SIT-o(wn Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JULY 25, 2013 I_BA FILE: 6666 NAME OF APPLICANT: Ratso, LLC SCTM: 1000-52-5-58.2 PROPERTY LOCATION: 67875 Main Road (aka CR 25) (corner Albertson Lane), Greenport, NY SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type ll category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code § A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 8, 2013 stating that [his application is considered a matter for local determination as there appears [o be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under [he Minor Actions exempt list and is not subject to review under Chapter 268. There are no natural features for LWRP review. PROPERTY FACTS/DESCRIPTION The property is 45,634 square feet in size and zoned in a Light Industrial District. It has 260.00 feet of frontage on Main Road (C.R.25), 277.17 feet along Albertson Lane, 155.00 feet on the northern property line and 184.03 feet on the southwestern property line as shown on the survey dated October 22, 2012, last revised July 8, 2013 prepared by Nathan Taft Corwin, III, LS. A chain link fence surrounds the property. The entrance to the property is located on Albertson Lane, and a chain link gate controls the entrance to the property. On the property is a 3,200 square toot metal building. The vast majority of the property is covered by asphalt pavement and is used for storage of Construction equipment, materials, and containers. There is an industrial electric meter and transformer on the north side of property behind the building. The neighboring properties are also zoned Light Industrial districts and the properties are being used for industrial use. One of the neighboring properties is an uninhabited swamp. The property has green vegetation shading in front of the chain link fence making the property less visible from the street. BASIS OF APPLICATION: Request for Variance(s) from § 280-64A and Article XV Code § 280-63 and the Building Inspector's May 13, 2013 Notice of Disapproval based on an application for building permit for additions and alterations to an existing commercial building, at 1) less than the code required minimum front yard setback of 100 feet from the Right of Way, 2) less than the code required minimum rear yard setback of 60 feet. RELIEF REQUESTED: The applicant proposes to construct an office addition to the existing metal commercial building requiring variances for a front yard setback of 57.8 feet where the code requires a 100 foot front yard setback and a rear yard setback of 51.3 feet where the code requires a rear yard setback of 60 feet. because the Vage 2 of 3 -July 25, 2013 Z6A#6666-Ratso. LLC SC'rM# 1000-52-5-58.2 proposed construction on this 45,634 square foot parcel is in the LI Zone, with two front yards is not permitted pursuant to Article XV, § 280-64 A., which states, "Structures shall be set back at least 100 feet from the "Right of Way." The proposed construction notes a front yard setback of 57.5 feet from Albertson lane. In addition the proposed construction is not permitted pursuant to Article XV, § 280-63, which states, "No building or premises shall be used and no building or part thereof shall be erected or altered in the LI Light Industrial District unless the same conforms to the Bulk Schedule and Parking and Loading Schedules incorporated into this chapter by reference, with the same force and effect as if such regulations were set forth herein in full." The Bulk schedule requires a rear yard setback of 60 feet. Following construction the rear yard setback will be about 51 feet. The application requires site plan approval by the Southold Town planning board. ADDITIONAL INFORMATION: The property has previously been granted relief from the code in ZBA appeal number 4934 dated April 19, 2001 which allowed the occupant relief from the code to build the existing structure at a rear yard setback of 52 feet. According to testimony the applicant needs relief from the code in order to effectively run his business and needs the additional office space so that office staff and mechanical crews can work more efficiently and so that the flow of traffic and heavy machinery is not impeded. Currently office staff cannot always work inside the building at the same time as the mechanical crews. The property has limited space to store and use large trucks and other machines. The applicant can only place Che office in the proposed location because it is the only place that will not impede the flow of traffic and efficient running of his business. The Planning Board, in a letter dated July 9, 2013, approved the site plan drawn by Nancy Dwyer dated April 18, 2013 and supports the requested variances. The Planning Board stated, "that the subject parcel is zoned Light Industrial (LI) and is located in Greenport where the proposed light industrial use is consistent with the Town Code and the Town's comprehensive plan. The Planning Board supports the requested variances and states that the existing 3,200 square foot building will be partially screened by vegetated buffers which should mitigate any visual impact from the street." FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 11, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: I . Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because there is an existing industrial structure on the property and the neighboring properties also have industrial uses. There are a few residential homes across the street from the property, but there is evergreen vegetation screening making it difficult for them to see the property. