fax (631) 765-9064 RE EIVED '}'" ~N. ~~ Southold Town Clerk FINDINGS, DELHIERATIONS AND DETERMINATION MEETING OF JULY 25, 2013 ZBA Application No.: 6662 Applicants/Owners: Kevin Gallagher and Dorothy Gallagher SCTM:1000-70-] 0-61.1 & 62.1 Property Location: 1800 Park Way and 40 Beachwood (adj. to Goose Creek), Southold, NY SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type [I category of the State's List of Actions, without further requirements under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 17, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated June 27, 2013. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. Additionally, it was noted that the parcel is environmentally sensitive with a tidal wetland occurring in the south. Wetlands were last delineated in 2007 and an update should be requested to determine the area of buildable land. Upon review of an updated survey submitted by the applicant, the LWRP Coordinator recommended that the Board impose a clearing limit as noted on the original 2000 survey or that a non-disturbance buffer of fifty (50) feet be established to mitigate potential impacts on Goose Creek. BASIS OF APPLICATION: Request for a Lot Waiver under Section 280-11 to unmerge a vacant land area of 22,192 square feet (CTM 1000-70-10-61.1) from an adjacent land area of 19,769.95 square feet (CTM 1000-70-10-62.1), based on the Building Inspector's Notice of Disapproval dated January 9, 2073 and updated March 21, 2013 pursuant to Section 280-10(A), determining the properties have been merged. Page 2 of 3-July 25, 2013 ZBA 716662 - Ga Ilagher SC7M M1000-70-10-61.1&62.1 ADDITIONAL INFORMATION: During the hearing the applicant's agent was asked to provide an updated survey showing the current flood zones on the subject property. On July 25, 2013 the Board received the requested information showing the revised wetland line and the area of buildable land. Comments were requested from the Planning Board. In a memo dated July 17, 2013, the Planning Board objected to the waiver of merger stating concerns that the parcel contains developmental constraints that could result in adverse impacts on the physical or environmental conditions in the neighborhood. Additional information provided on July 25, 2013 by the applicant's agent included a letter of opinion dated July 25, 2013 prepared by Joseph Fischetti, PE., which states; the majority of the proposed house and proposed sanitary system is in an X zone (no flood zone). The proposed house will be constructed to FEMA regulations. The front of the house and sanitary system will require simple grading of approximately one foot to match the grade at the street. The standard shallow sanitary system may be constructed and will not require retaining walls. An additional letter with comments and analysis was submitted dated July 25, 2013 prepared by Bruce Anderson, MS., president of Suffolk Environmental Consulting, Inc., stating, in pertinent part; there was a prior Town Trustee approval for a single family dwelling in 2000 when Mary and George Mayer owned the subject vacant lot, and a NYSDEC tidal wetland permit was granted; that the construction would have to comply with FEMA regulations and the septic system would be approved by Suffolk County Health Department in compliance with today's standards. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July L 1, 2013, at which time written and oral evidence were presented. Pursuant to § 280-11 the Applicant has submitted documentation, to the satisfaction of the Board that these lots were merged consequent to being owned by family members. There have been no transfers of ownership outside the family since the time merger was effected. Pursuant to §280-11, the Zoning Board finds that: (1) The waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood because: Southwood Subdivision contains lots that are similar in size to the two lots that are proposed to be un-merged. The average size lot in the Southwood subdivision is 20,000 square feet. The undeveloped subject lot (SCTM #1000-70-10-61.1) is 19,770 sq. fr. and is located in a densely populated built-out neighborhood. (2) The waiver would recognize a lot that is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation. Dorothy Gallagher purchased the vacant property with a separate deed and at a separate time from the neighboring property. The subject vacant lot has a separate address and tax map number from the adjoining lot. The prior owner's only owned the vacant lot and no other adjoining lots. The subject vacant lot is completely vacant and undeveloped and the existing vegetation on the lot is not maintained and grows naturally. (3) The proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district because the subject