(631) 765-1809 • Fax (631) 765-9064 Sou hold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JULY 25, 2013 ZBA FILE: 6665 NAME OF APPLICANT: Dina Masso PROPERTY LOCATION: 5705 Nassau Point Rd, Cutchogue, NY SCTM# 1000-11 1-]3-04 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under [he Suffolk County Admtmstrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 24, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated June 24, 2013. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION The subject parcel is 33,799 square feet in an R-40 District. The parcel fronts Nassau Point Road for 100.48 feet, has a northern property line of 349.42 feet, a southern property line of 327.38 feet and is waterfront on the Little Peconic Bay along a Tie Line of 100.49 feet. The parcel is improved with a I Story Frame House, a bulkhead, decks, wood stairs with landings from the top of the bluff to the bulkhead. All as shown on the "Survey of Property" prepared by John Metzger, L.S., dated October 25, 2012, last revised May 14, 2013 (revision) BASS OF APPLICATION: Request for Variance from Article XXllI Section 280-124 and the Building Inspector's May 3, 2013, amended May 16, 2013 Notice of Disapproval based on an application for building permit for additions and alterations to an existing single family dwelling, at; 1) less than the code required total side yard setbacks of 35 feet, located at: 5705 Nassau Point Road, (adj. to Little Peconic Bay) Cutchogue, NY. SCTM#1000-111-13-4 RELIEF REQUESTED: The applicant requests a variance to construct an addition to the dwelling which will result in a 29.9 foot Total Side Yard where the Code requires 35 feet. FINDINGS OF FACT/ REASONS FOR BOARD ACTION Pagc 2 of 3 -July 25, 2013 7.BA#6665 - Masso SCTM# 1000-III -13-4 The Zoning Board of Appeals held a public hearing on this application on July 11, 2013, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(31(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed addition will be constructed with the same style of architecture and materials, which is in character of this neighborhood. The side yard setback of the proposed construction is proposed at 19.7 feet, which is greater than the code required single side yard setback of 15 feet, which should mitigate any detriment to the adjoining property owner. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant desires to expand the existing Kitchen and Den, which expansions/additions are only feasibly constructed in their proposed locations. 3. Town Law &267-b(3)(bl(3). The variance granted herein is mathematically substantial, representing a 15% relief from the code. However, in the area of the proposed addition, the applicant will be removing an existing deck which has an existing 15 foot side yard setback which is more nonconforming than what the applicant proposes. The proposed addition will have a 19.7 foot side yard setback and will bring the parcel into more conformance with the Code required Total Side Yard. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(31(b)(51. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing an addition to the dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Weisman (Chairperson), and duly carried, to GRANT, the variance as applied for, and shown on the Survey of Property, prepared by John Metzger, L.S., dated October 25, 2012, last revised May ]4, 2013 (revision), and the architectural drawing sheets A-100 and A-IOI, prepared by Meryl Kramer, R.A., dated Masso 04/05/2013. Any deviation from the survey, site plan and/or architecturad drawings cited in this decision wild result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The property consists of 34,508+- sq. ft. in area and is improved with gone-family, one-story frame house with wood deck areas and cabana. The existing dwelling construction is more particularly shown on the survey prepared by Peconic Surveyors, P.C. dated January 23, 1989. BASIS OF REQUEST: Building Department's July 31, 2001 Notice of Disapproval for the reason that under Article XXVI, Section 100-244, and Section 100-242A, the proposed two-story addition and proposed structural alterations to a nonconforming structure on a nonconforming lot (with a conforming use as a dwelling) is not permitted unless the side yard is a minimum of 15, and having a total of thirty-five feet. AREA VARIANCE RELIEF: The applicant proposes to construct alterations and addition over the existing footprint and maintaining the same nonconforming southerly side yard at 10 feet, at its closest point, shown on the 11-17-00 plans prepared by Donald G. Feiler, R.A. REASONS FOR BOARD ACTION DESCRIBED BELOW On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. Grant of an area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Applicant proposes to create asecond-story addition over the southerly part of the existing one-story dwelling, following the footprint of the existing first floor one-story dwelling which has a preexisting nonconforming side yard from the foundation -except for an 80 sq. ft. area on the south/west side of the first floor which is conforming and is not subject to this variance request. The southerly side yard property line contains mature trees, where the addition is proposed, and provides a buffer between the properties. 2. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to pursue, other than area variances because the existing side yard setback is nonconforming, and the applicant wishes to build a second story addition over the existing first floor foundation. 3.
