(631) 765-1809 Fax (631) 765-9064 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 30,154 sq. ft. lot has 99.58 ft. frontage along the south side of Peconic Bay Boulevard in Laurel. The property is improved with a single-family, two-story dwelling and two detached buildings, as shown on the October 12, 1999 survey prepared by John C. Ehlers, L.S., revised October 16, 2003, and rough diagram prepared by En -Consultants showing the relocation of the 4' x 8' step area. The existing dwelling is shown on the Ehlers survey at 65 feet from the bulkhead along the average high water mark. BASIS OF APPLICATION: Building Department's September 30, 2003 Notice of Disapproval, citing Section 100-239.46 in its denial of a building permit application concerning a porch extension at less than the code -required 75 feet from the bulkhead. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 22, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a 4' x 34' porch addition behind the dwelling at 60+- feet from the bulkhead along the high water mark and 45 feet from the closest, inner bulkhead, as shown on the plan revised October 16, 2003, prepared by John C. Ehlers, L.S., relocation of the existing 4' x 8' step area as shown on an undated diagram prepared by En -Consultants. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant wishes to add a 4 ft. porch extension behind the dwelling facing Great Peconic Bay. The building inspector has taken the Pagi -2 — February 12, 2004 • Appl. No. 5451 —Wilbur F. Osler, III CTM 1000-126-11-17 position that the closest point of measurement should be the closest bulkhead separating the upland from the beach area. This is depicted on the survey prepared October 12, 1999, revised October 16, 2003 to show the porch extension, with a proposed rear yard setback of 60+- feet when measured from the southeast corner of the proposed addition, and 45 feet to the closest bulkhead. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant has an older home built prior to the setback restrictions for new construction within 75 feet from the primary bulkhead. 3. The variance granted herein is not substantial and the 5+-% reduction from the 75 ft. requirement is the minimum that the Board will approve in this application. The present roofed, unheated porch will be expanded by four feet and the existing 4' step area relocated. 4. The difficulty was self-created in that the home was built many years ago, and became nonconforming when the bulkhead restriction was added to the current zoning code. 5. There is no evidence that the grant of the relief requested will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district. 6. Grant of the relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an extension, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the survey map dated October 16, 2003 prepared by John C. Ehlers, L.S. (and undated diagram prepared by En -Consultants clarifying the relocation of the 4'x 8' step area which was not shown on the 2003 survey). This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