lot at 1800 Parkway Drive SCTM No. (1000-70-10-61.1) is the only undeveloped lot in the 53 lot subdivision in which it is located, and therefore one more home would not have a substantial impact on [he neighborhood. After construction of a house the existing grade in the rear of the property can be maintained at existing grade. The standard shallow sanitary system may be constructed in the front yard and will not require retaining walls. This property has adequate sandy soils and adequate elevations for a standard shallow sanitary system. The establishment of a fifty (50) foot non-disturbance buffer will further protect the wetlands and Goose Creek from any potential impacts. Based upon the findings described herein and in the Additional Information section of [his decision and in the public record, it is the Board's determination that the environmental concerns of the Planning Board have been sufficiently addressed and mitigated. Additionally, the Board will impose a condition on this waiver of merger that was recommended by the LWRP Coordinator on July 25, 2013 in a second review of the subject lot to establish a 50 foot non- disturbance buffer from the border of the wetlands to the buildable area of the lot, as shown on the survey by Nathan Taft Corwin, Land Surveyor, dated October 21, 1997, last revised July 18, 2013 in order to bring the lot into more conformity with the town's land water preservation program. RESOLUTION OF THE BOARD: In considering and balancing the above factors and pursuant to the Waiver Provisions of the Town of Southold Merger Law, Section 280-I 1, motion was offered by Member Dantes, seconded by Member Goehringer, and duly carried to: GRANT, the waiver of merger as applied for and as shown on the survey by Nathan Taft Corwin II, Land Surveyor dated October 21, 1997, last updated July 18, 2013 subject to the following condition(s): CONDITIONS: I . Proof that waiver of merger is effected by way of a deed from the applicant to a separate individual or entity conveying title to that portion of the property known as 1800 Parkway Drive C'FM ] 000-70-10-61.1 be provided to the ZBA within 2 years of the date of this decision. Failure to comply with this condition will result in nullification of the waiver of lot merger granted herein. 2. A fifty (50) foot non-disturbance buffer, as defined in town code, shall be established landward of the tidal wetlands line shown on the survey dated July 18, 2013 by Nathan Taft Corwin I(, Land Surveyor and delineated by Suffolk Environmental Consulting, Inc. on July 16, 2013. The Planning Board strongly opposes the application to unmerge the above referenced parcel for the following reasons: A 4,250 sq. ft. lot was originally created in 1953 with the filing of the subdivision "Map of Southwood." The creation pre-dates zoning regulations in the Town. The lot was increased to its current size (19,769 sq. ft.) due to deposition of dredge spoil/fill. 2. Although the parcels surrounding the proposed action are similar in size, this action would create anon-conforming lot that is less than 40,000 sq. ft. required in the R-40 zoning district by the Southold Town Code. 3. The parcel contains the following developmental constraints that could result in adverse impacts on the physical or environmental conditions in the neighborhood: a. Marine wetlands: To protect water quality of marine systems town regulations require a 100' setback from a wetland boundary. Due to the width of the lot, the 100' setback line severely impedes the development of the lot. Note the wetland boundary was delineated in 1997 and should be updated. b. Flood zone: The majority of the parcel is located in the FEMA AE el 7 Flood Zone. Areas subject to inundation by the 1- percent-annual-chance flood event. Unmerging this lot will cause additional development to be placed in the flood zone. This is inconsistent with the Town's Comprehensive Plan which recommends limiting development in these areas (Southold's portion of the Suffolk County Multi-Jurisdictional Multi-Hazard Mitigation Plan) c. Low grade elevations and fluctuating groundwater tables: The plans indicate that the grade will be raised to accommodate the residence due to low grade elevations. The low elevations coupled with fluctuating ground water levels often impede the function of sanitary systems and subsurface storm water controls, leading to pollution of the adjacent surface waters. 