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the property is on a cornerlot with front yards on Albertson Lane as well as the Main Road. The property has a building envelope that is small and substantially limits the Light Industrial use of the property. Also, the proposed office space will allow staff to view the entrance to the property and the garage bays allowing for improved security of the people who work there and the safety of the materials and equipment. 3. Town Law &267-b(3)(bl(3). The variances granted herein are mathematically substantial, representing 43.5% relief from the code in the front yard/right of way set back and a 15% relief from the code on the rear yard setback. However, the property has two front yards substantially limiting the scope of code permitted use and the existing building and proposed addition are/will be screened from view by vegetated buffers which mitigate visual impacts from both streets. Page 3 of3 -July 25, 2013 7.[3A#6666 - Ratso, LLC SCTMN 1000-i2-6-582 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this LI Zone will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install leaders and gutters and drywells if code requires. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an office space for his business to effectively work while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Goehringer, and duly carried, to GRANT, the variances as applied for, and shown on the site plan and drawings labeled pages 1-3 prepared by Nancy Dwyer and dated April 18, 2013. And as shown on the survey dated October 22, 2012, last revised July 8, 2013 prepared by Nathan Taft Corwin, I[I, LS. Subject to the following condition; CONDITION: 1. Applicant shall maintain evergreen plantings along Main Road to mitigate any visual impact from the street. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alderations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. 77ais action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. No. 4934 - PAUL J CORAZZINI Location of Property: 67875 Main Road, Greenport Parce11000-52-5-58.2 Date of Public Hearing: April 5, 2001 FINDINGS OF FACT PROPERTY FACTSJDESCRIPTION: The subject property is a 1.0475-acre lot looted on the Comer of the Main Road (S.R. 25} and Albertson's Lane, Greenport. The lot has two toed frontages, one of 287.17 feet along Albertson Lane and 2S0 ft. along the Main Road. The property is bested in the LI Light Industrial Zone District BASIS OF APPEAL Building Inspector's Notice of Disapproval dated December 18, 2000, denying an appFcation dated November 13, 2000 for a permit to build a c;orrtmerdal budding, for the following reasons: (1) ARide XIV, Section 100-142 requires 70 ft. mirdmum rear yard setback, and (2) Article XIV, Section 100-143C for the reason that "no single structure shall have more than sixty (ti0) pnear feet of frontage on one street. An amended April 4, 20001 Notice of Disapproval was issued replacing the above Notice of Disapproval, which negates the necessity for a variance under Section 1t)D-143C as to a building frontage limitation, based on AppeaUlnterpr+etation No. 4708 rendered by the ZBA 7/22/99. RELIEF REQUESTED: Applicant requests a variance to beats an 40x80 ft. storage building with a rear yard setback at 52 feet, instead of 70 feet, as shown on the November 7, 2000 site plan map_ REASONS FOR BOARD ACTION. DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the d~aracter of the neighborhood or a detriment to nearby Properties because, when considering the nature of appficanYs business and the size of the trucks and equipment that the applicant intends to store and work on within the proposed building, a 44x80 ft. building is the minimum size to allow adequate room. The building is proposed a; the center of the lot and will be screened from the road. The immediate neighboring Properties are other industrial zoned uses. 2. The 3lertefit sought cannot be achieved by some method, feasible for the applicant to pursue other than an area variance. The lot is a comer lot with iwo front yards (100 ft. and 77 ftJ. 3. The area variance is not substantial. 4. No evidence has been submitted to indicate an adverse effect or impact on the physical or environmental conditions in the neighborhood or district The building would be built observing the 100 ft. front yard setback with a 50 ft. natural buffer along the Main Road, thereby shielding it from • (2ECEIi/E© Pags 2 -April t9, 2001 K~b~ r „ ~ZBAAppI. Sent: Wednesday, July 10, 2013 11:21 AM To: Toth, Vicki Subject: Ratso Construction Vicki, To save Mr. Ratsey a second visit to the ZBA, I wanted to point out the fence shown on the site plan he dropped off to us yesterday. The fence is already up, and I'm told there is barbed wire on top (not sure if that matters; one of our Board members seems to think it does). You may want to run that through Building Dept to see if it has the proper permits and meets the code. Planning will certainly do so if you don't, but since he hasn't submitted his application to us yet the timing will be off if he needs any variances for that fence. Just an FYI along with the email I sent yesterday afternoon. Thanks, Brian Brian A. Cummings, Planner Southold Town Planning Department 53095 Route 25 P.O. Colin Ratsey came in about lOmin ago with an approved as-built site plan from March of 2007 showing a buffer reduction from the 2001 site plan approval that required 50' to NYS Rt. 25. The 2007 as-built shows a 25' wide natural buffer to Rt. 25 and Albertson Lane, which is consistent with the existing conditions of the site. If the buffer issue comes up we have copies of important portions of the as-built site plan on file here, but do not have access to the original plan just yet.
