Dear Mr. Purita,
The Southold Town Board of Trustees reviewed the survey prepared by Peconic Surveyors last
dated October 27, 2004 and determined the proposed Cluster Minor Subdivision and Lot Line
Change to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and
Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal
Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal
wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated
above, without a permit. It is your responsibility to ensure that all necessary precautions are
taken to prevent any sedimentation or other alteration or disturbance to the ground surface or
vegetation within Freshwater Wetlands, Tidal Wetlands jurisdiction, and Coastal Erosion Hazard
Area, which may result from your project. Such precautions may include maintaining adequate
work area between the freshwater wetland boundary, tidal wetland jurisdictional boundary and
the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay
bale berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion Hazard
Area would require permits from this office.
This determination is not a determination from any other agency.

Requested Action:
The applicant proposes to subdivide a 27.0309 acre parcel into 3 lots where Lot 1
equals 40,575 sq. ft.; Lot 2 equals 46,565 sq. ft and Lot 3 is comprised of 22.5227 acre
development right sale and a 2.5083 acre building envelope. A .8496 freshwater
wetland exists on the western property boundary. The plat shows a 100' buffer area
around the wetland and no development is proposed within this area.
The applicant proposes to sell development rights on 23± acres.

adopted the following resolution:
WHEREAS, the applicant proposes to subdivide a 27.0309 acre parcel into 3 lots where
Lot 1 equals 40,575 sq. ft.; Lot 2 equals 46,565 sq. ft and Lot 3 is comprised of a
22.5227 acre Development Right Sale and a 2.5083 acre building envelope; and
WHEREAS, the applicant has submitted an agreement, executed on March 21, 2002,
between the applicant and the County of Suffolk to purchase Development Rights on
Lot 3 (23+ acres); and
WHEREAS, the action, as submitted, meets the 75% preservation threshold as
specified in Local Law No. 3 of 2002; therefore, be it
RESOLVED, that the Southold Town Planning Board start the SEAR lead agency
coordination process for this Unlisted Action.
The plat has been referred to the Suffolk County Planning CommisJ4ion the Town of
Southold Police, the Southold Fire Department and Town Trustees for review and