4. The parcel is adjacent to Goose Creek a NYSDEC Critical Environmental Area. INAY U 3 2013 • • DOARD OF APPEALS (~~6a- The vacant lot to be un-merged was originally Lot 11 in the filed subdivision of "Map of Southwood", Approved by the Southold Town Board and filed on November 24, 1953 with the Suffolk County Clerk as map No. 2141. The original lot was approximately 85' x 50', however, prior to DEC and Trustees jurisdiction in 1977, Goose Creek was dredged and the spoils were added to several creek front lots, including Lot 10 (adjacent) ,Lot 11, and Lot 12(adjacent)...making the lots on the filed map larger and equal in size to the other lots in the subdivision. The lots in the Southwood subdivision are recognized lots. The Town Board placed a note on the map requiring Lot 10 to be enlarged by deed, as described properties. The adjacent land was acquired and added to the lots. The lot has historically been treated and maintained as a separate and independent residential lots since the date of its original creation. The lot to be un-merged has not been transferred to an unrelated person or entity since the time the merger was effected. Lot 62.1 (House Parcel) Kevin & Dorothy Gallagher purchased the house on May 5, 1994. The house is known as 40 Beachwood Lane. On November 21,1995 Kevin & Dorothy placed the house in Dorothy Gallagher's name for estate planning. In November 4, 2004 Dorothy Gallagher placed the house back in both Kevin and Dorothy Gallagher's name. Lot 61.1 (vacant lot) was purchased by Dorothy Gallagher in 2000 from George & Mary Mayer, who had owned the lot since 1977 as a separate lot. This application is an alternative to that provided for under other Town Code provisions available for an area variance. Merger occurred between 2000 and 2004 when Dorothy was the common owner of both the vacant lot and the house parcel. Mr. Gallagher cashed out his pension to purchase the lot. Mr. And Mrs. Gallagher are now retired and living off of Social Security, they need to sell the lot as they had planned when they purchased this property. They continue to live in their Southold house in the summer and wish to continue to live here. The purchaser's attorney reviewed the single and separate search and discovered the period of common ownership between 2000 and 2004. The sale of the lot has been indefinitely placed on hold until the waiver of merger is approved. APPLICANT'S REASONS: (1) The waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood because: Southwood Subdivision contains similarly sized Tots of 20,000 sq.ft., this is a densely populated area of similarly sized parcels. In the 70's some of the waterfront subdivision lots along Goose Creek were expanded as was required by the Town Board and noted on the map; The Building Department recognized these lots as "described parcels". The Gallaghers purchased the parcel by separate deed. Mr. And Mrs. Gallagher live in Florida and were not aware that lots could not be placed in the same name. The two parcels have different addresses; The vacant lot address is Parkway and the House is 40 Beachwood. The properties receive separate tax bills and the house on 62.1 is centrally located on the lot since 1977 (building permit #9547 and C.O.); a building permit was issued in 1990 for a deck (building permit #18918 and C.O.). The lot to be recognized is similarly sized to the neighboring lots in Southwood subdivision. The surrounding community was developed from the 1960's to the present day. (2) The waiver would recognize a lot that is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation because: Each lot has a separate address and Mr. And Mrs. Gallagher purchased two separate parcels. The owners have prepared a survey with all the regulatory requirements, they had negotiated to sell the lot, but the single and separate prepared by the prospective purchaser found that the lot and house had merged at one point when the properties were owned by the Gallaghers. Thereafter, the properties were again placed in separate name. However, in response to their memorandum dated July 17, 2013 we wish to provide the following response together with the updated survey and opinion letter from Joseph Fischetti, PE.: The Town Board, being the legislative body of the Town of Southold, approved the subject lot. The Town Board approved the four lots in the subdivision, with a notation that they are to be sold only when their side lines extended to the ordinary high water mark. The subject lot (subdivision lot 11), as well as subdivision lots 10, 12 and 13 have complied with this subdivision condition since 1971. These subdivision lots have been sold independently and all but the subject lot is fully developed. My client has been assessed by the Town of Southold as a 19,769 sq. ft. buildable waterfront parcel. The lot has been single and separate during the ownership of the Gallagher's predecessors in title since the lot creation. The merger to their adjacent home occurred only during a four year period for the Gallagher's due to estate planning. The lot was thereafter separated and has remained single and separate to the present. Southold Town Zoning Board of Appeals July 25, 2013 Page 2 ~~~ ~~ The Planning Board acknowledges that the parcel is similar in size to surrounding parcels. In fact, this lot is the last undeveloped lot in the 53 lot subdivision known as ~~Map of Southwood". According to the tax map, only one lot in the neighborhood, SCTM#1000-70-10-63.2, was intentionally combined in order to build a larger waterfront house extending over the combined subdivision lots. The adjacent Gallagher home is developed in conformity with the applicable setbacks. The subject parcel has no greater development restrictions than any of the other properties in the neighborhood. In fact, the current regulations will mitigate all impacts of the last new single family dwelling in this neighborhood. The proposed plan shown on the updated survey by Nathan Taft Corwin III, LS dated July 18, 2013, shows a house and sanitary which is a better plan with lesser environmental issues than what had been previously approved by the Southold Town Trustees. Upon approval of the waiver of merger, any proposed house plan will be reviewed again by the Southold Town Trustees and appropriate buffers and environmental safeguards will be adopted. As to the specific issues sited by the Planning Board: (A) Marine Wetlands: In accordance with your request, my client has obtained an updated survey with the updated wetland delineation and flood zone. Most, if not all of the waterfront Southwood lots are within the jurisdiction of the Southold Town Trustees and all have received approvals to build, expand, or modify their single family homes. The construction of a new house on the subject parcel will be regulated by the Southold Town Trustees pursuant to Town Code Chapter 275. Whether this lot is merged or separate, it will be subject to Trustee's jurisdiction. The proposed house was subject to the Trustees jurisdiction in 2000 when it was owned by Mayer, and the Trustees granted Mayer a wetland permit to construct a house, new sanitary, well, and 350 cy of fill. To protect the wetlands, the Trustees established a ~~clearing limit". The current plan would be similarly developed. However, the house can be built without fill and will be connected to public water. According to Joseph Fischetti, PE, who has reviewed the proposed house and sanitary, the front yard will be graded to 6' elevation which is the elevation of the road. A standard construction requirement. (see attached Fischetti opinion letter) Southold Town Zoning Board of Appeals ~ `~~ ~~ July 25, 2013 Page 3 (B)Flood Zone: The Flood Zone was not shown on the 2000 survey plan, nevertheless the finished floor elevation of the proposed house which received Trustees approval was shown at proposed elevation 10. As was requested, the new survey includes the Flood Zone. The majority of the proposed house and the proposed sanitary is Zone X. The southerly part of the property is Zone AE elevation 7. The construction of a house would be of standard construction, with the finished floor elevation at a minimum elevation 9. Construction at Flood Elevation 9 complies with the Town's FEMA requirement. Compliance with FEMA therefore complies with the Suffolk County Multi-Jurisdictional Multi- Hazard Mitigation Plan. (C)The test hole shows suitable conditions for a standard shallow pool sanitary system. The conditions of the subsoils are good permeable course sand and standard storm water controls will be designed specifically for the property. The proposed plan shows proposed drywells for roof runoff with gutters and leaders. The Town's adoption of Chapter 236 requires proper drainage structures. There is 5 feet of depth of fine to course sand which is sufficient depth for storm water controls. The municipal drainage grate in the street is evidence that drainage structures function in this area. Finally, the construction of a single family dwelling is a Type II SEQRA action. Consequently, pursuant to SEQRA regulations, there is no adverse impact with the construction of a single family dwelling to Goose Creek (a NYSDEC CEA). The above is corroborated by the opinion letter provided by Bruce A. Anderson of Suffolk Environmental Consulting Inc. herein attached. Based on the above, as well as the record during the hearing, the proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district. For example, the seasonal fluctuation of groundwater in the more central portions of the Town would likely be measured in feet whereas the seasonal fluctuation of groundwater on a waterfront property would likely be measured in inches. (M) While Goose Creek may have been deemed a Critical Environmental flrea by NYSDEC, the construction of a single-falnIly dwelling is a Type II Action pursuant to 5EQRA.
